In April 2019, I hired a contractor to renovate my home. I made a $10,000 deposit and per the contract, I agreed to make subsequent payments in phases providing work was completed as outlined in the contract. The contractor failed to complete the first phase according to our contract and as a result I refused to make subsequent payments.
The contractor is now requesting an additional $14,000 payment for work he did not complete and refuses to return the keys to the home. I've reached out to him via his office and personal telephone numbers and business email, but he will not respond.
Phase 1 was completed with additional plumbing and tub installation beyond the 1st payment. Also what homeowner failed to tell you is that he made framing changes which cost us 2 days labor to remove and reinstall the changed layout as per the homeowner. The homeowner was not charged for this additional work. All of the work described for the 1st phase was completed. When 2nd payment was requested verbally and by email the homeowner then wanted to change the contract requesting that he purchase all materials and asked us to provide him with a labor only contract. After several emails and phone converstations the homeowner failed to produce the 2nd payment to move forward with the contract. We then forwarded this information to our Attorney Diane C at ***. She then contacted the homeowner and advised him that he is in breach of contract and we would be forced to put a mechanics lien on his home and subsequent lawsuit.

The home was not framed according to the drawing provided to the contractor. Therefore, phase I was not complete. The contractor took it upon himself to make unauthorized framing changes that I did not agree on. When addressed about the unauthorized design, the contractor made several excuses and agree to fix it, but failed to do so. After several attempts via email, telephone conversations, text messages, and in person contact to resolve this issue the contractor refused to complete the framing as required. Further, the contractor provided a type of bathtub and shower floor that was not agreed upon. The contractor tried forcing me into a floor design that was easy for him, but not what I wanted. The contract and pictures of approved and unapproved designs are attached.
Specific verbiage from the contract reads: "..Reframe new walls for additional bathroom as per drawing...New sheetrock, spackle, and tape where needed. All reframing 2x4 construction. New bathroom will have access from Master Bedroom."

Stole my money and didnt complete the job contracted to do. Office wont take calls, when they do answer phone, I get a attitude and someone will call back ( they dont). Owner will not take my calls. Gave them 15,000 down payment for a siding/roof job which on contract would take 4 weeks to complete. 7 weeks later they have done 1/2 of a shed, ZERO work on house, they send 1 guy once/twice a week with 1 box of material. This company has lied from day 1. They are unprofessional. DO not give them your money. DO not let them anywhere near your project. I am disgusted. Their " salesman" who claims to be their project manager actually told me to lose his phone number after I gave him money and no one ever showed up to do the job and I called him to try to get help since the office doesnt answer
We received a $15,000.00 deposit from *** as a deposit towards the attached contract. This job was subject to AMC providing financing with credit approval. We forwarded ***'s information over to our company attorney ***, P.C. at *** for a title search on the residence and for a credit check on ***. During this time we removed and replaced the roofing, siding & wooden access door on the Pool house & pool shed & carted away all debris and dumped them at a registered dumping facility. We worked on ***'s residence on 6/*, 6/*, 6/*, 6/*, 6/*, 6/, 6/, 6/, 6/, 6/*** & 6/. During this time our company attorney informed us that *** has a federal lein for over $102,000.00 on her residence at ***, along with other judgements at the same property. At this point my attorney advised me not to provide financing because we would have no way to collect. Subsequently we advised *** that her credit is in poor standing and in order to move forward with her contract we would need to be paid in installments to complete her project. *** objected and claimed that she has a high credit score and that she had satisfied all of her judgmenets. We then forwarded this information from *** back to *** for further inquary. *** ran another title search and found again the same judgements on this property finding *** was inaccurate in her defense. In good faith we completed the pool house & pool shed in lieu of the deposit. *** continued to deny owing any money to the federal governemnt. At this point *** and *** had more then 1 phone conversation where *** explained her findings and that I would not be able to provide financing. As of today *** has choosen to post dirogatory and false statments about my company on google reviw under All Maintenance Company. Thank you for help in this matter.

Contractor deciding not to finance job is his decision he is refusing to give back 15,000 deposit I want my money back , he completed about 2500 on work and is refusing to give any money back , it did not take 8 weeks to decide he did not want to finance the job , I have a 10 yr old federal tax lien , once again his decision. Whether to finance or not but deciding not to did not entitle him to keep my money when it was not Earned , it also did not take 8 week decision nor should he have strung me along and did any work on the project if he did not intend to complete the job he is a scam artist , and a theif

In regards to the $15,000.00 deposit.
All Maintenance Company removed and replaced at the pool house roofing, roofing underlayment, siding, repaired facia boards, cleaned up and carted away material.
At the pool shed All Maintenance Company removed and replaced roofing & underlayment, siding, fabricated & installed a access door for the pool shed.
As previously stated we worked at the Carter residence for 11 days as stated in previous emails.
Our company attorney *** Law Office at *** spoke with *** on several occasions in regards to the federal tax lien on the property and other derogatory credit history.
Initally *** denied and said the credit history is not factual. *** performed a 2nd credit history and title report on ***'s social security number and property address.
Diane Carroll confirmed the Carter Residence does in fact have a federal tax lien for $101,942.81.
Based on the lien on the Carter Residence and the negitive credit history on ***'s social security number *** advised us not to finance the $51,500.00.
Further more there is also other judgements on the Carter Residence for non payment to other home improvement contractors.
Ms. Carter has also chosen to use the google review platform to post and make alligations that All Maintenance Company is scaming her.
The facts are that we performed work and provided services, delivered & installed construction materials & labor, carted away all garbage and debris from construction and other expenses accociated with this project.
We applied the $15,000.00 deposit in full towards the work that was done.
As of today *** continues to state that we accepted a $15,000.00 deposit and did not do any work at her residence. All Maintenace Company is very well prepared to litigate this issue in Suffolk County Supreme Court.
I paid 10,000.00 for my front yard to be landscaped in the late summer last year. This year my new sod is 90% dandelion and all the weed liner is showing and blowing back through the wood chips. Looks terrible. Called to ask questions about the sod and when the sod will be replaced. I was told how busy they are and a date could not be given. When a request was made that we be priority as we have already paid for this service I was told that he was not comfortable continuing the conversation and hung up. So now I may or may not ever see my new sod.
