Contractor was verbally authorized to remove hearth from fireplace so sub-contract company could install flooring in lieu of hearth while in condo replacing flood damaged floor When I got home the entire fireplace was gutted, drywall 2" from either side removed, window trim, and curtain rods removed on one side, firebox, mantel, and hearth removedPaid for labor for unauthorized work, then quoted $to fix error first timeAfter I logged a complaint, told $as a "special deal."
In addition, accepted partial responsibility for damaging personal property, but now is reneging on verbally agreed settlement of $
Most of the agreement to remove the hearth was verbal, except for the attached text messages between the manager Paul, and myself when the flooring company was going to go in, and I asked about the removal of the hearth before they went in. I had asked for a quote on doing some work on the fireplace, but had no intention of removing the old firebox or the rest of the walls, etc, as I was just replacing the electric insert. They had never responded to my email about a quote on the work, [redacted], as my other contractor for the flood insurance claim had rejected the work deeming no time to do it. I had discussed at least removing the hearth so the flooring could be done, and as you can see in the text that he acknowledged the flooring company could do the work, and they would bill me for the hearth portion. I [redacted] used the wrong word calling it the "mantel" but he still understood the error, and that it was the hearth I wanted done, so I didn't worry about correcting my error at the time. Attached is also the first quote I got for doing the repairs on the fireplace area for $2500, and the owners email to me asking me to verify that I had authorized the work or not. He didn't even know on October 18th whether the work was approved or not. So why am I expected to pay for work that wasn't authorized?
I have attached some emails we were sending back and forth. I said I would give her the cost of the statue and her renovation for free if she would let me test that statue. But if the glue tested was old she would have to pay for the testing and no free renovation. The best she...
could say was the test was expensive! I didn't care how much it cost because I know I was right and it was all about principal at that point.
