In April - July 2013 [redacted], owner and crew dug the hole for our in ground pool 4-8 inches too low for the grade of our back yard. They abandoned our project and went past the time frame they promised to be done. We had to fire them and they file a small claim that we won.
Review: I purchased a three person spa from Aqua Elite on 10-16-2013 and was told it would take two weeks for delivery which did not happened. [redacted] came to my home a week later to inspect the site where the spa was to be placed and assured me that my deck was fine and it would fit. I did not receive what I had purchased and delivery did not take place until December 2nd of 2013. The spa they delivered was a striped down model without the lighting package and the pumps was not as powerful as my friends spa. They baited and switched it with a striped down model. Furthermore, they damage my deck awning making alterations to it after he told me that the cover would not open with the cover lift installed on the spa. [redacted] told me he was a contractor and it would be easy to lift up the roof so it would work just fine. Since I had to return to work I left it to them finish the installation. They took a saws all to it and left it in an unsafe condition. I asked him to correct his damage and said that this was not the same spa that I ordered. [redacted] yelled at me and told me he was going to charge me for his time and labor but he did not bill me and expected me to correct the shoddy mess he left me with. He wrote me a letter on the 4th of December stating he told me the spa would not fit when he came to make the site inspection which was not true. I did not know the lighting package was not installed in the spa until the electrical contractor came the next day to hook up the spa. I asked for my money back and for him to fix my awning. He has not call or written me since December.Desired Settlement: I would like for [redacted] to provide me with the spa I purchased or return my money as well as pay for the damage he and his crew did to my property.

On 10/16/13 [redacted] came into our store and was
interested in a 3 person spa just like the one her friend purchased. We
explained that her friend bought the floor model which was at a discounted
price but we would honor the price excluding the colored lighting package. [redacted]
did not want to pay the additional $250 for the lighting package and said that
the standard white light would be fine. We wrote her a bid and she came back on
10/21/13 to order and pay for the spa.
We told her that the factory is 2-3 weeks out for production but had
been running as much as 5 weeks and that we would let her know as soon as the
spa shipped so we could arrange for delivery.
While we were waiting for the spa to be built [redacted] went to
[redacted] house to pre-site the delivery. He looked at the patio where the spa
was to be placed and told [redacted] that the patio cover was too low and that the
spa cover would not be able to open properly if the patio cover was not raised.
He asked her to raise the lattice patio cover or remove it.
When we arrived on 12/2/13 to deliver the spa the patio
cover was not only at the same height but a makeshift plastic roof had been
added. [redacted] offered to raise the patio cover for [redacted] and she agreed. We
raised the patio cover about 6 inches. The roof of this structure was made of
lattice and 2x2 wood sticks as support for the plastic roofing. It was clear to
us that this was a temporary structure because of the lack of strength it had
as well as the lack of lumber used as supports. We are sure this is also why
the [redacted] did not get a building permit for the patio cover – because a
permit isn’t required for temporary structures. We left the patio cover in a
similar shape as what we found it in. We are not sure why the [redacted] are
requesting us to reinforce a structure that was meant as temporary or why they
built it like that in the first place.
As for the “bait and switch” accusation, the spa [redacted]
received is the spa she ordered. It has the exact same pumps that her friend’s
spa has. This is simply verified by checking with the factory and referencing
the serial numbers. [redacted] declined to pay for the premium colored lighting.

On 10-16-13 I went into Aqua Elite Spa store and said that I would like to purchase the same exact 3 person spa that my friends just purchased. It is true that they informed me that they purchased the floor model and that it would take 2 to 3 weeks for delivery. I also called Aqua Elite on the 21st of November asking when I could expect delivery and [redacted] said it will take another two to three weeks before delivery because the factory was backed up on orders. [redacted] did not say anything about the discount price on the floor model or mention anything about the lighting package being an extra two hundred and fifty dollars more. At no time did he tell me the lights would cost more if he had I would have paid it. Also all the spas he showed me on the floor had lights on the outside of the floor model spas.
[redacted] was at my house when the electrician, the one he said was the person he often recommended, showed up to evaluate the site to place the power supply for my new spa. The electrician informed us that he had to remove my motion sensor light on the back of my home because it would be too close to the spa by law. At that point [redacted] left so I could finish my arrangements with the electrician. Moreover, this is another reason I purchased this spa because it had lights on the outside of the spa. Not only did the lighting package come with color lighting on the outside but each of the jets inside the spa reflected the same light. Mike lied to you when he said I declined to pay for the premium colored lighting package. He never offered or told me the lighting package would cost extra.
I sent you copies of my contract and my friends as well as a copy of the cost to repair my deck awing, did you receive them?
I text you this morning from my phone at work this morning but I started this letter to you on Sunday. I saw you had sent me a message on the 27th but could not reply. On the 28th I had a medical procedure, at the Northwest Orthopaedic Clinic that made it impossible to reply to your request.

We are not sure what else can be said in this matter. [redacted] received the hot tub that she
ordered as stated before. The deck roofing was left in the same condition that
we found it in.
We are sorry that [redacted] feels like she needs to
accuse us of pulling a “bait and switch” or of lieing. We have done neither. We have sold hundreds of spas over the last 8 years
and have never had a complaint of this sort. Our record clearly shows this.
Again, we are very sorry that there was an issue with [redacted].
