Case: # *** On 6-17-a foundation inspection order came in from our online order from our website from *** *** at *** ***, for her buyers that were financing FHAJust a note we do a lot of work for several *** *** offices and loan originators in OregonOn 6-19-Russ E*** & Trent E*** visited *** *** at her home, they introduced themselves, gave her a business cardWhile we were there *** first statement to us after we told her we were there to inspect the foundation and verify if the home had tie downs or not, *** replied saying the home has tie downsAt that time she let us know if the home didn’t have tie downs she had no funding to pay for themAt this point *** gave us a short life spill about the buyers of her property wanted everything she had, and the conversation was friendlyWe asked her if she had other items to sell we might be interested in sporting goods items, or man type stuf* said she had some firearms but didn’t want to sell them, but had a generator that her husband purchased for $220, and at the time would consider selling itWhen I looked at the generator it was a watt Honda, appeared brand new, which I know new are $800-$1000, I told *** at that time I wouldn’t buy it without researching market value, which I thought was more like $500-$*** also had made statements she was a ChristianWe are believers of the Lord as wellWe created an estimate to send to the lender for installing tie downs and issuing a engineered foundation letter as required from FHA/HUD for the loan to go throughWe talked to *** about the above statements, that we would be interested in bartering to help *** complete her sale*** called me Russ E***, and said she didn’t want to barter for the work, and told me that she had called the State Police regarding me asking her for firearmsI asked her for sporting goods items, she led on to firearmsI have several correspondence emails and phone calls to *** *** of *** *** confirming the buyers would pay for the tie downs and *** would pay for the foundation certification at closing of the loan and was agreeable to thatThe work was agreed upon, we lowered our price for the seller and we were billing all costs to escrow broke down into two invoices $for install of tie downs, to the buyers and $for certificate, *** ***6-30-*** changed her story a couple times, she was informed by *** *** that the tie downs would need to be installed, she choose not to be there when our son Trent E*** went there to install tie downsOn 7-20-we received an email from *** ***, saying the loan had been terminatedAt this point we would need to collect the invoice due and file a lien on *** ***’s home *** *** *** ***, Welches, OR We talked to *** *** regarding the sale not going through, *** said the lender needed a day extension, the seller *** *** would only agree if she could live in her home longer daysThe buyers had already given notice to move and had moved out and were living in a temporary situation waiting on this loan to closeI talked to *** on 7-20-and gave her the opportunity to pay the invoice and would discount it, in turn she said she was not responsible for, as she did not order it7-23-Filed lien at Clackamas County for $Around the first of August I got a phone call from a contractor friend of *** asking questions on her behalf, and he crawled under the home verifying the tie downs were installed8-17-got an email from *** saying she was in contact with a lawyer, and said I had no signed documents*** said in her email she was informed of the tie down installation8-17-I talked with her new realtor *** *** about the situation, he told us she had a buyer for her property, and he wanted copy of the lien paperwork, and would talk to ***8-28-*** sent a certified letter saying she would file with contractors board in days should things not be resolvedWe are not in the wrong, we provided a service, and somewhere along the line are being made out to be the bad guysJust a note we did do a foundation certification and tie downs for the previous buyer on another home, which has closedWe will wait until the OR Contractor board contacts us
