On January 10, 2013, I sent $7,600.00 to [redacted], the [redacted] of Advanced Mechanical Services, for an HVAC system to prevent my wife's severe asthma in a cabin we are converting to her art studio at [redacted] XXXXX. The components included in the contract were a York propane-fired furnace, a York 13 SEER condenser, and a Trane Clean Effects Air Cleaner. Only after repeated prodding, from our general contractor, [redacted] of [redacted] and from us, did he begin work, but after I pointed out that the Trane Air Cleaner was missing from the partially-completed assembly, he stopped work entirely. His last reply to increasingly urgent communications was by text on April 8, 2013.Account_Number: Advanced MechanicalDesired SettlementI would be grateful if you were to make contact with [redacted] and to urge him to complete the contracted work, including the installation of the Trane Air Cleaner. Without this component, my wife's asthma, which has required several emergency room visits, could recur.Additionally, it has been 5 months since I made the contracted initial payment, and [redacted] refuses to talk, email, or text me or[redacted] our general contractor (telephone XXX-XXX-XXXX)Consumer's Final Response I write to request that you revise the Desired Settlement portion my Complaint, referenced above and in your email pasted below. Please change the "Desired Settlement" from the text in my original submission, "I would be grateful if you were to make contact with[redacted] and to urge him to complete the contracted work, including the installation of the Trane Air Cleaner." to the following:"Please refund the $1,600.00 you received in January, 2013, for the Trane Air Cleaner and provide compensation to [redacted] for his cost in hiring another company to complete the contracted work. The estimated additiional time and materials cost is $4,000.00, for a total of $5,600.00."As you can see from the emails below, sent to both[redacted]'s email addresses as well as by text message, I advised him today that we have engaged someone else to purchase the equipment he contracted to provide as well as to properly to complete the job.
