I am responding to the stop payment order and contract dispute filed by [redacted]. To begin, I was hired by [redacted] to paint her front porch. I used two coats of clear sealer with a non-slippery additive including the side garage and side path. The customer was happy with this work and...

even expressed so in front of a witness (I believe it was her trainer) and gave me a payment of $400. Mrs. [redacted] later requested a third coat of the clear sealer and stated she would buy the paint. I even offered to do the labor for free. The job in question regarding the garage floor project required clarity and time invested to find a solution. The owner, [redacted], did not reveal that underneath the latex floor paint was a heavy duty stain on the garage floor area. Had this been known, I would have only proceeded if we stripped the entire garage floor. What I later learned is that prior to my hire date, her ex-husband [redacted] put a stain on the floor, then the customer proceeded to paint it herself. She hired me because she did not like the floor color. I said that for the best results, my recommendation was to strip of the stain and paint down to the bare concrete, so I can place epoxy for durability versus latex paint. She said she had a limited budget and wanted to proceed without stripping. I researched and worked with my sales representative, [redacted], at [redacted] and we decided to move forward with water based epoxy. I informed the homeowner that this is not a guarantee, but we felt optimistic that it will work, and she was approved to move forward. Regarding the mat sticking issue described in her letter, I’d like to highlight that the mat had sticky glue underneath it, and in the end is what caused the paint to peel. Due to this situation, my sales rep [redacted] contacted the [redacted] firm who sent [redacted], [redacted] to the job site to inspect. At the time of his visit, her ex-husband was present and that’s when we learned that he had painted the garage floor first with a floor stain. Unfortunately, the job had been completed at the time of learning this. I spoke with the [redacted] salesman, [redacted], who stated he had tried to contact Mrs. [redacted] twice but she never returned his phone calls. I have been taking care of my customers for over 30 years and have never encountered any issues with my job performance or my business. I really wanted to help Mrs. [redacted] with this issue but she has been extremely hard to communicate with and was not honest with me about the history of the project area. I do care and have respect for all my clients and would never do anything to jeopardize my business or relationships. The time I spent looking for the product that would work for this particular job, actual labor and time researching the paint, far surpassed my bid for this job so in conclusion, I do not believe a refund for the payment of $400 Mrs. [redacted] gave me for the initial project to seal her front porch is appropriate, as these are considered two separate jobs. In the end, I did not receive any payment for the garage floor work – all of the materials were unfortunately paid for by me.

In response to [redacted]..... he was well aware if all the work that was done to the garage floor prior to his staining of it.  Unfirtunately, he never made it clear that the best way to fix the garage, floor was to to remove all color from it and redo the work.  I have never received any call backs from hisxassociates, especially a gent named [redacted] from [redacted].  John is lying about that as well as [redacted].  The work has been guaranteed to be completed by [redacted] and he has been making futile attempts to fix my garage floor.  Demanding that my neighbor open the garage door for him so he can do the work and demanding I leave the paint outside or else.  Mr. [redacted] is not a super professional person.  Even though he has been in business for 40 years, he still has a,tenancy to be dishonest, lie, and overcharge for his services when he is not sure how to do something.... His garage project should have been quoted 800.00 not 1600.00 if he doesn't know what he is doing.  And, everything that has stuck to the garage floor including paint sticks that Mr. [redacted] placed himself, has left residue on the painted floor. There are tire tracks, chip marks, and padding stuck from a mat with no glue on the back side, because of the poor workmanship. As far as the front porch, it too has poor workmanship. I requested w [redacted] to make sure the floor was not slippery, when wet, after he applied the sateen finish w/grit to the porch......that was the agreement.  Unfortunately [redacted] did not do that and "told" me it's fine, you have no problem with it..UUntrue.  The porch can't be walked on when wet....highly slippery.  Another botched job.  So, with a man with 40 years of experince, [redacted]s workmanship is not the best.  I never received a call back from his reps and [redacted] has been very difficult to deal with.  He is licensed, but at this time, there should be a question on how, well he can do projects..... I do know of another project he painted, that the same result was happening, the paint was chipping off a wall that was not treated properly? I still believe that it is his duty to fix my garage and guarantee the work at a schedule that is helpful for me.  Mr.[redacted] has not been nice to work with and he seems to be taking advantage of the bad job , twice, he has done for me.  If he doesn't know, how to do a project then he needs to seek professional help.  I still wish to receive some of my money back for the garage floor that totaled me 1200.00.  If he had wanted to take all the color off, as he knew there were multiple layers, his fees would have been highly inappropriate for his workmanship.  As stated, I have seen another project that he did in which he had the same problem with the paint chipping and peeling.
