on Jan. 17th paid a $1200 dwn payment for a 2012 Chevy Avalanche. Dealership said everything was approved and let me leave the lot. 4 days later I was told the financing company failed to take the loan and the dealer wanted me to return the car. I returned the car on Jan. 23rd. Dealer DID NOT GIVE BACK DOWN PAYMENT. stated he was keeping it because of fees he had to pay. on Jan 31st. Dealer said they can find another finace company I can get the truck back. I paid an additional $600 dollars totalling $1800. again I signed paper work and dealers let me leave lot with vehical. stating first payment was due MAr. 1st. on FEB 17th my truck was repossessed for no reason. called dealer and they wouldnt give me an explaination. called Lender/ Finance company LOBEL and they started my account was still active but had notes that dealer picked up car because of missed payment. I DONT SEE HOW I HAD A MISSED PAYMENT AND IT WASNT DUE UNTIL MAR 1st and they took the truck on FEB. 17th. I have tried several attempts to contact owner to get a portion or all of down payment money and dealer refuses to refund a partial or full refund of $1800 dollars

The transaction in question started, on X-XX-XXXX when Auto Haven received a credit application submitted through our website www.theautohaven.com from Mr. ***.
Once the application was processed Mr. received and approval thru one of our finance companies, United Auto Credit. During the funding process qualifying criteria must be met in order for the company to finance the deal. That being said, Mr. signed the contract and provided said criteria being: Proof of Income in the form of check stubs, Bank statements, Proof of residence, Proof of Insurance, and 6 references.
At this time (XX-XX-XX) a $1200 payment was made via debit card using his pin # as his initial down payment. Two deferred payments were set up, one to be paid on XX-XX-XX of $600 & last payment on XX-X-XX of $600. Customer took possession of the vehicle.
Upon sending these documents to the finance department of United Auto Credit, it was found that Mr. had provided a falsified document for his proof of Insurance. We were notified by United Auto, that due to the fact that he provided a false document that the company would no longer finance the deal. The deal was denied.
We contacted Mr., he came in to the office, and we spoke about the document. Which he stated that he purchased the policy from a co-worker who sells insurance. We notified him that we would have to try and get him approved with another finance company if he was able to provide legit full coverage insurance. Mr. agreed and we (Auto Haven) took possession of the vehicle until further notice.
Within the week Mr. provided us (Auto Haven) with full coverage insurance and was approved with Lobel Financial.
All documents were submitted and we (Auto Haven) received the go-ahead on the release
On XX-XX-XX Mr. once again took possession of the vehicle and made a $600 payment towards his down. Final payment being due XX-XX-XX of $600.
On XX-XX-XX we (Auto Haven) received notification from our bank, Bank of America Merchant Services, of a Dispute/Charge-back on behalf of Mr. in the amount of $1200.
Upon receiving this we contacted Mr. on several occasions, ie: Calling his cell, leaving voicemails, sending text messages, contacting his references, and his job. To no avail. By this time Mr.' final payment of $600 came due, and we were concerned since we had no contact with him as to date.
We submitted all of the documents that we had pertaining to the charge of $1200 to Bank of America, to show consent of purchase by Mr..
At this point we started to think he was avoiding us. We went by his home, and his job, in which the vehicle was spotted in good condition. Knowing that he is still working and living were he said he did was good. We tried for a couple more days to contact him with no luck.
We called to verify that the insurance was in current status, only to find out that he cancelled the insurance two days prior to taking possession of the vehicle on 01-31-20. In that instant the vehicle went up for repossession due to default on 2-13-20.
The vehicle was repossessed on XX-XX-XX while parked at Mr. place of employment. Notification of said repossession was sent certified, to Mr. on 2-19-20.
The finance company was notified that the vehicle had been repossessed, and they also received a check for the buyback of Mr.' deal.
We have since received the $1200 owed to us from Bank of America Merchant Services after providing all required documents proving consent of purchase.
At this time with everything stated above and incurred costs, we do not feel that Mr. is entitled to any portion of his down payment.
