I am rejecting this response because:
Mr*** refuses to come to the house due to plumbing breaks, refuses to provide his insurance, and he makes no offers for refund. The following statement will show that he is a liar and I will be submitting additional evidence in support of my allegations
Mr*** observed the water levels dropped from the clean out. I have never requested the commode to be left removed. There’s absolutely no benefit to the customer to leave the commode uninstalled. Mr*** did the static leak test on February 24, and returned two days later on February 26, to do the pin point to locate the breaks. The work started on March 1, by tunneling under the house. Land Stabilizers LTD was hired on 04/01/to level the house and they used existing tunnels to install piers under the house. Mr*** is incorrect to say that the tunnels were filled and completed by March 20, 2011. * * * Plumbing LLC did a post static leak test on April 13, and the test failed. The break was not found because Mr*** failed to pull the commode when he did his initial static leak test. Robbie Castellano was hired to dig the right side of the house after Mr*** did a pin point and located a break by the washing machine. Mr*** was advised by me that * * * Plumbing LLC observed the plumbing did not have a degree downward slope and Mr*** told me the back fall was minimum. I do not understand why Mr*** would not have done the job correctly the first time but for him to expect the customer to make recommendation and proposal is asinine *** *** Plumbing took pictures after tunneling under my house on September 22, and advised Mr***’s work never would have passed inspection. Unfortunately, I am in Bexar County where permits and inspection are not required. The pictures *** *** Plumbing took are very objective showing places arched upward then downward and then upward again. The pictures show bends where the plumbing are stressed. There are absolutely no hangers anywhere to be found. It is the job of a license Master Plumber to make recommendations on their proposals. Such negligence cannot be excused by the plumber by saying the job is no longer under warranty. The absence of hangers is enough proof that Mr*** failed to do his job as per building code or other law regulated by the state. Therefore, Mr*** is liable for damages for his negligence
Land Stabilizers LTD was called again on or about February 13, due to a shift in foundation. They called * * * Plumbing LLC to do a static leak test and it failed. I called Mr*** to fix the break under warranty. Mr*** is already arguing that the break is not the cause of the shift in the foundation but the foundation is the cause of the break before he does a pin point to locate the break. He also advised that if they level the house before he does a pin point the warranty would be void. Mr*** did a pin point on February 18, 2012. He put the camera through the pipe below the sink and he pulled quickly before I could look though the camera. He advised he could see nothing for all the grease in the pipe. He went outside to block the cleanout and filled the pipes with water from the kitchen sink and washing machine. The difference in performing a pin point was not noticed until the more recent pin point done by *** *** Plumbing. I believe Mr*** covered up the back fall in the plumbing by the sudden change in procedure. Mr*** found break by the half bathroom and Land Stabilizers LTD did an amending proposal to include a break in the foundation. After the foundation was leveled Land Stabilizers has * * * Plumbing LLC to do a post static leak test on March 1, and it failed. Mr*** did another pin point and found the break by the washing machine. He had me hire *** Alonso directly to dig a tunnel to the right side of the house to repair the same break Mr*** repaired back in the year
I had not found the warranty provided by Land Stabilizers until after my initial complaint. I noticed the warranty was dated June 28, with Land Stabilizers. After reading the date, I recalled Land Stabilizers would not provide a warranty until they receive a letter from Mr*** that a static leak test passed. I called Mr*** and advised that I need a passed static leak test before I can get my warranty from Land Stabilizers. I got my warranty from Land Stabilizers via mail. I called Land Stabilizers LTD about the warranty and they advised that they received a letter from Mr*** of a passed static leak test. I originally thought I had a passed static leak test by * * * Plumbing LLC but after finding the paperwork required by the structural engineer that it dawn on me that I do not have a letter showing a passed static leak test. I cannot find a charge from Mr*** for a post static leak test and I do not recall him doing a post static leak test. I have a charge for pin point dated February 22, in the amount of $and a charge February 28, for $for break at the half bath. Mr*** delegated the repair by the washing machine to right side of the house to *** *** along with excavation in the amount of $on March 18, 2012. The next charge from Mr*** was for converting a single vanity to a double vanity in the amount of $271.51. Mr*** must have falsified a static leak test to Land Stabilizers on/or about June 28,
