Initial Business Response /* (1000, 5, 2016/02/09) */
We disclose what we have knowledge of, Ms. [redacted] was never told it was not in an accident, all the information we give is what is required by law through the damage disclosure statement she signed. At the time the vehicle was sold it was not a...

salvage vehicle and we would have no information that it had been a total loss or the auction would have to notify us, which it was not.
And we don't have or have had an employee by the name of Angela here.
Initial Consumer Rebuttal /* (3000, 7, 2016/02/11) */
(The consumer indicated he/she DID NOT accept the response from the business.)
My apologize I meant Felicia. At the time before I purchased the vehicle I asked Felicia was the vehicle been in any accidents and said said no. Not only was I there she made this statement to my niece and nephew. No wants someone else's damaged vehicle.I would've never purchased in the first place. My insurance was able to pull up two accidents but did disclose that it looks like it was involved in 6 accidents. Two of which was paid out in an insurance claim. Based on want Felicia told me and two others that the vehicle had not been in any previous accidents I purchased the car. She was untruthful with me in order to get a sale and she worked for Approved Auto's at the time so she repsented the company therefore they need to be held accountable for being decitful to me as a consumer. I should not be responsible for a balance on this vehicle because of lies.
Final Business Response /* (4000, 9, 2016/02/12) */
Again, we can only disclose the information that is available to us through the damage disclosure statement which is a federal form required when we sell vehicles. The customer was given this form and signed off on it so did our sales rep at the time, since we don't use any sort of vehicle history software we don't know how many accidents the vehicles that we purchase have been in. We rely on the information given and disclosed by the auction which if it would have been a salvage or rebuilt vehicle they by law would have to disclose to us any further information is not disclosed to us at time of purchase from the auction.

Mr. [redacted] was informed that with our buy here pay here he would establish credit with us. the employee came to make a payment. Yesterday when Mr. [redacted] came to get his payment caught up I advised him that his retail installment contract clearly states we have the right to repossess his vehicle should he be late. We are not in the repossession business but we do ask our customers to make their payments on time so they can keep their good standing credit with us.
We apologize if he understood we would report to any bureaus but this vehicle is in his company name and the 3 bureaus only report personal credit not business credit.

(The consumer indicated he/she DID NOT accept the response from the business.)
I [redacted] was only advised that they would report to the credit bureaus. This was a lie. They have not reported to any credit agency. They also lied and claimed since filing my complaint that my contract was with [redacted]. This was once again a lie after calling [redacted].
They are again as seen above expressing personal and confidential information. Their two employees who witnessed the information being told are the two that told my employee about the late payments, dates these payments were due and that the vehicle was up for repossession. After reviewing my contract it shows that they must notify of the repossession. So once again they are lying.
And again The question that was asked when purchasing the vehicle, would it report to my business credit. SO I covered all my basis and through the while buying process I was lied to by Approved Autos.
I will be contacting my attorneys to further handle this situation.
I do not accept the business response as it is once again nothing more than a lie.

We did not lie to the customer. The contracts we make are forwarded to [redacted] and they review them for approving the loans. Because this customer was not happy [redacted] chose not purchase this contract, standard practice in the buy here pay here business.
As far as reporting to the credit bureau, again a business cannot be reported to the bureau only personal credit so we wouldn't have told him that.
We treat privacy very serious and will never give personal information to anyone else, in this case no personal information was given out such as Social security numbers, date of birth etc.
The customer has a right to seek legal counsel but we feel we have not done any harm with any of our business practices.
We have been in business for 4 and a half years and have sold over 1500 cars to people in the triad who need special financing and we get a lot of repeat customers because we treat everyone fair regardless of their credit situation, that is what keeps us in business.
Should you feel the need to contact me for any further questions please do not hesitate to do so.
Thanks.

Re: File No. XXXXXXXX [redacted]
To whom...

it may concern:
In reply to the complaint filed by Ms. [redacted], we at Approved Autos have not done anything wrong to cause Ms. [redacted] any loss of money and her claim that we owe her any money is not legitimate.
All the information regarding the purchase amounts, dates, and down payments are correct however her deal was not finalized because she was missing stipulations that the finance company that had approved her was missing. For example her pay stub did not show her year to date income and that is a requirement from the finance company in order for her to finalize the deal, thus we could not pay off her vehicle because we had not completed the deal. Ms. [redacted] is the owner of [redacted] insurance company and she placed her own insurance on the vehicle she purchased from us. Being that the vehicle she traded in had a balance of over $16,131 and was only worth $9500 we stretched the deal to make it work for her and be able to take negative equity rolled over to the vehicle we were selling her and the finance company did not approve for any other products such as GAP insurance. The day she was involved in an accident it was late at night and our sales rep. Anthony Z[redacted] was already home when Ms. [redacted] texted him to ask him if she had GAP insurance, to which he replied, "I'm not sure I think you did but I can check in the morning."
I am attaching a copy of the retail installment finance agreement (LAW-553)where it shows she did not purchase GAP insurance and she was aware it did not have any.
After we sent payment to the credit union that was lienholder on the vehicle she traded the credit union notified us they had mailed the title to her and so I kindly called her to inquire about it and she stated whe would like to speak with me directly face to face.
I met with her and she explained the problem was that her insurance covered the total loss of her vehicle except for $3000 of it and she had a balance that she had to pay because her insurance wouldn't cover it. I explained to her that once a deal was finalized that I could not just write a check for that amount but in order to help her I could sell her another car and roll over that $3000 in negative equity on to it, to which she replied she was going to [redacted] and they would help her.
We feel that Ms. [redacted] working in the insurance business would know if her vehicle had negative equity she would purchase additional insurance to cover for that, I know in the passed I have done that. At this point there is not much we can do since this issue is clearly with the insurance company not paying enough to cover the balance on her vehicle loan and nothing that we did intentionally.
Should you have any other questions please feel free to contact me or our attorney on retainer [redacted]
Sincerely,
Jose M[redacted]
