Customer states that rep modified cancellation date by writing a different one on the contract. This is not true. Copies of the contact and cancellation notice given to Ms*** and signed by her are attached. Cancellation date is 3/5/18, signed by Ms***, which she verified with finance company. There is nothing written on contract to change those facts. There were no accessories purchased on the contract. Again, see copies attached

Complaint: ***
I am rejecting this response because:the sales Lady didn't leave any attachments or anything, she was fully aware I was only doing this to help her win a contestShe also knew my granddaughter was distracting me,and yes she told me too call on Tuesday morningI had no ideal of the Sat work day, and she even wrote this on top of the contract, she also swore on her children s lives and GodThat I wouldn't have to keep it,I guess that's why she didn't leave nothing but the vacuum that I don't need or want.I also tried to reach out to her by her phone number and she told me she was in the hospital and didn't have time for meShe knew I can't afford this raising my granddaughter on my ownThis is not right and they need to refund my money and pick up the vacuum
Sincerely,
*** ***

Company was notified that a postdated check was mistakenly deposited on Saturday, 2/18/17. Banks did not reopen until after the holiday on 2/21/17. At that time customer provided documentation and company confirmed with bank that a mistake was made, and a $check was sent to
customer. Customer indicated that she was pleased with that solution and would withdraw this complaint, as it was mistakenly filed before company had any opportunity to correct mistake

*** *** called me after the cancellation period had expired for his mother, *** ***'s, purchase of a Kirby vacuum cleaner. Mr*** said his mother had been diagnosed with dementia and that he had power of attorney for her. I told Mr*** that the representatives had
specifically questioned his mother about dementia, and she said she was fine and knew exactly what she was doing. She never mentioned her son or his power of attorney at that time.I told Mr*** to mail in the notice of cancellation that was given to his mother, signed and dated. I told him that even though it was late that Aerotech would process the cancellation as a courtesy. The process for timely cancellations is that once the cancellation notice is received, arrangements are made to pick up the Kirby. After the Kirby is inspected and returned to stock, a refund is processed and mailed to the customer.Mr*** did not send the notice of cancellation. He instead sent a letter demanding that his mother's pending refund check be made out to him and mailed directly to him immediately, and also filed a Revdex.com complaint even though we had already resolved the matter on the phone.I called Mr*** again and asked him why he had filed the Revdex.com complaint and why he had not sent the cancellation notice signed and dated. He said that he couldn't find the cancellation notice and accused Aerotech's rep of not leaving one at his mother's house. I mailed Mr*** a copy of the cancellation notice signed by his mother indicating that she had received it and asked him to sign, date, and return it as he originally agreed to do.Aerotech expects to receive the signed dated cancellation notice from Mr***. Aerotech expects to pick up the Kirby at his mother's house, inspect it, return it to stock, and issues a refund to the customer. There is not basis for this complaint. Aerotech is going beyond its obligation by allowing a late cancellation of this purchase, as Mr*** requested. Aerotech requests that Mr*** withdraw the complaint.A copy of Mr***'s letter to Aerotech is attached

Customer purchased merchandise on Thursday March 1, 2018.  She signed a contract for the purchase on that day with a three business day right of cancellation which expired at midnight Monday, March 5, 2018.  This was in accord with what the representative told the customer, with what the...

customer was told by the finance company and verified with the finance company, and in accord with the FTC cooling-off rule that the right of cancellation extends to midnight on the third business day after the sale, and Saturday is considered a business day.  Kentucky, where the sale was made and the merchandise was delivered, follows this Federal law.  Customer chose not to exercise her cancellation rights.  Then customer called on March 6, 2018 and left a phone message saying that she no longer wished to pay for the merchandise and to pick it up.  Her call was returned and the customer was informed that her cancellation period had expired.  Then customer stated that the representative told her she could call and cancel on Tuesday March 6, 2018.  The contract says no such thing, the representative said no such thing, and the finance company said no such thing.  It is just not true, and there is no valid reason to cancel this binding contract  Customer signed and verified the correct cancellation with both the representative and the finance company.  Thus this complaint has no merit and should be closed.

This customer purchased a vacuum cleaner system on 4/27/16 with a three day cancellation option.  Aerotech has received no cancellation notice to date.  This morning 5/17/17 the customer and his wife contacted Aerotech for the first time and said they had mailed in a cancellation notice on...

4/28/16, but had no evidence of it.  The wife said "the post office said it was delivered."  So I asked the customer to go to the post office where she was told it was delivered, get proof of mailing/delivery, and Aerotech would honor it.  To date they have not provided anything, except to say they do not wish to pay for what they purchased.

Customer is due a refund, and refund has been issued to customer's American Express Card.  If refund does not appear for any reason, customer is requested to contact this company for proof of refund.

Initial Business Response /* (1000, 10, 2015/12/22) */
Our records show that after Mr. [redacted] cancelled his transaction, the vacuum cleaner was picked up at his home, checked, and processed back into inventory. A refund was then sent to Mr.[redacted], $90, our check number XXXXX, over a month ago. This...

complaint should have been closed last month.

