Initial Business Response /* (1000, 6, 2014/06/03) */
To whom it may concernMy name is *** *** and I am the General Manager of Alberta Truck and AutoOn May 17th Mr*** *** and his wife came to purchase a *** *** When they arrived the vehicle had just been
sold to a young ladyI had told them that I could get them another one just like itThe condition was that I would require $down and upfront because I would be calling a rental company to pull one of their fleetWhen we do this as a rule they charge us moreI explained to them in detail that the $would be non refundable because we would not be able to cancel the order once we made itI had told them I would likely have it by the following Friday
My contact with the rental company confirmed by email he would get me one from Calgary and I would likely have it on Friday as wellI followed up during the week and was again confirmed by email of a Friday delivery dateFriday came and went and I was emailed that they sent me up an *** by mistakeSaturday the *** came to inform me they needed the vehicle now or they wanted their money backI kindly reminded them that we paid extra as a special order to get them their vehicle and I reminded them that I made it perfectly clear I would keep their deposit if they cancelled for any reason
At no time when they initially were in the process of giving me the deposit did they indicate that they needed it for a specific dayIf that was the case I would not have ordered it because things happenWhen they came to my lot on Saturday wanting their deposit back I also showed them the correspondence between me and the rental company of what had transpiredAt that point they told me they needed a vehicle that weekend and went and bought one somewhere elseThe vehicle arrived on Monday morning and is still here waiting for them to complete the transactionWe have a signed bill of sale by the customer clearly showing the deposit is non-refundable at customer request for ordering the ***
As far as hanging up on the customerI politely told him that after hearing him tell me that same story times a fourth time was not going to change any of the factsRegardless, we are willing to look for some middle ground and re-imburse the customer $in an attempt to mitigate both parties losses for the cancelled dealIf you require additional information regarding this matter feel free to contact me at XXX XXX XXXX or via emailHave a wonderful day

Initial Consumer Rebuttal /* (3000, 8, 2014/06/12) */
(The consumer indicated he/she DID NOT accept the response from the business.)
Why would I have to pay the $1000? His contact in Calgary should pay him because they are the one made a mistake and cause this problemIf I got the vehicle on time, this will never been an issue and both party would be happyI work hard for my money and $is my weeks' pay checkMy wife is on maternity leave and I am the only one works in my family$is really big deal for me and my family
To whom it may concern. *** *** looked at a vehicle we just received on July and informed us that he would be purchasing the vehicle once the inspection was completedHe SIGNED a purchase agreement that had pricing clearly indicated on the documents and told us he would be picking
up the vehicle on Saturday. As a result we told other customers who were also interested in the vehicle it was sold and had placed a sold sign in the vehicle and removed it from our online inventory. He later called on the Saturday when he was supposed to pickup the vehicle and wanted to renegotiate. He was told on the phone that we lived up to our end of the deal and we expected him to honor his. He arrived on Sunday afternoon and when he was told that we would be holding his deposit for this vehicle or for the purchase of another vehicle he began to swear and behave inappropriately and was promptly asked to leave. Should he wish to purchase the vehicle he first agreed to buy or another one, his deposit will be applied to that vehicle in full.

I am rejecting this response because: I did not agree to the price or the payments were over my budget. [redacted] I am not obligated to sign an agreement that I cannot afford. There was no discussion that the deposit would not be refunded in the event the deal did not go throught. Very poor business ethics in my opinion. Why pissed of a.customer and keep their desposit instead have returning the deposit and having a happy customer that will come back and deal with them whenough they can afford a payment. I am.very disappointed in the dealings. $250 may not be alot of money to you but it is to me. I apologize for swearing but understand my.frustration with the situation. I never said I would be coming on saturday [redacted]. Sundays are my only day off as I mentioned to jeremy numerous times.....I was told no one can sign a deal.on a Sunday. No extra effort to accoma date my.work schedule was put in. Very very poor customer service. I will be spreading the word about my dealings.
Sincerely,
[redacted]
