Review: This company sells beds, when they are selling you abed they never say your money that you give is not refundable. While one guys talks you into purchasing a bed the other guy is asking for payment. First they run your credit card for down payment then they fill out the contract. We have tried for 10 days to gt a phone call returned, with not luck! Only after I threatened the company did I recieve a call back. After text back and forth [redacted] said, "He would refund my account $1,000! I have this statement on my phone from texts. Now 30 days later, still no credit on my bank debit card. Keep calling and texting only getting the run around. There are muliple names and addresses for this company with [redacted].Desired Settlement: Want my money returned to my PNC credit card of $1,000.00

Review: Comforpedic Mattress purchased in 2008 with the promise of a 20 year warranty. Mattress is sagging and should be replaced...getting the run around!!!

The mattress is a Simmons ComforPedic King size bed, Model number T5856. We bought this mattress at the Sonoma County Fair on July 22nd, 2008 from [redacted] and we were told that it had a 20 year warranty.

The mattress was great for the first few years, but it has begun to sag in the spots where my wife and I sleep. It functions much like a hammock now, and if I sleep on my chest (like I usually do), I wake up with a horrible back ache since my midsection sinks lower than my head and feet. I called the factory for warranty service and they referred me to the dealer.

I called and was put in touch with [redacted], who told me to take pictures of the mattress showing how much it was sagging. He told me to use a ruler attached to a straight board across the mattress. On 8.20.13, I sent him the pictures via email along with scanned copies of the "law tag" and my original receipt.

At first, he said it looked good and he would send it off to the factory for my replacement, which would cost me $400 for delivery. He also said I should get my mattress in about two weeks.

On 09.03.13, two weeks later, he emails me again saying that he needed better pictures. I sent him some more, and he said they were good, and he would send it off to the factory.

On 09.17.13, after another two weeks with a defective mattress, I called to ask him the status and left him a voice mail message. He replied with an email saying that I now need to mail to him directly the original "law tag", and he'll send it to the factory for my replacement.

Clearly, this organization cannot be trusted to do what they say they will do, and what happens once I mail in my original "law tag" from my mattress, when they already have a scanned copy emailed to them? Once I send that in, If they say they lost it, it's gone and I can't get anything? Maybe thats by design...Desired Settlement: I would like my mattress replaced immediately. I was told that the replacement would cost $250 to ship to them from the factory, and $150 for them to deliver it to me. That seems reasonable, and I'll be happy to pay that to get my mattress replaced. What I DON'T want is another month of getting the run-around, and I don't want to send in original, irreplaceable documents to an untrustworthy person.

I contacted [redacted] and he agreed to follow through with the warranty claim. He promised to complete the claim once he received the "law tag". He apologized for the delay and the poor communication and he asked that I retract the complaint.

Review: The company failed to honor their 365 day warranty and replace the defective king split adjustable bed that had snake like movements.

Purchase date was July 17, 2013, purchase amount $6,150.60. Deposit of $650.00 American Expressed and $5,500.60 financed through GE Capital. The company was called numerous times between late August and September reaching a busy signal or answering machine. Several attempts made on September 17, 13 including a fax. Received a call back from [redacted] stating the merchandise had to be kept for 60 days and I would be responsible for delivery and other fees. He was very rude and I reminded him he stated the warranty was for 365 days and could be returned for any reason and no discussion of fees. He stated nothing could be done. He was advised I have been sleeping in a chair. Contacted GE Capital and was advised to return the bed prior to the 26th of September. The merchandise was returned on 9/18/13 and accepted by Ms. [redacted]. However, prior to her signing the paper [redacted] called and told her not to accept the return. The merchandise was left inside their place of business where Ms. [redacted] directed us to put it. Despite them notifying me they have the merchandise safely put away they refuse to credit my account. Mr. [redacted], continues to advise the merchandise was left on the porch and not accepted as a return. I have pictures to prove the contrary. They grossly misrepresented the product warranty and that they had a store in Lodi. The store too my surprise was a house that was filled with mildewed boxes of beds and very smelly. There were unwrapped beds and junk in there. I dealt with the following salesmen, [redacted] XXX XXX-XXXX, [redacted], the reported owner and [redacted]. I have requested my accounts be credited the amounts charged and they have refused.Desired Settlement: I am seeking to have American Therapy refund $650.00 back to my American Express credit card and $5,500.60 to GE Capital credit Services. They have grossly misrepresented their product and product warranty. They are unprofessional and dishonest in their dealings with their customers. Their business practices are deceitful and cunning.

