Thanks Please note that American Capital Group did not respond to this complaint as 100% of the money was refunded to the customer prior to the complaint being filed We granted the customer's request for a refund as an exception to our written contract as we believed he had been mislead by the equipment seller and/or this was a fraudulent transaction We were just unable to determine the responsible party A full refund was issued in this matter We are requesting that this complaint be removed in its entiretyAlternatively here is our formal response: ACG issued a full refund to [redacted] as owner of Camco, LLC He attempted to purchase a used tractor from a private party seller that turned out to be on consignment He was also attempting a sale leaseback on that same transaction Camco, LLC (owned by [redacted] ) claimed that he paid for the equipment already but was never able to submit proof he paid for the tractor When he did submit documentation it showed a wire transfer request paid by Fort Collins Mortgage ( which means title transferred to them)Subsequently when trying to determine the Bill of Sale information and vehicle ownership documentation was produced showing an entity Shop For Best, LLC as the tractor owner; but that business entity could not be connected to the actual alleged holder of the tractor Dimaro Auto Consignment & Sales There was no documentation or proof connecting any of the business entities to the equipment Dimaro Auto Consignment was believed to be selling the tractor on behalf of an individual listed on a different Bill of Sale as Daniel Peterson We also could not get any information on where the equipment was currently located [redacted] has previously filed for bankruptcy and this transaction was already high risk The various Bill of Sale documents showing different owners, the consignment issues, chain of ownership, and sale leaseback - proof of payment issues were all unable to be explained or properly documented by the customer The transaction appeared potentially fraudulent However, ACG was unable to determine the culpable party In an effort to maintain the customer relationship, ACG issued a full deposit refund (waiving all fees and expenses) This refund was issued timely in line with the legal documents signed by the customer
