Rent TO OWN BULL******
I had a attorney review my lease only to find out it's bs 🤬

So excited we are able to own a house thanks to A&C Investments. Our kids are so happy to have a house and friends to play with.

A&C Investments is holding my deposit of $1500 on a rental property I was interested in and will not return. I never signed a lease with them.
A&C is holding my deposit that I put down on a property provided by their agency. I have never signed a lease and have only filled out a application. They started billing me as my anticipated move in date was 10/1/2018. I asked for a later date and they told me that I would have to pay starting 10/1/2018 regardless of what date I moved in and they did not prorate and although I never signed a lease. They claim we have a verbal agreement. I never agreed to verbally to any conditions nor did the application fee state I would loose my deposit. I think this is illegal. They claim because other people were interested in the property and they held of renting it they do not have to provide my $1500 deposit back.
I contacted them on several occasions (date below) with no response. They claim because I have/will report them that I am threatening them

I received an email response back from them on 10/15 stating that they would not refund due to our supposedly verbal agreement

Desired Outcome

I want a full refund. I have called and email this company numerous times and only got a response after I told them I was reporting them. The claim we have a verbal agreement, although it was never mentioned we had a verbal agreement until I asked for my money back. There is no legal document in place besides the application. I have not signed a lease with them

Our company had an agreement with***. After viewing a home that we had open and available for rent, an application was placed by*** for the home. After being selected to be the tenant of the home they (her and the other applicant) wanted to sign a lease for the home. Because of their busy schedule and inability to sign a lease at that time an agreement was made. This agreement was according to their desired so they would not lose the opportunity to rent this home and the home being offered to others. The agreement was that we (A&C Inc.) would mark the home as taken, and not offer it to anyone else until they would both be able to meet up to sign the rental contract. Their side of the agreement was a deposit to hold the home for them of $1,500 as agreed on. From the past we have learned not to hold a home without a payment because if people change their minds last minute we are without a tenant for the month, and have to repeat the entire process of finding a tenant all over again, which can take 1-2 months. We kept to our side of the agreement and rejected many good applicants that desired the home after this agreement with ***. After*** and the other applicant missed many appointments to sign the lease they then found out that she was pregnant and wanted a bigger home. We offered them bigger home options, that they did not like, and ultimately they made the decision not to sign the lease as agreed on. We wished they did not make that choice but we are not financially responsible for their choices.

No I do not accept their response. At no time was any of this mentioned to me about losing my deposit. I would have never moved forward with them, if I had been advised the deposit was not refundable and they relied solely on a verbal agreement which I never knew we were in one (verbal). At this time I am moving forward legally to recoup funds lost.

Thank you for taking your time to review this case. We try our hardest to be honest with others and keep to our business agreements. As*** stated that there was no signed paperwork, we wanted to sign the papers with them but the other applicant was to busy to get together. They really wanted the home and did not want to loos the opportunity for it to be given to others so a verbal agreement was arranged until they were able to sign the paperwork. They missed multiple appointments to sign there contracts. We kept to our end of the agreement by turning away many other people wanting the home. Signing the contract was postponed multiple times by them and it seemed that they were wanting to change there mind and not keep there end of he agreement, even after we kept to ours. They came up with multiple excuses on why they could not meet up. They then stated that*** wanted a 4 bedroom home not this 3 bedroom. We agree with you on working together to try to resolve concerns and come up with a solution to the problem. We did try working with them to resolve these issue and so they would not loose there deposit as agreed on. We showed them other homes, some that met there desired 4 bedroom size. They continued to come up with multiple different excuses on why they can not keep to there agreement and even continue to do so at this time with the garbage in the yard. When we found out that the yard was not to there liking we sent our contractor over there right away and cleaned it up to try to resolve that concern also. We wish that they did not change there minds and are trying our hardest to work with them to resolve there concerns but feel that there underlining concern is that they just want to break the agreement. We have many of our employees that has been involved with this process that can serve as additional witnesses on the above information.
