The office is trying to bill us for damages that were there prior to moving in, not applying our deposit.
Moved into unit *** in Aug of 2015, it was okay but there were issues with the unit, namely the water leak in the storage closet on the patio, maintenance came out to look at it but never fixed it, massive amount of black mold. After 3 yrs living in 1213 we transferred to *** after a neighbor vandalized my truck (office did nothing to the neighbor).

The apartment move in was delayed over 2 weeks due to it not being ready. When we demanded move in it still was not ready. The carpet was dirty. Paint splatters were all over the floor. Dead cockroaches and bugs were in the light fixtures and scattered throughout the unit. There were nail polish stains on the counter tops and scratches on the floors and walls.

During our year living in *** we had 3 active leaks with black mold going untreated. I'm sure the health department should come check the units, as most of our neighbors had black mold too. We had cockroach infestations. Work orders were ignored for months. Trash service that was paid for was unreliable and trash would sit out for days. The conditions of the grounds were deplorable. The pet waste stations garbage cans were overflowing onto the ground with pet waste and no bags were replaced for weeks. Pet poop was everywhere. The ONLY small dumpster for the ENTIRE complex was overflowing with trash on a weekly basis. This size of property should have 2 large dumpsters at the very least. Both pools were closed for over a month by the city because the chemical levels were not maintained properly. Management lied to us about this issue, saying it was due to a signage issue. We found out the truth when we received the report from the city after we contacted them directly. The 2 saunas were non-functional almost the entire 4 years we lived on the property. There were several abandoned vehicles in the parking lot for almost a year straight used as storage. The maintenance crew was often seen working on their own cars in property garages during working hours instead of addressing our work orders. I included photos of our bedroom window that had a massive leak that was never fixed properly, that had at least 3 ft of water damage to the carpet/pad that I had to fix. The master closet has massive black mold due to a leaking pipe in the guest bath that "fixed" by maintenance by cutting out parts of the carpet, part of the dry wall was not drywall but painted over packaging tape.

We were terribly let down by this property after being loyal tenants for a total of 4 years. We will not be paying a penny of the damages that were supposedly incurred during the time we lived in *** The carpet and walls were in bad condition upon move in. Anything needed to be done to the unit for a new tenant is regular wear and tear that the property should cover. We should not be paying the bills for Water's Edge regular maintenance. Also, where is our security deposit??? It was not returned and was not added to the final balance. Are we to assume Water's Edge is just pocketing that money?? Also, management sent me photos of the unit after we moved out, a lot of the photos looked exactly like the ones I sent them after we moved into the unit. I took photos of *** prior to moving in (we already paid first month rent) that showed trash sitting in the living room, I had Jack Jenkins who worked there yelling at me in the office parking lot saying that I was not permitted to be in that unit, very classy.

This morning my wife and I both received calls from Carson Warfield Collections, I spoke to them informing them there will be no money sent to them. I called Water's Edge, spoke to a new leasing agent who got more than an earful from me, informed her I need Adara Communities to contact me...not holding my breath.

We also know the conditions of *** prior to moving in because we are friends with the couple who lived there prior to us.

Desired Outcome

I want the following- The bill recalled from the collection agency so this will come off our credit. The bill eliminated due to the complex trying to charge us for carpet that was already worn out, paint issues etc. Honestly we are at the point that we want our deposit back because we have to endure collection calls, filing complaints and our well being because of the black mold.
