I contacted Adams Home Builders locally about a standing water issue in the center of my backyard and it hasn't been resolved after 9 months.I contacted Adams Home Builders locally about a standing water issue in the center of my backyard and it hasn't been resolved after 9 months.Problem date October of 2014,Purchased August 2014,Contacted BBW group to assist and they did NOT resolve this issue neither.Desired SettlementFill the ditch, gutter, runoff in the center of my backyard with DIRT and not with STRAW and/or GRASS SEEDS. The water stand for at least 2 days after heavy rains and collects mosquitoes and is corroding the soil(HEALTH ISSUE #1)Business Response Mr. [redacted] was advised prior to purchasing his home that all rear yards in his community are seeded. Mr. [redacted]'s yard was graded as required by the City of Olive Branch and upon completion received a passing inspection that the yard was graded as directed and to their satisfaction. On August 12, 2014 Mr. [redacted] was explained what would be covered under warranty and what would be considered homeowner maintenance and signed documents to that effect during his walk thru, soil erosion being one of the items not covered under warranty. On August 29, 2014 Mr. [redacted] signed his final walk-through papers indicating that he accepted the house in it present condition, a policy that is in place to insure that all homeowners are 100% completely satisfied and that there are not any outstanding issues prior to closing. Mr. [redacted] sent in a warranty request with regards to his back yard and as a courtesy we went back and regarded a portion of his back yard, re seeded his back yard, and once again explained that soil erosion is homeowner maintenance and that he would have to take the proper steps to prevent any further erosion. Mr. [redacted] signed the completed work order on May 5, 2015 indicating he was satisfied. Mr. [redacted] contacted [redacted] who also explained that erosion is not a warrantable item but homeowner maintenance. Therefore Adams Homes considers the matter closed. Adams Homes advertised 100% financing with their preferred lenders and could not deliver this claim however entered into a contract on that premise.I entered into a contract with a home building company by the name of ADAMS HOMES LLC on May 31st 2013 for the purchase of a home, plan (2625B) in the [redacted] subdivision of [redacted] XXXXX [redacted] in [redacted] This contract was to be financed with a FHA 100% loan through one of their preferred lenders [redacted] It was communicated to me by [redacted] that on July 5th 2013 this program was no longer available and such was also communicated to Adams Homes at that time. At no time after that date did Adams Homes communicate the change of this finance program to myself or my spouse, I first learned of this change on Tuesday July 16th, 2013. I contacted [redacted] and spoke to [redacted] to see if they needed anything else from me at this time for the loan and he informed me that [redacted] no longer had this program for a FHA 100% financed loan they only had a 3% down payment Conventional or the 3.5% down payment FHA loan. At this point I contacted Adams Homes on July 17th through the sales person [redacted] who originally put together the contract and sale with me but she did not immediately answer my call but I left a message on her voice mail requesting that she call me, in this message I also outlined the information I had received from [redacted] A day passed and I had not received any communication from Adams Homes and I called again on July 19th 2013 at 12:35 pm and spoke to [redacted] Sales Manager) at Adams Homes and tried to give her the details of the situation but she quickly told me that she did not know the details of my contract but that she would have the sales agent [redacted] give me a call. At 2:57pm [redacted] returned my phone call and I outlined the information from [redacted] to [redacted] and she asked me did I have any money that I could put down to try and secure one of the other two loan programs that [redacted] had available and I told her no. I explained to her that I signed this contract and opted for the 100% financed loan specifically for that reason and gave her a $1000.00 check for the earnest money in good faith, and I told her that the ONLY reason I even considered Adams Homes is because they advertised the 100% loan financing and if they do not have this program this contract is void because anything outside of that is not what I signed up for or agreed upon with Adams Homes. At that point [redacted] told me that she understood and I just needed to come in and fill out a release form for the $1000.00 earnest money I had given Adams Homes and she told me the money would be returned to me in about 3 weeks. I signed the release form on Sunday July 21st 2013 at approximately 2:30pm at the MODEL HOME location in the [redacted] subdivision of [redacted] XXXXX. On July 22nd I contacted [redacted] to find out if they had any other type of 100% financed loan programs and he told me that they had a 100% USDA loan program that was for specific areas and that I would qualify for it based on what I presented for the other program but he told me that this program would not work for the home in the [redacted] subdivision as it was not in a USDA area. I told him I understood and to please proceed with the loan application and that I would contact Adams Homes to get an estimate of the time frame I would be receiving my earnest check back from them so that I could use it for another realtor. I called [redacted] on the 26th of July at 1:30pm and asked her when I could expect to receive my earnest check back and she told me that my release form had not been approved by her manager [redacted]. Their prefered Lender does not offer the 100% financing they advertise and this contract was signed under false pretense I want my earnest money of $1000.00 returned to me ASAP.Desired SettlementI want the $1000.00 earnest money that I gave them to secure the contract,this contract was signed under false information.
