An annual contract was entered with the Customer on February 11, 2015. Payment terms in the contract (which was signed by the Customer) state the contract begins 2/11/15 and continues until 2/11/16, and then rolls month to month there after (unless contract is paid in full, which Customer did not)....

Cancellation terms in the same signed contract state that Memberships that roll over month-to-month status require a 30-day written notice which will include one billing cycle. The Cancellation policy requires the Customer to provide 30-days written notice by filling out the proper cancellation form at the gym location, or certified mail return receipt. Contract was fulfilled and cancelled March 15, 2016 at Customer's request.

This is in response to the complaint with the ID of [redacted] Once the term for our 2015 paid in full memberships would expire, they would auto-renew at a month to month basis but at our lower monthly rate. This is explained when signing up and also in the agreement (which is sent out to our...

It was never advertised that we had a open date. That is why the pre sale link was only made available online and closed the date we opened. It is a pre sale that allowed anyone to take advantage of the   "charter member" rate special. As for the mail, the post office will drop off mail, to us directly, I cannot control when mail is delivered,  and the day that it arrived one of my employees worked the morning shift.  As you will see highlighted in the section your membership does not start until the facility opens.  SECTION 2: YOUR PREPAID 25.00 MEMBERSHIP ENDED. 11/04/2016-12/04/2016 in the next section on the highlighted area, it reads how to properly cancel your commitment: and if properly qualify, in this instance you did not. see pdf.

I am rejecting this response because: Anka is failing to let you know that the letter was most definitely post marked for earlier in March. I did not state that I sent it months ago ( I stated I sent it after we spoke in beginning of March when I started getting the emails and text messages if you refer back to my initial complaint). Ironically the letter magically appeared the day I went in to the gym to sign the agreement over 22 days after I mailed the letter. It was sitting on the counter when I went in to sign. I have never stepped foot in her gym before that day, and she is leaving out the part about her advertising the gym would open in December when it actually opened in February when there was no way for me to get a hold of someone in person (which supposedly is the only form that Anka will accept though the contract states otherwise) . I would also like to state that when I spoke to her on the phone she would not give me any other remote options to sign the opt out even though her "contract" accepts multiple forms including facsimile (telegram) which she claimed she could not send me. Copied verbatim from her "contract"         "If you properly rescind or cancel the Agreement, you will be issued a refund for any prepaid sums within 10 business days after 9Rounds's receipt of your proper notice of rescission or cancellation. At your election, refunds may be processed electronically back to the credit card or designated account on file. If you do not qualify for rescission or cancellation as described above, then you may not terminate your prepaid membership prior to the end of the intial term. Once your initial term ends, your prepaid membership will expire automatically." Going off on the information above and looking at my contract it says my term was 1 month to begin 11/4 and to end on 12/4. Which would be my initial term. It does not say anywhere in the contract that they can bill me for another month after I cancel either, which I was told I will be billed for April. The information that was given to promote the business was misleading and again I am asking for the company to stop trying to send me bills and calling and texting constantly and to wipe what I owe clean

company has always expressed open communication between any and all online " pre sale members" It will show that she opened all communications via email at which progress we were in with opening this facility. And that anytime during that process she had ample opportunity to reach out and cancel said agreement.I also have the mailed letter that Miss [redacted] claimed that was sent months ago, post marked for the month of March. Miss [redacted] also claims that she had moved, but the letter shows that her address matches the same address she had signed her agreement with.Miss [redacted] also visited our facility to fill out our 30 day quit notice on 3/21/2017, we have her signed notice, that I will attach to this correspondence as well. _____________________As you will see I gave Miss [redacted] the opportunity on February 13th to drop into the club and fill out our 30 day written cancel notice, and that although she would not of been with in her right to cancel, I would of been happy to let her out of her agreement. She chose not to. With the facts that I present before you, it will show that I have been more then flexible.
