In July of 2015, I paid $500 to ACRC to provide Fair Market Value letters (may also be known as assessment report)for a Personal Services contract for my mother due to her advanced dementia. I couldn't find a copy in my files so I requested to get a copy in July of 2019 and was told they would have to get copy out of storage. I have made several attempts with *** (Executive Director) since then and as of 10/8/19, I was told they destroy their records after 2 years. Also, I reached out to *** (President & CEO) today and have yet to hear back regarding whether or not they will provide documents requested several months ago OR their retention policy.
1)I would like the copy of The FMV Letter(s), assessment report, any other documents/ reports related to Personal Services Contract (PSC).
2) If they don't have hard copy of documents, I would like any emails with electronic copies forwarded to me. (I asked *** to check her emails to *** at Shalloway & shalloway on 10/8/19 and she told me she couldn't find (didn't have) any emails from 2015).
3) If they fail to provide electronic copy or hard copy, I would also like a copy of their retention policy with regards to documents, emails, etc. I was told they have a 2 year retention which doesn't seem reasonable.

Delivery Deliver the document(s) OR electronic copie(s) of documents for the Personal Svc Contract. If they refuse to produce documents requested, I would like a copy of their document and email retention policy.
The Alzheimer's Care Resource Center is a non-profit organization that was asked by the law firm of Shalloway & Shalloway to provide a Fair Market Value letter to Ms. Ms. paid our fee of $500.00 and the Fair Market Letter was prepared and forwarded to her attorney's office, as is our policy. This happened back in July of 2015. Evidently the law firm lost the letter and has directed Ms. back to the Alzheimer's Care Resource Center. As we are not required to have a retention policy, we normally keep records for people who use our services one-time-only, for a maximum of 2 years, particularly because in all cases regarding Fair Market Value Letters, all documentation is sent directly to the client's attorney, as was the case with Ms. letter. As far as electronic communications, due to HIPPA and privacy concerns, we normally delete all emails after a client is no longer active with our organization. This was also relayed to Ms.
Contrary to the complaint, on October 10, 2019 Ms. Gerard emailed me asking for our retention policy which I provided to her at that time. The emails have been copied below for your review.
