Complaint: [redacted] I am rejecting this response because:This is a classic 'pass the buck' response from a dealer that will not stand behind their serviceLet me clear up the assumptions MrC [redacted] suggested.The truck I purchased had 74,miles when I purchased itIt had 87,miles on it when the transmission started to failThis truck is used for a mile commute, five days a weekAll recommended maintenance was performed per Nissan and the warrantyPerhaps I should have had the radiator fluid randomly changed and inspected, but I (foolishly) assumed since I had owned it for less than year and put less than 13,miles on it, it wouldn't require this service yetYes, the warranty covered the timing chains (another item Nissan it being sued for), as it should have.Actually, MrC [redacted] knows this is all irrelevantIf I had the radiator inspected the day I drove off the dealership parking lot, and it showed signs of cross contamination, I would be in the same predicamentThe warranty I was sold does not cover this major repair and expense, and I was lead to believe it wouldThe point here is being missedThe dealership did not feel it pertinent to inform me that the transmission and radiator on this Nissan Frontier was likely to fail, per the class action lawsuit filed in 2012, https://topclassactions.com/lawsuit-settlements/lawsuit-news/3317-nissan-radiato...⇄ 'best extended service' contract they sold me would not cover this problem, whenever it eventually happensThis is bad business [redacted] *** Sincerely, [redacted] ***
To Whom it may concern: Miss *** purchased the best extended service contract that was available at the time of her purchase. At that time a year old vehicleFrom my understanding in communicating with the service contract company the law suite has nothing to do with her coverageThe
Radiator failed in turn caused the transmission to fail when the fluids cross contaminate. Since the Radiator is not a covered component of her service contract they will not cover the transmission as the radiator is the causeThey did cover just over $1,worth of work to have the timing chains and guides to be replacedNissan has admitted to the problem and extended the warranty on them. $3,co-pay on about a $6,jobAs I feel for Miss *** and her situation, Advantage Nissan will not be paying the $3,co-pay for her. From my understanding the vehicle has gone from WA where she purchased it to FL and now COI have no clue how it's been serviced and or maintained as we are able to normally spot the effected vehicles that have the concern before a failure occurs with proper maintenance and service intervalsAs not all of the vehicles are effected you can spot them early when the radiator fluid starts to get discoloredIt is not an overnight process that leads to failure Chuck C***Advantage Nissan

To Whom it may concern, I spoke with *** *** regarding this on 9-19-She informed me that she just traded her car in out at a big sale in the local Mall parking lotDuring the appraisal process they ran a AutoCheck Vehicle History report and found the vehicle was in a Minor
AccidentI pulled her car deal and found a *** that we ran during the Nissan Pre-Owned Certification processThere was no accident on it at the time of saleI then paid to run a AutoCheck and it did show a minor accident indicated I then pulled a new *** (you will see dated on the attachment 9-19-2016) and it still was not present on the ***I then called Miss *** back to let her know of my findings and as this is not the norm, however, once in a while we will see a discrepancy from *** to AutoCheckShe asked about the *** buy back and I informed her that she would qualify for a buy back if the vehicle was totaled or salvaged title prior to her purchase, or Odometer problems such as True Mileage unknownShe seamed like she understood the *** buy back and that she didn't qualify for it as it was only a Minor Accident, not a total loss, or salvaged titleShe then asked about how it could be CertifiedI explained to her that it passed our Nissan Certification just fineIn fact as long as it is a Minor accident it still falls into Nissan's Certification GuidelinesWe feel that we did everything the right way and did our do diligence to make sure we were selling a quality vehicleUnfortunately at this time we will not be refunding any moneyAttached you will find a copy of the car fax ran during the Nissan Certification Process, a copy of Nissan's Certified Guidelines, a *** ran on 9-19-when Miss *** contacted me, and the *** Buy Back Guarantee that she signed showing exactly what criteria would need to be meet for a buybackIf you have any questions or need to speak with me please call me at ***Chuck C***General ManagerAdvantage Nissan

I can understand the frustrationNot every vehicle was effectedNissan has extended the warranty on them along with a co-pay for those out of their extension on the transmission such as this truckThe extended service contract purchased was the best one available for the year of the vehicle at time of purchaseWe will not be able to pay the $3,she is asking for

I am rejecting this response because:This is a classic 'pass the buck' response from a dealer that will not stand behind their service. Let me clear up the assumptions Mr. C[redacted] suggested.The truck I purchased had 74,848 miles when I purchased it. It had 87,740 miles on it when the transmission started to fail. This truck is used for a 13 mile commute, five days a week. All recommended maintenance was performed per Nissan and the warranty. Perhaps I should have had the radiator fluid randomly changed and inspected, but I (foolishly) assumed since I had owned it for less than year and put less than 13,000 miles on it, it wouldn't require this service yet. Yes, the warranty covered the timing chains (another item Nissan it being sued for), as it should have.Actually, Mr. C[redacted] knows this is all irrelevant. If I had the radiator inspected the day I drove off the dealership parking lot, and it showed signs of cross contamination, I would be in the same predicament. Complaint: [redacted]I am rejecting this response because: the emails clearly says NO FEES, Mr. H[redacted] is the one trying to take advantage of his ex customer, and not honoring his word in addition his math does not add up. If the Revdex.com needs the emails where his salesman clearly indicates the NO FEES then I can provide them.
I will also start a complaint with [redacted] as Advantage Nissan and Mr. H[redacted] and his salesman do not honor their word, concealed the "disposition fee" and told me that my car was going to be returned to Nissan which appears to be incorrect.Sincerely,[redacted]

We are the highest rated Nissan dealer in the state of Washington, by Nissan North America as well as [redacted] Nissan dealer of the year for 2014 & 2015. Attached is his final deal showing lease payment of $286.19. The disposition Fee is clearly stated in the contract that he signed. I feel Mr. [redacted] is trying to take advantage of us after we went over and beyond to help him get into a New Nissan LEAF, as we did our part in compensating him for the disposition fee at the time of purchase. This is not his first leased car, and as far as I am aware every manufacture has a disposition fee at lease expiration.

I have spoken with the customer and we are working on resolving her concerns together. I'm sure she will be pleased with the outcome. However, I don't know if we will have it resolved within the 10 days of needing to respond to this. If we can keep this in limbo with the customers approval...

I'm sorry Miss [redacted] feels this way. The vehicle passed a rigorous safety inspection, met all of Nissan's standards to be certified, we didn't hide anything from her. She even signed the Vehicle Buy Back Sheet that was attached to my first response. We checked the vehicle out for her for FREE after she purchased the car and found no problems with it. We are firm on our decision.