Mrs.[redacted] is very delusional about this situation. After having her mattresses for two months, she contacts us to report that she can not sleep in the bed. She stated that the bed is moving underneath her and she can't sleep on the bed. Being that the bed is a cal king adjustable bed, it is comprised of two mattresses. I asked her if she has tried sleeping on the other mattress, and she replied that that mattress also moves underneath her. These mattress are top of the line Simmons Beauty Rest Mattresses. So if the mattresses are in fact moving, something in her house must have gotten in the mattresses and cause it to move. At any rate we told her that, (at our discretion), we could offered her the 365 day comfort guarantee, and this guarantee is not offered to everyone. Being that she has had the mattress for over 60 days, she is eligible to take advantage of the this guarantee if she so pleases to. The only stipulation is that she has to pay for the shipping and delivery of the new mattresses.

I told Mrs [redacted] all this and she did not agree that she had to pay for the shipping and delivery of the mattresses. She insisted that we replace the mattresses without any cost to her. I sent her a copy of the 365 comfort guarantee that we offered to her outlining the the guidelines that had to be followed if she wanted to proceed with the exchange of her mattresses.

About a week after this conversation, she shows up at our store in Lodi and had her neighbors take the beds out of her vehicle and put them in the store. [redacted] (the owner of the company), was very explicit in telling her that she could not leave the beds there. Mrs. [redacted] insisted that I told her that she could bring them back to us. Under no circumstances did I or would I tell her that she could return the beds, and she is well aware of that fact. [redacted] called me and ask me if that was the truth, (about her being able to return the bed), and I told her absolutely not! So she told Mrs. [redacted] that she could not leave the bed there and had to take them back. She continued to have her neighbors take the beds out and hurriedly left the store without turning back after [redacted] repeatedly kept telling her to takes the bed out of the store.

Mrs. [redacted] is delusional because she thinks that by not coming back and getting her bed she will not have to pay for the bed. That is not the case. Mrs. [redacted] has requested GE Capital to rescind the contract and not charge her for the bed, but they have refused because she has absolutely no justification for taking the bed to the store and leaving them. Mrs. [redacted] must come to the store and pick up her bed that she abruptly and fallaciously left at the store, and pay for her bed like she is suppose to. If Mrs. [redacted] wants to move forward on the guarantee that has been offered to her, we will be more than happy to handle that for her. But most importantly she must come get her bed and take them back to her house.

I am rejecting this response because:

The response you received from American Therapy Equipment of Northern California in regards to my complaint was not only unsatisfactory and offensive, but grossly mistakes the facts in my dispute. It was nice to hear the merchant at least finally admit the items were placed in the home front store and not abandoned on the porch as previously stated in writing. I contacted Simmons directly at ###-###-#### to inquire about the 365 warranty on the Comforpedic Beauty Rest Adjustable bed and was informed Simmons only makes mattresses and not adjustable bases. It was further explained not all mattresses are compatible with adjustable bases. The agent asked what the issue was with the bed and I explained it was making snake like motions and the agent stated that would definitely be an issue with the adjustable base and not the mattress.

It was also explained not all merchants participate in the Simmons 365 day warranty and they were not able to tell me if American Therapy Equipment of Northern California participates or not.

