After entering into a contract with Affordable Storage and verifying my parking with their staff, they proceeded to have my vehicle towed. I entered into a contract with Affordable Storage for a storage of a classic vehicle. I had the car towed over to affordable storage. After completing the information with ([redacted], the employee) we confirmed the parking before we left the premises. I checked on this car on a monthly basis. Then on September 1st Affordable Storage contacted me to tell me that all cars needed to have a parking tag displayed or the would be towed, after that I spoke with [redacted] and she stated that my vehicle was fine and it was not at risk of being towed. Then when I sent a friend to make a payment on 10/25/2013, after I made the payment that is When [redacted] informed my friend that the car had been towed a few weeks ago she gave my friend the contact info for the towing company. After contacting the towing company and getting all the info, I learned that the vehicle was towed on 9/16/2013, which is about 15 days from the last contact I made with Affordable Storage in reference to my vehicle. After explaining to [redacted] the events that had taken place she stated that she would have to speak with [redacted] and get back with me. I had not heard from [redacted] so when I called she stated that [redacted] only recalled a few events. We also spoke about when I went to make my initial payment [redacted] asked if she could make the payment from her credit card because she was unable to stop at the atm that morning. [redacted] told me that [redacted] would not have done that, as of today she was able to confirm that [redacted] did make a payment from her credit/debit card and kept the cash on hand for whatever reason. When I explained to [redacted] that I needed further resolution she told me that she was the one who makes the final decision and she stated that the problem was between me and [redacted] towing and would not discuss the issue any further. I feel that they should have the vehicle release because their employee ([redacted]) verified the information for me as to where the vehicle was parked and about the parking tag. The space [redacted] states they designated for my vehicle is in eye view of their office and never has anyone mentioned my vehicle being in the wrong space even after I referred a friend and contacted them on several occasions.Also, [redacted] has offered me a closer parking space, which doesn't not support the information I received from [redacted]. They accepted my payments since July and according to them the car was parked in the wrong space. I feel this matter was no handled properly and the office manager [redacted] is failing to accept the responsibility for the decision made by her employee which led to where we are now!Desired SettlementI think that Affordable Storage should be responsible for the charges that have accrued with [redacted] towing and reimburse me for the payments I made and the vehicle was not there.Initial *usiness Response Our property is signed parking by permit only and that unauthorized cars will be towed at the owner's expense. There is a sign on the gate as you enter the property as well as posted on our door coming into the office. There is also a sign located on our lower parking lot stating this policy as well. All customers are made aware that their permit must be displayed. If there is not a rear-view mirror that the permit can hang a parking permit sticker is offered. On June 8, 2013 the Ms. * came in to inquire about renting a parking space. A contract was completed for parking space [redacted]. A parking permit identifying the parking space was also issued at this time. At the time she rented the space, the automobile was not present. My employee showed her where the parking space was and explained that the space was not marked so she wanted to make sure she understood that the space was along the curb past the parking right inside the gate. This is the only parking that can be seen from our office or those parking spaces. When the tow truck driver they employed to bring in the car he/she took it all the way to the lower level which is not visible from our office and parked it in [redacted]. This space has been rented to the same person since 2009. In early September he brought it to our attention that the car parked in [redacted] was not his car and could we have the owner to move the car. We spent 2 weeks trying to locate the owner of the vehicle. We checked the car to see if the tag was present and it was not. There basically was not any interior to the car so there was not a rear-view mirror to display the tag. We looked to see if a parking permit sticker was present and it was not. We then pulled the VIN on the car and had DMV to run it and see who it was registered to. The car also did not have a license plate on it so we couldn't even have the tags run. The car came back as not registered; therefore we had no way of knowing who the rightful owner was. Since the car was parked in another tenant's space and we did not know who the owner was, the car was towed as per our posted policy. It is Ms. *'s responsibility as she was not authorized to park in [redacted] to pay any balance due to [redacted] Towing. In regards to any money paid for time her car was not parked on our property as it was impounded, I told her on 10/26/13 that as a courtesy to her I would have our corporate office write her a check for September 16 through October 31st rent which had been paid. When I spoke to her on 10/30/13 I told her that she had been credited the rent for September 16 through October 31st. I was told by the additional accessor/contact on the account that Ms. * put the tag with her contract and wasn't sure what she had done with it. When I explained that DMV did not show who the car was registered to she told me it was because they (I am assuming herself and Ms. *) were still holding the title. The complaint states that she confirmed the parking space with our employee before they left the premises; she also stated this to me but said that our employee showed her from our office. She was never at any time taken down to the lower parking area that cannot be seen from our office. Obviously there was some miscommunication between Ms. * and the person who towed the car to our property. Said employee does not recall ever speaking to anyone towing the vehicle, only Ms. * when she came in to rent the parking space. If the tow truck driver would have inquired at our office when he/she brought the car on the premises they would have been shown where to park the car. As previously mentioned the renter of [redacted] has rented the space since 2009, it was not listed as a vacant space nor would we have directed someone to park in that space. That space where Ms. *'s car was parked is clearly marked [redacted] and her contract is clearly marked [redacted].
