On October 28, 2019, I had snow tires installed and both front and rear differential fluids exchanged by Big O Tire in Grand Junction, Colorado. The next day, October 29, I began a trip in my vehicle East towards my home in Michigan. Approximately 80 miles into my trip, I heard a noise and felt my vehicle lurch as I was travelling on the interstate. Almost immediately afterwards I began smelling some kind of foul odor that to me smelled like burning oil of some kind. The car continued to drive at that time, and so I attempted to slowly drive it to the Subaru Dealership in Glenwood Springs, Colorado. Approximately one to two miles from my exit off of I-70, my vehicle, which had started to act strange, lost all power and I was stranded on the very narrow shoulder of the interstate for some time before a police officer came and pushed my disabled vehicle to a safer part of the shoulder. There I waited in a snowstorm for hours until a tow truck I had called arrived. The next day I talked with Glenwood Springs Subaru, and told them what had happened, and that I believed it was my transmission, which would be covered under an extended warranty if that were the case. They were very busy and needed some days to get to inspecting my car. After a few days, Glenwood Springs Subaru got back to me and said that they expected my transmission would be a warranty replacement, pending approval from Subaru of America. However, the next day they called me to ask if I had had any service done to my differential. I informed them that I had Big O tire do the 30,000 mile service on the front and rear before starting my trip. It was during this call that I understood what had happened, and that big O tire was liable for the damages. So, on November 6, 2019, I called the Shop Manager of the establishment in Grand Junction which had done the original service to inform him of the damages to my vehicle. He denied that his technician could have made that mistake and tried to end the conversation there. I asked him if there was anyone else I could talk to about this and he gave me the email address of Martin L. All communication between Martin and I was done via email. Martin refused to send a representative to inspect the vehicle for himself and I refused to allow Martin to take custody of my vehicle, as he wanted to tow it back to Grand Junction. My mother became involved and tried to negotiate an agreement with Mr. L. We got an outside shop (Jim's Auto Repair) in Glenwood Springs to provide a second opinion. They agreed the Big O technician had made a mistake, and was responsible for the damage to the transmission, and put in writing that they would testify to this in court. When it became clear Martin L had no intention of filing a liability claim and paying for the repairs to my vehicle, we authorized Glenwood Springs Subaru to complete the repairs. I regained possesion of my vehicle then on November 14, 2019 and completed my trip to Marquette, Michigan.
We were in contact with Guest, when we were made aware the Guest was having car problems we requested more information that we never received and that he allowed us to tow his vehicle to another Subaru dealership to get a second opinion. We never denied or accepted liability so before we do anything we would like to get a secomd opinion from another Subaru dealership.

I am rejecting this response because:
The message from Big O Tires is not truthful. All information was provided to them. Many calls and emails were exchanged between me, my mother ***, Justin the Glenwood Springs shop manager and Big O's Martin L. Photos were provided proving the mistake had been made by Big O Tires. A second opinion was obtained and provided, at my expense only after pleading with Big O to send their insurance adjuster to see for him/herself. It does not make sense to tow a car 200 miles for a second opinion, which can be obtained onsite. They refused to send their insurance adjuster. This behavior was categorized as atypical and unusual by the Glenwood Springs shop manager, Justin. *** was willing to negotiate on the price of repairs ,and the quote provided was less than it would have been were it a warranty/insurance repair as the attached email shows. But Big O Tires refused to even communicate after that email. Fact one: on October 28, 2019 the vehicle operated normally. Fact two: on October 29, 2019, after being "serviced" at Big O Tires, the vehicle malfunctioned and ceased operating entirely. Fact three: two different repair organizations came to the same conclusion that the tech at Big O made a mistake, causing the car to malfunction, both stating they would be willing to testify to this in court. Photographic evidence also proves this, as does simple logic. The only thing that happened to a fully functioning car between the 28th and the 29th is the tech at Big O drained the differential leaving it dry and mistakenly put the fluid in the transmission.Fact four: We have been trying to work this out with Big O since this happened. They have been unusually difficult in this regard, with respect to industry standard.
The normal course of action, according to Justin the Subaru shop manager, is that the shop contacts it's liability carrier, sends an adjuster, and admits their mistake. Big O refused to do that, forcing the repair to be put on a credit card and causing significant stress, delay, and expense. We are not looking for anything more than just reimbursement. It is really bad business to do this to people.
this is my last resort before filing a lawsuit. I Big O claims they will provide Top quality service provided by a team you trust. Martin L, their regional manager claimed to have integrity. My experience was opposite - service that actually ruined my transmission and a manager who refused to take responsibility. It's the worst experience I have ever had.