I made numerous calls to American Therapy Equipment of Northern California prior to reaching them on September 17, 2013 and expected to have my bed exchanged under the 365 day warranty without any issues. This was based on the 365 day warranty the Simmons adjustable bed had. Mr. [redacted] tells me I had to wait 60 days before an exchange could be made and faults me for finally being able to reach them on September 17, 2013. 60 days I was never informed of, however, 60 days would have been up on September 26, 2013. According to numerous reports from previous customers reaching this company is challenging at best and when you reach them they do not take good care of their customers. This is unacceptable.

I was last contacted by [redacted] at my place of employment on January 9, 2014 and I advised him I was at work and not the appropriate time to discuss the matter. He provided me with his cell number and I agreed to call him in the evening. I contacted Mr. [redacted] at 6:00 p.m. and received his answering machine. He returned my call around 7:00 p.m. and stated he wished to resolve the issue as I have filed two disputes with GE financing company. He further stated he is willing to get me a new mattress at his expense and that he is doing this for me. Mr. [redacted] stated he did not want to see my good credit get messed up. I stated to Mr. [redacted], “I do not believe just replacing the mattresses alone would resolve the issue as the electrical bases are more likely the issue.” Mr. [redacted] became nasty and stated, “You are [redacted] up your credit.” I advised him that I have lost all confidence in him and his company and that it appears he resorts to deceptive and bullying tactics and I only want my money back at this point. He became verbally aggressive and I told him we are at an impasse and hung up.

I am forwarding you copies of some of the pictures taken at the time the Comforpedic bed was returned to the merchants “showroom” and the deplorable conditions that existed at that time. Unfortunately pictures do not capture the moldy smell of the house. I am at an impasse with this merchant. I simply want my money back. I did not get what was represented to me a Simmons Comforpedic Beauty Rest adjustable bed. It simply does not exist. The merchandise and the 365 day warranty were all grossly misrepresented.

The owner of the company [redacted] accepted the return and directed my helpers where to place the merchandise. However, before she had the chance to sign the paperwork [redacted] called and could be heard cursing and told her not to accept anything. They still have possession of the merchandise that is not what they represented it to be.

Review: On 5-25-14 we purchased 1 King Comforpedic by [redacted] Adjustable Bed with Massage, 2 Memory Dough Pillows (Malouf), 2 Temperature Control Units, 1 Set of King 1-piece sheets, 1 King 10-piece Comforter Set (Brisbane). After numerous calls when items didn't arrive in time frame they said, numerous TCs were made to [redacted]. After many excuses [redacted] stated he was having trouble getting the King mattress, and stated he could bring us 2 XL Twins to "try out" and we would be able to return within 365 days if we weren't satisfied. After much persuasion we finally agreed. On 6-24-14 he delivered the XL twins. Upon delivery he didn't have other items, remote didn't work and had to order another one from factory. When it arrived we had to calibrate it with housing box and found out the wires were severed (most likely the reason it didn't work). To date this has never been corrected. On 7-16-14 we called [redacted] to let him know we were dissatisfied with the 2 XL twins and wanted the king we ordered. He said no problem he would order it and should take about 10 working days. Numerous TCs were made to [redacted] with no answers or no return calls. On 9-24-14 we did speak to [redacted]. Since it had been 4 months, our frustration level was at it's peak. He stated he had a bed and had hired 2 delivery men to bring it to our home. He did NOT have the other items and didn't know when he could have them. Delivery men came a few hours later. It wasn't even the correct mattress or size, and mattress was used and dirty. We refused delivery. A few weeks later [redacted] called and said he was no longer able to get the [redacted] Comforpedic mattresses but was now working with another mattress company and could provide us with a mattress from them. Still nothing was said about all the rest of the accessories we purchased. We never phoned him back but contacted our attorney. Letter mailed to [redacted] dba American Therapy Equipment of Northern California with above information requesting a refund.Desired Settlement: Refund. The above information is condensed, but I have full detailed information of every call made by us, every call received from [redacted], pictures, information from Simmons / Beautyrest Company RE his "closed out" account with them, etc. We don't trust him, and don't believe he has any intention of rectifying this issue. We simply want his bed gone and a refund.
