Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below. The response from AAK is not acceptable. This is not my *year-old's fault. "She didn't listen" is not acceptable. I'm eternally grateful for the speedy response when my daughter was drowning, but it never should have happened. I entrusted AAK with the complete care of my child.  Nothing was done to prevent this from happening. Telling a [redacted] that she can't go down the slide because she's wearing a life jacket leads to deductive reasoning for any adult, let alone a [redacted]. Our [redacted] is not a large child- quite small to be precise. You can't tell me they couldn't physically keep her from taking off a life jacket, walking to the slide, and going down. If they told her to keep it on, as they say they did, she should have been offered an immediate consequence for disobeying, not allowed to proceed the way she did. The response from AAK paints a picture of [redacted] being defiant, running to the slide with a "nobody can stop me" attitude, then plunging down the slide and drowning. That's just not the case. [redacted] is a very intelligent and very obedient child. She certainly understands the danger of deep water.  Perhaps the fault is hers and mine for trusting the level of care at AAK. We'll never ever return and we are doing our best to shatter our story.
Regards,
[redacted]

Mrs. [redacted],We are very sorry for what [redacted] and your family has gone through.  We have been in business teaching kids swim lessons and hosting Slumber Parties for almost 15 years now with no incidents.   Safety is our #1 concern for all of the kids who visit our facility and we do not...

take it lightly.  When [redacted] went into the pool with her group, she was swim tested and did not pass.  Our staff put a life jacket on her and she was instructed to stay in the shallow end of the pool.  [redacted] wanted to go down the slide but our lifeguard told her that she could not go down the slide because she had to wear a life jacket.  The rule is:  If you cannot swim and pass our swim test, the child cannot go down the slide.  [redacted] took off her life jacket and went down the slide anyway.  Our lifeguard acted quickly and jumped in to save her.  We do not know why she took off her life jacket.   We do think that because of her age (* years old) she did not comprehend the danger.   We know that our staff was amazing that night and reacted perfectly.  We had plenty of staff on site and a certified lifeguard on duty at all times.  Staff do not get into the pool to catch kids coming down the slide.  All kids sliding have proven that they can swim on their own by passing our swim test.  Our staff reacted quickly and saved [redacted]’s life.  Our lifeguard on duty even received an award from the City of Jeffersontown for her fast reaction. You mentioned that All About Kids failed to call and check to see if [redacted] was ok.  This is not true in that I talked to your husband twice on Friday night of the incident.  We also communicated via text message on Saturday. I reached out again on Monday to see when we could meet and we met on Tuesday.  In addition, our slumber party manager talked to your husband several times.  I hope in no way you thought we showed a lack of empathy.  We have looked at this situation at great length and we have even made some adjustments to our Slumber Parties for the future.  We are no longer going to allow kids ages 4-5 to swim during the Slumber Parties (exceptions will be made if the child is enrolled in our swim lessons).  We would suggest for all parents to have their child eat before they attend our Slumber Parties.  Especially if they are not getting a snack or anything to eat since 11:30 am.   Because it is an overnight activity, we usually have pizza time between 8:30 pm and 9:30 pm so the kids are not starving later that night.  We have already agreed to pay for [redacted]’s hospital visit and we have also refunded your $28 for the Slumber Party back on your credit card.  In addition, we offered free swim lessons for [redacted] so she could learn to swim in the future.  Once again, we are very sorry for what [redacted] went through and we will do everything that we can to prevent this from happening again.
