To whom it may concern,BBSC Endurance Sports produces race events in Nevada, Utah and ColoradoParticipants register for our events via our online registration form (www.flatironsevents.com)As stated in the original complaint, our event (the Lake Mead Marathon) was forcefully cancelled two days
prior to the event due to the Federal Government Shutdown on January 19, This cancellation was completely out of our control since it was caused by the Federal Government shutdown, and our event location was within the National Parks.Although we were prohibited from conducting the race, we still hosted two Packet Pick Up events to allow participants to come retrieve their shirts, medals and goody bagsThis is where I met *** ***, who came to packet pick up to claim her merchandiseWhen I met her, she was very neurotic and aggressive in demanding a full refundI tried to explain to her that entry fees go towards the production of the event and the materials that are purchased long in advanceThis includes contracts with vendors, travel cost for our staff to get to Las Vegas from Denver, course nutrition, marketing costs, the post-race meal, overhead, sanctioning fees, permits, shirts, medals, bibs, and awardsWhen an event is forced to be cancelled with only days notice, we (BBSC) do not receive any refunds for these items, so a full refund is not financially feasible since the money has been spentI also explained that BBSC is a small family company that operates on razor thin margins and we would not exist if we gave refunds for cancellations outside of our control.Furthermore, our insurance policy does not cover cancelled eventsAs a result, we have rules and policies, and waivers that all athletes have to acknowledge and sign when registering for our eventThese waivers and policies clearly state that if there is a cancellation due to factors that are out of our control, that there will be no refunds issued under any circumstances*** *** signed and acknowledged these policies when she registered for the eventAttached are the documents to support this claim. I am rejecting this response because:25% on another race isn't compensation it is marketing to drive up registration and not actually offering participants any of their entry back. If this were the case they would offer a refund of the 25%. The way they have it I would have to give their business MORE money just to try and recoup my funds. Additionally, trying to cut down a complainantant in the response to provides further proof as to the behavior I experienced in person. Mocking participants who were not just out money but out months of dedicated training. Additionally, I tried to compromise in asking for a deferral to another race instead of a refund when we spoke in person. Its called customer service, and business ethics. This company clearly does not have either.
