I reviewed the response made by the business in reference to complaint ID ***, and find that there is really no resolution to the issue. Yes, we are in contract and it happened to work out for us. I still feel that if she is going to continue selling homes, that she be held to a higher standard in handling the offers submitted by buyers.

It is unfortunate that in a Seller's market most homes can result in a multiple offer situation. This occurred in this case. Monica B*** had received multiple offers on this home, in which she presented to the Seller. An offer was submitted on the same day by a buyer who saw the
home hours after the ***. Their offer was extremely close in price and terms and was higher than the *** offer. The seller requested that Monica ask for a "highest & best" with a deadline of Thursday at 9:am. Monica sent an email announcement through Centralized Showing Service. The seller contacted Monica to extend the deadline until Friday to encourage more offers. The other agent resubmitted another offer and called Monica to confirm that his buyers offer was receivedIn this market, most agents will call or text and get written confirmation from the listing agent that the offer was received. Monica checked her email and Dotloop and did not see an additional offer from the *** agent. Since she thought she had all of the offers, the seller countered and accepted another offer. Afterwards, Monica received an email from the *** agent. Monica discovered that she did not see their offer in Dotloop, which was sent late at night, the email that was sent, nor did she receive a confirmation call or text from the buyers agent confirming that the *** offer was received. The next day Monica presented the offers and the seller accepted an offerAt that point, that contract was legal and binding. I understand that the *** were upset about the situation; however, their offer was not copied and submitted to one of Monica's buyers. Our company did not represent any buyer in this transaction. We did not discriminate against the *** and have no basis for doing so. Monica consistently conducts herself in a professional manner. With electronic media, emails do not always come through when they are sent and can be missed. It was not intentional. When representing a seller, our responsibility is to secure the highest and best offer for the seller regardless of who the buyer is. Sellers will choose an offer on the best terms with the price being just one of the factors, not on who sees the home first.The first buyer ultimately backed out of the contract. I requested that Monica immediately call the *** agent to give them the first opportunity to purchase the home. The *** are now in contract on this home
