I am rejecting this response because:Once again this contractor has chosen to respond with half-truths and outright falsehoods.  The email I sent to him was a result of a very heated discussion about how much he had messed up my kitchen remodel.  He failed to point out that he began that discussion by accusing me of nit picking his work (sample pictures attached) in order to get out of paying him and by calling my character into question.  He also chose to leave out the fact that I sent that email on May 11th while his contract guaranteed that the job was to be completed on April 29th.  He did not bother to mention that he had left me with the impression that it would be a matter of a few days, not weeks, until he could acquire the materials needed to finish the repairs on the botched flooring job.  We had arrived at a very short list of other fixes that would get a small portion of the poorly done work up to a minimally acceptable level. This included the $1600 refund for the poorly installed backsplash (and yes, he admitted at the time that it was poorly installed) because he was incapable of figuring out how to fix it without a two week delay in ordering new materials, which I told him was not acceptable! There were a great many issues he refused to address and any compromising being done was on my part to get him to agree to finish the job.  I had done all of the compromising to arrive at that list.  Once he emailed to let me know it would be an additional two weeks (or more) before he would even call and discuss a finish date I simply gave up on him. His promises and “guarantees” amount to a false sales pitch to lure unsuspecting people into hiring an incompetent contractor.   Sadly, I fell for it.By the way, he also said that he is fully licensed and insured but, since his threats, I have looked into him more closely and can find no evidence that he is registered or licensed as a contractor in this city, county, or state. (Perhaps he is licensed, but I can find no proof of this online.  Furthermore, I cannot find any proof that his business entity “303 Contracting Corp.” even officially exists). He also stated that no building permits would be required since there would not be any structural changes made but, again subsequent to his threats, I have looked into this and found that the job should have been permitted and had inspections done because he:1) added new plumbing fixtures in the laundry room2) added electrical outlets and new lighting fixtures 3) added a range hood and new venting and duct work 4) changed the stove over from electric to gasHe said everything would be done to code and again I have reason to doubt this, particularly in light of the electrical outlet installed under the sink within an inch or two of a water source and drain hose (picture attached) which seems dangerous to me.So, now it seems that the entire project may have been done illegally and might have to be torn out and reinstalled by a company who will to the job right.He left a voicemail saying that he is going to put a lien on my property and sue me.  He has called me two faced, bat-st crazy, and the worse kind of person (all documented in emails and voicemail).  How could I ever be expected let someone like that back into my home?It is my understanding that the Revdex.com works with the State Attorney General and Office of Consumer Affairs to investigate and prosecute cases that rise above mere incompetence, cases that involve negligence or are possibly even criminal in nature.  Perhaps it is time to investigate whether [redacted] and 3 day Kitchen & Bath actually operate within the law?

I do apologize to the customer for not being able to bring this kitchen remodel up to their expectations.    In regards to the credibility of my company, I am happy to show you all of my licensing and insurance.  I assure you that all of my sub contractors are also licensed and insured.  All the work is up to code and done by the proper technicians.   303 Contracting Corporation is registered with the state of Colorado. My insurance is handled by Security National Insurance company. I am a registered contractor in Colorado. I work hard for my customers and on my business to keep it up to date with all the proper licensing and insurance as well as being on top of new codes and regulations.  A simple phone call to me could have cleared up any questions about my company not being credible as I keep all the information on my laptop.      I wish my customer the best.

