I am being charged for a community pool that I am not able to use. This has been going on for 3 years and I have asked about this over and over again. I keep getting misleading information and dragging of the feet to provide this service that I paid for.
Hello,I wanted to inform you that the fee that is due to the association does not go directly to just the pool. The fee takes care of, the insurance of the association, common areas, Landscaping, irrigation, and maintenance. The developer of this community is on a delay and they actually have an inspection today at 12:30pm. Once the Certificate of Occupancy is released and granted by the city of New Braunfels, the pool will open. The pool cannot be opened without the prior approval of the City of New Braunfels.Please keep in mind, the governing documents that are given to each resident when closing on their home, does not state when or how soon the pool will open. I am rejecting this response because:
I understand that the fees is not just for the pool. But there is a portion of it that does to go it. I also understand that the documents that I received don't say when the pool will be opened. BUT it was put out in writing that the pool would be started at 50% of lots sold. The permit was submitted in May 2018 and it would be REASONABLY expected to be completed a REASONABLE time. 2 years 3 months and counting is not a REASONABLE timeframe.
To ask to discuss this with the actual board members is an impossible task as well. Can't speak to them, can't write to them and don't hold any meetings. But they tell you what to do, fine you, penalize you and mislead you to get you to buy property here. ENOUGH IS ENOUGH. I will next talk to the attorney for the next step. I refuse to continue to keep paying when the HOA is in violation of the governing documents its self but I will wait for my legal advisor first.