Mr*** lied, “He stated Land Stabilizers came out in March and found the house had settled again they did not think it was plumbing related and they shimmed the foundation.” Land Stabilizers never gave me an opinion on the cause of the shifting of the foundation. Mr*** admitted that I wanted repairs done under warranty and then he wants you to believe I told him that Land Stabilizers told me the shift was not due to a plumbing break is contradicting and a blatant lie. Where he states that my house was leveled in March simply did not happen. What I told him was that *** *** with Land Stabilizers came out and advised that they do not have a shim small enough to level the house but detected a rise in the foundation at the double French doors to cause them to jam. *** *** Plumbing advised that there was a great void under the house and water flows where there is least resistance. The rise to the foundation where the door is jammed that leads to the garage is in proximity of the break to the right side of the house by the washing machine. This is the third break in this location and the other break is in the same location of Mr*** did his repairs. Mr*** cannot as blame on Land Stabilizers from the phone nor does he have the credentials to do so. My house remains unleveled and my doors remained jammed to this date. Mr*** advised, “I am not going to waste my time.” He told me this when he called me delusional. He has not come to the house to assess the situation and he certainly not able to evaluate the situation from the phone
Where Mr*** states, “The fee I charge per linear foot of tunnel and backfill was the industry standard set by the insurance companies at the time of repairs.” This is also a lie because there was no insurance company involved in our transaction so there was no insurance company setting the standard. Mr*** is responsible for misrepresenting charges and subject for review

This letter is in response to additional concerns and allegations in the homeowner's second letterI will only be addressing the new concerns and allegations as I have already responded to the repeat issues in his letter
First off I have never lied to a homeownerMy homeowners repeatedly use me and refer me to friends and family because of my honestyI have not been to the home after our September phone conversation due to the homeowner's yelling and nasty demeanor on the phoneI did not feel a face-to-face meeting would be appropriate
All repairs done at the home were in accordance with plumbing code and manufacturers recommendations using schedule PVC pipe and fittings, heavy-duty clamps and glue joints made with the proper primer and glueHangers or steaks are only required every 5' of horizontal piping and no repairs exceeded 3' >4' of pipingEach repair was supported by either concrete or dirt well within the 5' requirementThe main sewer from the clean out to the repair where the kitchen sink ties in was not exposed except for one side to follow as a guide and was left well supported with the original dirt
Three years ago when the tunnel was excavated this piping had proper slope and was not disturbed by the repair of the x wye for the kitchenThere was absolutely no negligence on my part as I repaired three totally separate very small 3'> 4' sections, which in no way affects the remaining system
As the homeowner had paid me to do numerous jobs at the residence I did not charge for a quick retest after repairs in The homeowner was present during the final retest in and observed the test hold for minutesMonths later when he requested a written retest report one was provided for the test performed in his presence
I only repeated what was told to me by the homeowner over the phone when he stated that a company called Land Stabilizers came out in March and had to shim the houseHe told me he did not call me then because he did not think plumbing was relatedI am not trying to assess blame on anyone for the current issuesI am only stating that my three small repairs were done correctly and since the warranty has well expired I am not liable for the current situation
PVC pipe and fittings only break under great pressureIf they were not installed properly the joints would only pull apart, not breakI never said an insurance company was involvedI said plumbing companies used what the insurance companies set as the pricing for under foundation repairsThis is a perfect example of words and statements being twisted around to point blame

This letter is in response to the complaint your office received about my company Topp's Plumbing Company, LLC. I am the Owner and Master Plumber of this company. I would like to start by saying, in the 11 years I...

have owned my own business, I have never had a complaint reported to the Revdex.com or any other professional reporting agencies. Although I regret that this job has turned out this way, I do not feel it was due to any negligence of my company.