To Whom it may concern,   It has weighed heavy on my heart that I have not been able to 100% satisfy my customer.  At the time of signing my contract I always make an agreement with my customer that I will do whatever is necessary to make them 100% satisfied if they agree to let me back into their home to correct anything they are unhappy with.  I made this agreement with the customer in this case.  When I realized there was more to his unhappiness than just the usual touch ups, I went over and had a face to face conversation where we agreed upon the work I needed to perform to bring the kitchen up to his standards.  This was the e-mail he sent me after that conversation:   “Hey [redacted],   I am so glad that our somewhat heated discussion ended in a way that will allow us both to feel better about things.  I don't think either of us are walking away from this transaction unscathed but compromise is better than conflict to my way of thinking.  The breif conversation I had with *Customer’s Partner* about my compromises got nearly as heated as our discussion so I've still got some conflict resolution left ahead of me!   I just wanted to recap my expectations so we are completely clear and remain "on the same page."     You have agreed to:   1)  repair the nailed down tile in the laundry room ( and any issues associated with that repair)   2)  clean the glue/filler material off around the joints (since I have been unable to remove it with mild cleaners)   3)  repair the tile, trim, threshold...  in the doorway to the dining area   4)  trim out the back door to match the other trim on the project   5)  take $1600.00 off the overall cost of the project to cover the backsplash materials and labor should we decide we cannot live with it in its current state   6)  we left this ambiguous,  but Oscar's first question was how about finishing under the laundry room cabinets and I told him I thought you had said at one point that you would be okay with doing that (I'd appreciate it as well!)   You also said that you are not closing the door on doing other minor repairs to improve our satisfaction, and I promised to not take advantage of that offer, and with that I think we have a pretty good vision of how to move forward and conclude this remodel.   It is my sincere hope that we can finish up on good terms and part friends.  Please let me know if I've mischaracterized anything we discussed, otherwise I'll look forward to hearing from you when you have the materials needed to finish up.   Thanks...*Customer*”      I compromised with him to come to a resolution.  I agreed to pay for his backsplash which I thought was done fantastically (pictures included).  During our conversation I did mention that I would need to order the materials to replace the tiles in project  #1.  After getting back to my desk and ordering the tiles I sent an e-mail to the Customer telling him the time table.  He wrote back an e-mail that told me that I was no longer allowed in his property and I should not expect a payment from him.  From that point on the customer has been completely shut down.  There has been no way to communicate a resolution.  It is firmly my belief that he realized I would do anything to make him happy and receive my final payment.  He wanted a free kitchen and would have me dance around until I walked away.  That being said, I still would go back into his home if allowed and take care of the issues at hand.    His response to the Revdex.com says I threatened him.  The only threat I have made was to take him to court.  Never in my career has a remodel ended up in court.  I have always reached a resolution long before it reached that stage.  I strongly feel my work and quality was up to par on this job.  I have attached pictures for someone else to judge.  I have included close up of the floor and back splash which were two of the customer's biggest complaints.       I hope we can reach a resolution in this case.   Thanks for your time. -[redacted]

Hello and thank you for taking the time to review my response, I do guarantee my time frame on kitchen remodels.  In this instance I said we would be out of the customers house with a working kitchen in five days with the stipulation that we would come back the following Monday and address...

any imperfections on the job.  Usually this means we touch up some drywall repair or maybe clean a spot or two we missed.  In the case of [redacted], my crew and I made a few major mistakes on the final day.  We ended up putting the holes in the wrong spot on the majority of the cabinet doors for the knobs.  This meant that I had to replace a lot of the cabinet doors.  So, the workload on the following Monday was a lot, but the customer still had a working kitchen and a clean house after the fifth day.  It was not ideal, but we ran into a few bad mistakes.   We did come back on Monday as was planned upon signing the contract.  Not for touch up, but to fix the mistakes of last week and take care of any lose ends.  After we were finished on Monday it was still clear to me that the customer wasn't happy with our work.  He came up with a list of items that still needed attention.  Items like pulling out the range to touch up the drywall and paint.  An item that we happily did, but I did not find to be as serious as the customer thought it was, being a spot that isn't ever seen.  After another day of meticulous details I got a call from the customer with another list.  They were going over this remodel with a fine tooth comb.  While I don't mind the details and am happy to comply I was starting to get weary.  On the Thursday after the Original week.  After three days of touch up I went over to talk with the customer face to face.  After about four hours of debating we came up with a final list of details I needed to fix.  In an e-mail he sent to me, he outlined the steps needed to make him happy and then we could move on.   One of these steps was removing a few pieces of flooring he wasn't happy with and replacing them.  I sent him an e-mail back saying that flooring needed to be ordered and I wouldn't be able to get it from the factory for 2 weeks.  There wasn't even a way to overnight it.  He found this completely unacceptable and told me off.  He told me not to step foot in his house again and that he would not pay me for his kitchen remodel.  I had written it off as a loss.  I did everything I could to make this kitchen satisfactory for him.  The pictures of the kitchen are beautiful.   I would still be happy to honor our agreement after the fourth day.  To come back in and fix the things he agreed would make him happy.  At this point I would still have to order the materials to make it right.  It would take a couple weeks of shipping, but after that, only a day to install and touch things up as agreed upon. -[redacted]
