Product discontinued / FALSE ADVERTISING SCAM !
I was sold a practice exam for an exam that was completely discontinued less than 7 weeks from when I purchased this. The website does not mention anywhere that the material would be obsolete in less than 2 months. I have had my time any money completely wasted. AND I have failed to take the exam before it was done away with because of the crooks. I need a complete refund the product is worthless with no exam to take. I spoke to them on the phone and they offered no compensation or upgrade to the current relevant exam AT ALL ! The product isnt even offered on their site anymore
I would like to be reimbursed for my money AND time that wase wasted by these con artists.
Boson Software specifically develops products to help customers prepare for certification exams provided by IT vendors such as ***. In the spring of 2019, *** announced a major change to their certification program to be effective February 24, 2020. Usually, customers who are interested in pursuing a vendor certification have studied the vendor Web pages to understand prerequisites and other necessary information prior to sitting for an exam. As a result of ***'s announced changes, on June 25, 2019 Boson published on our Web page our own Upgrade Policies to be effective June 1, 2019. These policies included free upgrades with specific purchases required to be eligible. Individual customers received targeted e-mail messages about the upgrades. This customer elected to purchase a particular practice exam on January 19, 2020. The vendor, ***, had already announced they were accepting exam submissions through February 23, 2020. The customer had several weeks in which to study for and sit for the vendor exam and failure to do so was not the fault of Boson. In fact, Boson had many customers urgently purchase our product(s) just so they could sit for the vendor exam prior to discontinuation. Further, the customer could have taken the vendor exam and, if failed, could have claimed a refund through our No Pass *** Pay Guarantee, also fully described on our Web page. Additionally, the customer could have originally purchased an upgradable combination as specified in our Upgrade Policy to be eligible to upgrade to a replacement product, but again elected not to take this step. We have, of course, communicated all of this information to the customer via the payment/chargeback system. Then, as now, we stand by our position that there were remedies available but because this customer failed to act upon any of the requirements, was was ineligible for any refund and/or upgrade of the product.
This complaint should have never been closed. They did not make an attempt to resolve anything. They should be sued for false advertising. Their product expired less than a month after selling it to me with NO notification at all.
Boson Software stands by our original response and position that the customer had sufficient notice and information to decide whether or not he wanted to purchase the available practice product and take the time to sit for the vendor exam he states we deprived him of. Additionally, similar language was posted on the actual page he would have used to place his order. If the customer placed an order without reviewing the product page, the burden is his.
Further, the product he purchased is still available for his use; we have not denied him the availability of the product he purchased in any way.
Finally, the payment processor also closed the customer's claim in Boson's favor. Revdex.com's response to close this claim was the correct one. This customer does not have a valid claim to a refund or a new product.