To begin, a two-story house such as this one, with no shower drain or other visible opening to see water levels has to have a commode removed in order to perform a static test. The static test is done by plugging the drain system at the outside clean out in the ground towards the house. Water is introduced to fill the drams up to the level of the foundation. If the commode was not pulled there would be nowhere to observe the water level. The half bath commode was pulled and the homeowner observed the testing. The confusion probably comes from my telling him I don't pull the commode on a single-story home if there is a shower drain to view the water level from. This is only done for the initial "Yes or No" leak test. The commode is always pulled during pinpointing to eliminate that fixture and to add an additional site hole.
The initial static test in February 2011 showed a substantial leak of 18" in one minute. The homeowner requested the leak to be pinpointed and to leave the commode off for the week until I can pinpoint the leak so it did not have to be removed again. On 01 March 2011 a pinpoint test showed the leak to be where the kitchen sink connected to the 3" trunk line from the upstairs bath and washing machine drains A proposal and test report was submitted to the following day. During the test a camera was used and no back fall was present. There was grease build up in the kitchen line. The grease was cleared. The homeowner signed the contract on 01 March 2011 and repairs were started the following day. After the house was leveled by others. The drains were tested again with the homeowner present and the test held. The tunnel was backfilled on 20 March 2011 and the job was complete. Not once during the process was there a request for an Estimate to replace all of the plumbing. I was asked if I thought it was necessary and as it was a PVC system I stated only leaking segments needed to be replaced I do numerous tunnels that include whole house replacement when needed and would never turn down a chance to make thousands more on the job.
I was next contacted in February 2012 to perform another static test as the house had shifted again. I installed a 3" test tee on the right-hand side of the residence on the 3" line from upstairs. Leaks were located on the 2" 90° for the half-bath lavatory and. the 3" 90° for the upstairs bath. The reason for running water in the kitchen sink and washing machine was to see if they were on the test being performed and to isolate the kitchen sink for separate testing. The homeowner requested the repair's be done under warranty. I told him I only warranty what I had repaired before and these were different areas and had nothing to do with my repairs in 2011. He agreed and paid others to excavate the leaks and have me repair them. The repairs were done on 01 March 2012 and as indicated on Invoice #15006 that I am providing. I only charged for the 2" 90° repair at a discounted rate of $70.00 per hour instead of $90.00 per hour and I replaced the 3" 90° at no charge. There was slight back fall on the 3" line that was corrected by the repairs. Back fall on a drain system is always bad and needs repaired. Once again I would not turn down more money on a job.
In April 2012 there were static tests performed by both Land Stabilizers and myself. Both tests passed as indicated by the homeowner in his complaint. If any repairs were done incorrectly the test would not pass.
My next contact was on 18 May 2012. The homeowner requested I make his single master lavatory piping into a double vanity. This was done at my normal rate. The restroom was demoed and no request was made to set the commode. The $305.09 Invoice #15601 is provided and shows this.
A 1 Year Warranty was provided for the April 2012 repairs although I do not usually warranty work someone else backfills In August 2014, was contacted by the homeowner and he stated the repairs I made in 2011 and 2012 were leaking and I should warranty the repairs. I explained the warranty expired 16 months prior and he should have called for a static test while under warranty.
He stated Land Stabilizers came out in March 2014 and found the house had settled again they did not think it was plumbing related and they shimmed the foundation. I explained on the signature page of the contract it states if any foundation work is done the warranty is null & void. Any time a foundation settles or is raised it tends to break the plumbing The problem is with the leveling company. Once a foundation is leveled, if done correctly, it should stay that way. He states in his complaint he is hiring another company to level his foundation again. A static test should be 'Performed before and after any foundation work. This was not done in March 2014 as stated by the homeowner. He said that I needed to make an insurance claim on my company insurance to cover Us repairs. I told him for the numerous reasons I already stated there is absolutely no warranty from my company and the thought of me using my insurance for this is delusional.
All companies have different rates. It is always recommended to get three estimates for any work. Large companies can absorb certain costs such as plumbing material and labor or deductibles. The fee I charge per linear foot of tunnel and backfill was the industry standard set by the insurance companies at the time of repairs.
