I am rejecting this response because:Abra has stated that weather was a factor, which it was not, that they showed us a copy of warranty and offered to pay half, which they never didThey never completed work based on their proposal of the promise of it's owners
They submitted bills when we had agreed they were paid in full at end of yearWe have taken pictures and have had to have work completed by other firms to correct the work not completed or done incorrectlyI will forward all this information onto youAbra has also made claims about how we parted company to other firms we use in area and defamed our nameWe intend to go to court if these issues can not be worked outThey are still holding pumps of ours in violation of law

I am rejecting this response because: Abra Landscaping states that the retaining walls were “partially built” which is not correct. Abra Landscaping had completed the walls days prior to the rain storm (I have all this information documented). I agree that the heavy rain contributed to the walls collapsing, however if the walls would have been built to the correct soil type standard, they should not have failed (collapsed). This is not the issue, the walls were rebuilt, hopefully to the appropriate standards for the soil type.The issue (and the reason for the complaint) is that Abra Landscaping has not completed the project. I communicated to Abra Landscaping the items per contract that needed to be completed (prior to Abra Landscaping rebuilding the retaining walls) before I will consider the project complete and I make final payment Once again the items are listed below:Damaged retaining wall block needs to be replaced on the west side of the property (I spoke with the job foreman while they were building the walls and I pointed out block that needed to be replaced) Correct the final grade so that it flows away from the houseo By egress windowo Under the porcho Under the front entrance o By the lakeside decko Builders note in regards to final grade: “I noticed that the grade still slopes to the house around many areas of the houseUnderneath the entire porch, lakeside retaining wall, under the front deck, etcWe strongly recommend that you have the landscapers come back to make the grade correctNo outside water should run to the window well, and you can see how it just wraps right around the corner and drops in.”Lastly, there is a gutter downspout next to the egress window (only location it could be placed). Abra Landscaping as part of the contract was to properly install drain field that the gutter downspouts connect into. In my opinion, Abra Landscaping is responsible to make sure that no water enters the property either by ensuring the final landscape grade flows away from the house and properly installed drain field for the gutters. Both which were included in the contract and were communicated to Abra Landscaping to be finished before final payment was made

We were contract to a landscape project which included a large retaining wall at the newly built home of Mr. [redacted].  During the time that we were working on the project - this specific area (Cushing, Minnesota) had a rain storm go through and this location received over 4" of rain in less...

that one hour.  The homeowner had newly installed gutters on the home but they did not have "gutter helmets" to keep debris out of gutters.  The gutter installation person was to have installed them but had not gotten around to it yet - therefore the gutters failed during the VERY UNUSUAL rain storm and all the water came over the top of the gutters and cause the partially built retaining wall to fail.  The home builder B-Dirt stated to myself (one of the owners of Abra) that yes indeed the gutters were extremely plugged and cause the problems with the wall.  The gutters installer did not take any responsibility for his part that caused these issues- therefore it was totally left to us.  We rebuilt the walls per the contract.  The customer states that he has water problems with the egress window and it is because the final grading is not correct.  This is not true - the reason why he has had water is because the "gutter guy"  put a gutter downspout right next to the egress window there for the water problems.   Mr. [redacted] has emailed a list of things he wants done before we receive our final payment of $ 1,808.40.  We don't feel that Mr. [redacted] has any intention of paying the remainder balance due.

We have been doing business with [redacted] on various projects and properties since 2010 with a very good relationship.  Last year we were contracted to install a paver driveway which was completed last fall.  Due to weather conditions we were not able to install polymeric sand in 2016...

and we were to complete in spring 2017.  (this portion of the contract has not been paid for and was to be done @ time & material per contract)  We were never notified by [redacted] that there was an issue with the pavers.  This spring in May a gentleman from a competitor for landscaping phoned us and said Mr. [redacted] contacted him and wanted some repairs done and was wondering what the situation was.  We told them that we were unaware of any issues with the work we had completed in 2016. We were also contacted by a gentleman from another irrigation company that was sent to pick up the pumps that have always been stored at our shop at No charge over the winters.  We told this person that Mr. [redacted] owed us $ 724.07 from last season so we were not able to release the pumps to him.  At that time we emailed Mr. [redacted] and stated that we were owed $724.07 and would appreciate payment.  On 5/19/17 we emailed Mr. [redacted] and stated that he could have someone come by and pick up the pumps.  As far as trees are concerned we planted 60 trees back in August 2014 and they included a (1) year warranty.  The following spring (2015) there were 4-5 trees that didn't make it through the winter.  Mr. [redacted] chose not to have the trees replaced because he didn't want to pay his portion of the warranty work.  Please see tree/shrub warranty below: Limited Warranty:  We will supply once, @1/2 the purchase price + labor any tree, shrub or perennial that fails to survive the first year after planting - provided the plants have received proper care (excluding damage from animals, winter burn etc.), & only if landscaping bill is paid in full upon completion of the job.