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted], and find that alot of what was said in the response was not true. We did call & cancel within the 3 days time [redacted] even said that on the phone to my wife. I'm still trying to figure out if a company has a 3 day waiting period for ALL customers (decide if they will keep the vacuum) why on earth would you deposit checks until that time period is over. There was no demand from me in my fax with the check. Since I have POA it would be easier to send the refund to me verses confusing my mother further. NO one questioned my mother about her having dementia - unless she was acting very odd that day why would someone ask. Again if she was acting very odd why would a sales person take the chance to sell her the vacuum. I have sent back the receipt that [redacted] provided and he should have it back by now. Waiting for [redacted] to schedule for someone to come & pick up the Kirby vacuum cleaner. The only piece of paper my mother had was an invoice piece of paper with no figures on it so thats naturally what I thought [redacted] wanted back. I'll just be glad when the refund is in the hand of my mother or myself so this huge mess will be over with and at that time will I take this complaint off of the Revdex.com. Thank you
Sincerely,
[redacted]

Aerotech, Inc. [redacted] [redacted] Energy, IL 62933 [redacted] FAX [redacted] Revdex.com St. Louis, MO FAX 314-645-2666 Email April 5, 2016 RE:          Complaint# [redacted] Dear Revdex.com, Aerotech is responding to a complaint from Mr. [redacted].  On 1/30/16, Aerotech’s rep. did a free floor cleaning demonstration.  Mr. [redacted] complained about it.  On 1/31/16 Aerotech’s supervisor, [redacted], returned to Mr. [redacted]’s home, personally vacuumed the rug, buffed the floor again, and photographed the results.  Those photos are attached.  All of the photos confirm an aged floor with pre-existing deterioration.  Mr. [redacted] contradicts himself in his complaint.  He complains about wax buildup and a “small area of wax.”  Then he admits that no wax was applied by Aerotech’s reps.  And none was, because Aerotech’s reps do not stock or use wax as it is not part of the system they demonstrate and sell.  Any preexisting condition of Mr. [redacted]’s floors from old wax or wax buildup was not caused by Aerotech, nor did Aerotech ever offer to restore his floors to new condition.  Apparently Mr. [redacted] is hoping to parlay his free demonstrations, during which he purchased nothing, as a claim for restoration of his old floors and rugs.  This claim has no merit and should be closed. Very truly yours, [redacted]

I also wanted to reinterate my main concern before and during my conversation with [redacted] the 1st day he came to my house. My concern was why he thought he could wax over my hardwood floors that already had Two coats of polyrentane finish on top of my stained wood floors. He even complimented me on...

how well my floors looked and the shine on them. He told me after they waxed and did everything elso to them how much better my floor would look. I even had Two other adults in the room asking him the same questions about the waxing of my floors. He even stooped down and ran his finger nail over the wood and told me that he could feel the grain (of course you can feel the grain because all grain is raised a little bit from the wood planks themselves) and tried to explain to me that the was would enter the grain itself. Which amazed me even more knowing I had 4 coats of finish on them. A black man, I think his name was [redacted] or something like that told me they never wax a entire floor because it would take them all day to do that. When I told [redacted] of this, [redacted] told me that [redacted] LIED to me and that he was going to talk with [redacted] when he got back. [redacted] told me 5 different times that [redacted] was on his way over to my house during the time [redacted] was giving me his spill about all the Kirby attachments and what they would do. Of course Tone never showed up and never even called me during this time. The funny thing is [redacted] and I TALKED numerous times before he dropped [redacted] off. After that, [redacted] only would text me and NOT TALK to me. I asked him why he would just not CALL me and TALK to me like normal people do. He had NO good excuse at all which made any sense to me. I was actually CONNED by [redacted] and his company. That is exactly how I feel.

Complaint: [redacted]
I am rejecting this response because: she wrote this at the top of my copy because she didn't want her boss to know,do fine no atattachments ,but she knows I can't afford it and only agreed to keep it for a few days to help her win a [redacted], and trip. Why would she give me her personal phone number, and swear on her own children lives? That is not professional business by no means,I tried to contact her and she Ms [redacted] states she was in the hospital and didn't want to deal with the problem she created in the first place.I Irefuse to pay for something I was deceived by your sales Lady. I will never recommend Kirby to no one, this is not my fault and still refuse to pay. You shouldn't be training your sales reps to lie and deceive people. I'm a single lady 55 years old raising my5 ur old granddaughter, and work hard for every dime I make,I do a professional job and have never deceived my clients nor will I. To me this company doesn't care how they make money.
Sincerely,[redacted]
[redacted]

Initial Business Response /* (1000, 10, 2015/06/26) */
Our records show that Ms. [redacted] did cancel her transaction in a proper and timely manner, and the merchandise was returned to stock approximately ten days later. The installment loan application she signed in favor of United Consumer Financial...

Services was also cancelled as the customer requested. This company does not normally return cancelled applications, but is making an exception and will return the signed application to Ms. [redacted]. Ms. [redacted]'s used vacuum cleaner was disposed of. By policy the company must replace it with a comparable one. Ms. [redacted] has so far rejected two comparable vacuums. The company will use its best effort to locate a replacement that is acceptable to Ms. [redacted]. When I tried to call Ms. [redacted] with this information, she did not answer her phone.
