Brothers Tire did very inefficient,incomplete, substandard and untimely bodywork on my car. These actions caused mechanical problems with my car.On 10/02/2013, I talked with Mr.[redacted], owner regarding bodywork repair on my 2009 blue Hundai Accent. He requested me to bring car to shop on 10/3/2013 at 9:00am. I explained that the car was at [redacted]. He stated that he would tow my car to his shop if I authorize [redacted] to release it to him on 10/3/13. I called [redacted], and I gave the authorization. I called Mr. [redacted] on 10/3/13, but he was not available any on that day. [redacted], female employee informed me that he had not towed my car from [redacted], but she'll have him call me. I called Mr.[redacted] on 10/4/13, and he wasn't available again; however, [redacted] informed me that they had towed my car to thier shop. She stated that the bodywork person will look at it , and he will give her the estimatye. I requested [redacted] to tell Mr.[redacted] to contact me regarding the estimate and a contract. Two days had past, and I still had not heard from Mr.[redacted]. I never received an estimate, and I never received a contract to this date. I was never allowed to to talk to Mr. [redacted] after the initial conversation regarding my repairs for my car. I always had to sppeak to [redacted]. I went to the shop on several occasions for a period of two weeks, and [redacted] kept telling me that they had not started on my car because they were waiting on parts, and Mr.[redacted] was never there. On 10/13/13, I went by the shop after church to see if I could see my car through the garage glass; howeve, my car was not parked in a secured locked area. It was parked on the front parking lot closet to the street. I got out to check to see if any work had been done on my car, but very little had been done, and the paint did not match the other paint on my car at all. My car was unlocked, and all of my important papers had been removed from my glove compartment. There was newspaper balled up in the front seat of my car. I locked my car. [redacted], my car insurance had made several attempts to reach Mr.[redacted]; however,they would always have to speak to [redacted] had given [redacted] and [redacted] two to three different dates for the completion of the of the work on my car, but it was never ready whenI would go to pick it up. [redacted] informed me that [redacted] told them that my car woul be ready on 10/15/13 by 1:00pm and that I needed to turn the rental car into [redacted] on that date. When I had my friends to take me to pick up my car on 10/15/13, my car was not ready. [redacted] informed us that my car was not ready and that they were waiting on a pop-on part. I explained to her in front of my witnesses that I had to turn in rental car, and I needed my car. I asked to see Mr.[redacted] informed me that he was not there, but she would call. I told her that I wanted my car, and since I didnt have a contract, I would pay them $400 for the little and bouched-up work that they had done on my car. I reminded her that she never had Mr.[redacted] to call me back after I had called him on Monday, 10/14/13 to get a reason for my car being left out near the street in an unsecured place with my doors unlocked. She apologized. She texted Mr.[redacted] instead of calling him. We waited for over 30mins. but he did not show or call me. We called police. [redacted] called to tell Mr.[redacted] that police were there. That's when he came. Female police officer talked to him. He told her that I couldn't get my car until I gave him $1000 because he had put that much in parts and labor. I disagreed. Officer told me that I could not get my car off of his property unless I gave him $1000. I asked her why do I have to give him that amount because we had no verbal agreement or a contract. She told me to not ask her anything and that she would arrest me for Theft of Property o/$500 for Non-Payment of Services, so I had to give him the money to get my car. All of the lights were on on the dash. He would not allow us to come into shop to ask what they had done to my car. There was glass all in the trunk, back window and back seat of my car.Desired SettlementI would like $5000 in compensation for my out-of pocket expenses, mechanical repairs, car rental, pain and suffering, day off from work that I have incurred as a result of their negligence, incomplete bodywork, keeping it a secret that they had allowed someone to break into my car and vandalize it while it was in an unsecured area while in their care leaving all of the glass in my car and the stroke level bloodpressure and headaches that I suffered. Mrs.[redacted] stated that the estimate that [redacted] gave her was to high.Mrs.[redacted] said she was willing to pay $1000.00 for repairs,and thats all she can afford.Mr.[redacted] told her he will work with her.Mrs.[redacted] authorized [redacted] to release her car to [redacted] AT [redacted] WINCHESTER.WHEN THE GUY WHO DO THE BODYWORK TOOK A LOOK AT HER CAR.IT WAS MORE THAN $1000.00 WORTH OF DAMANGES AND LABOR.MRS.[redacted] WAS BEING VERY IMPATIENT WHILE THE CAR WAS HERE.SHE CALLED AND CAME BY EVERY OTHER DAY.WE HAD TO ORDER THE PARTS FOR HER CAR.WHEN ALL THE PARTS CAME IN AND THE REPAIRS WAS DONE,WE CONTACTED HER TO COME PICK UP HER CAR.WHEN SHE CAME TO PICK UP HER CAR SHE WAS BEING VERY DISRESPECTFUL,AND LOUD.SHE DIDN"T WANT TO PAY FOR THE REPAAIRS.MRS.[redacted] JUST WANTED TO PAY $400.00.MR.[redacted] TIRED TO CALM HER DOWN AND TALK TO HER.MRS.[redacted] DIDNT WANT TO HEAR ANYTHING MR.