There are more documents in the google drive links that were sent to you that are relevant to this case, but here are some that I believe are most relevant including my original receipt for service from Big O Tire, the total of the repairs that Subaru of Glenwood Springs performed, an independan't shops findings concluding that Big O tire is liable for the damage, and an Email chain that details the treatment we received from the Regional Manager of Big O Tire.

We will accept liability for the damaged transmission on the 2014 Subaru forester, please provide all proper documents of repairs perfromed. We will take liability for the $7,705.40 quoted on 11/11/2019 by Justin service writer at Subaru in Glenwood.

I am rejecting this response because: it does not reimburse me for what I had to pay. The repair that was needed due to the error made by the Big O tech cost 8249.60 as the attached shows. The original service should be refunded (259.86) as well as the second opinion that Big O required me to obtain (67.67). The total due is $8577.15. I appreciate their taking responsibility for their mistake, however this is the least I am due. This does not account for my hotel and meals while I waited for the vehicle to be fixed. Thank you for your assistance.

I have reviewed the final response made by the business in reference to complaint ID, and find that this resolution is satisfactory to me. This represents the refund of the initial service which caused the damage, the repair itself, and the second opinion. I reserve the right to reopen a complaint should the business fail to comply and issue reimbursement within 21 days. I would like a representative from Big O to contact me personally, to go over details for reimbursement. This location replaced the wrong tire on my vehicle causing major damage. They refuse to compensate me for all of the damage but did agreed to pay for the value of one tire. They have not paid me a dime. They refuse to return my calls. They hang up on me when I have attempted to call.
we have contacted guest and offered her one free replacement tire out of good faith as she only purchased one (1) from us and we have the proper documentation on her invoice and from the vendor we purchased it from that the correct tire was installed.

I have documentation that I have also sent to their corporate, who have also spent the last 2 months making several attempts to reason with this franchise to do the right thing and accept responsibility for their error. Whether it was there error, or the company they purchased the tire from. I received the wrong tire and it caused major damage to the other 3 along with other damage to the car. The documentation that they are referring to is based on a receipt or order form from the company they got the tire from, all of which was written up by them with the intent to order, receive, and deliver the correct tire to me. It was up to them, or the company they ordered it from to make sure that their process was verified from order to delivery. Their documentation is meaningless as somewhere in that process, the tire that was ordered and installed was not the right one. They have NEVER, contacted me, I HAVE contacted them and was hung up on. A receipt is not proof and is not the only source or logical way to deal with this issue. This company has no desire to accept responsibility, even though they know they are in the wrong. I have offered to compromise with them and only have them pay for the cost of 2 tires instead of 4. They refused that. They haven't even made an attempt to compensate me for the tire I originally purchased. I am not interested in receiving any replacement tires from this company, only compensation for the cost of the tires.

Our operations team has reached out and has been unable to reach a resolution with this guest thus far. Our team has the proper documentation showing the purchased and installed tire is correct, however have offered to replace this tire for the guest in good faith. If the guest would like to contact me I can help arrange for an appointment to replace the tire. Thank you!

Nobody has attempted to contact me. The "documents" mentioned are not reliable given the documentation provided by me in return. There was too much damage to accept 1 replacement tire. Nor will I accept any tires from Big O Tires again. I have requested at a minimum a refund for the wrong tire I purchased, the additional 3 tires that were a result were requested and rejected, a compromise of at least 2 tires were also rejected. They've received my requests, complaints, requests and recommendations from their corporate, and this franchise has no desire to do the right thing.