[redacted] HAD TO SAY,SO SHE CALLED THE POLICE.THE POLICE CAME AND HER CAR WAS COMPLETED,THEY MADE HER PAY.ONCE MRS.[redacted] PAID FOR HER CAR,SHE LEFT.A COUPLE OF DAYS LATER MRS.[redacted] FILED A FALSE POLICE REPORT STATING THAT MR.[redacted] VANDALIZED HER CAR.MRS.[redacted] HAD NO PROOF THAT HER CAR HAD BEEN VANDALIZED.NOW THAT THIS IS ALL SAID AND DONE.I THINK MRS.[redacted] WAS TRYING TO COMMIT AN INSURANCE FRAUD.[redacted]L PAID FOR THE DAMAGES,AND SHE ONLY PAID $1000,FOR HER REPAIRS AND DAMAGES.I KNOW THEY CUT HER A CHECK FOR MORE THAN THAT.MR.[redacted] WAS TRYING TO HELP HER BECAUSE SHE STATED THAT SHE NEED HER CAR FIX.AND SHE DIDNT WANT TO PAY ALOT OF MONEY.MR.[redacted] ACTUALLY LOST MONEY BECAUSE HE AGREED TO ONLY CHARGE HER $1000.MR.[redacted] WAS ONLY TRUING TO SATISFY A CUSTOMER.THE SERVICES WAS COMPLETED AND MR.[redacted] TOOK THE LOST,BECAUSE OF THE AGREEMENT WAS MADE FOR $1000.00 HE HONORED IT.Final Consumer Response In response to Brother's Tire's response, I spoke with a Mr. [redacted] on October 2, 2013. I don't know if that person is Mr. [redacted] because I don't know if Mr. [redacted] and Mr. [redacted] are one in the same person. I never discussed [redacted]'s Collision and Repairs estimate with Mr.[redacted]. I explained to him that [redacted] who is one of his employees's referred me to him. [redacted] told me that Brother's does body work, and I should give Mr.[redacted] a call. During the conversation that I was having with Mr.[redacted], he was continuously asking me the amount that of money that [redacted] was offering me. Mr.[redacted] and I never had a contractual agreement for $1000 fee for the repairs. Mr.[redacted] requested on October 2, 2013 that I call [redacted] and give them permission to release my car to brothers & drop off the estimate to [redacted]. I dropped the estimate at Brother's Tire on October 3rd, 2013. I gave it to [redacted]. I did speak with Mr.[redacted] at [redacted], and I told him that he could release my car to Brother's. However, Mr.[redacted] informed me that Brother's did not pick my car up until later on the next day. I received a call from [redacted] on October 4, 2013 informing me that Mr.[redacted] told her to call me and to let me know that my car would be ready on Tuesday, October 8, 2013. I contacted [redacted] (my car insurance company) because they needed to know how long that they would need to have me in a rental car. To this date, no one from Brothers has called me to inform me of the total amount or my damages or completes a contract for them to complete the work. I went to Brother's October 10, 2013 to pick up my car, and [redacted] informed me that my vehicle still wasn't ready. I informed [redacted], and they extended my rental car. She told me that they were waiting on parts. I asked for the owner again, and [redacted] told me he wasn't available. I requested that she have him to call me. I contacted [redacted], and they contacted Brother's. [redacted] called me back to tell me that they talk to [redacted], and [redacted] told them that my car would be ready October 12, 2013. I went to Brother's on Saturday, October 12, 2013. [redacted] told me that my car wasn't ready and they were waiting for one more part and for Mr. [redacted] to bring the paint, so Troy, the body repair man could paint the car. I told her that [redacted] wanted me to turn in the rental car. She apologized for my car not being ready. I contacted [redacted], and they told me that they would only be able to extend the rental car until Monday, October 14th 2013. I went to Brother's on October 14th 2013, Monday to pick up my car, and [redacted] told me that they were still waiting on a part. [redacted] never called me to tell me that my car was ready. I had to continuously contact them or go by the shop. I went that following Tuesday, October 15th 2013, [redacted] informed me that my car still wasn't ready because they were waiting on a part. I took witnesses with me on that day. Please see recorded visit in email that I sent you. Mr. [redacted] only showed up after approximately 45 minutes after I had to call the police because [redacted] refused to give me the keys to my car as they had not finished my car. If I didn't want to pay for the little work that had been done, why does [redacted] make the statement in her response that I offered them $400.00? The work on my car wasn't completed. Earlier in [redacted]'s brother's response, they made it seem that she called me prior to October 15th to inform me that my car was completed after I called the police. Which is it? She makes a statement that the police made me pay, but the police were only suppose to inform me that this was a civil matter. The police didn't have the right to force me to pay Mr. [redacted] one thousand dollars to get my car, or I would've been arrested on the spot if I took my car. My car was vandalized while in was the Brothers' care. Please refer to photos that I'm sending to you via certified mail.I am also sending [redacted] Collision Estimate. The estimate labor time should have been 28.9 hours, but Brothers' had my car 12 days, and the work still wasn't complete. Also, I am mailing you to the estimate from [redacted]. You may call Mr.[redacted] at [redacted] at (901)[redacted] or (901)[redacted] who will attest to the incomplete and non-quality work done on my car. Also, you may contact [redacted] at [redacted] at (901)[redacted] where I purchased and took my car when all the lights were on the dash, and my trunk was full of glass.
