[redacted] Here is my response to this made up complaint; I was recommended to [redacted] by a mutual friendI went to his home and we dicussed priceHe had told me he had two prior estimates and one was from [redacted] for or thousand dollars, the other was from [redacted] that his girlfriend e-mailed to me which was approx$13,I told him as a courtisey to our mutual friend I would do the job for $11,and we agreed virbalyThe job included [redacted] sidingOnly when he insisted on [redacted] siding did the price go to $12,because I explained to him I didnt have the buying power at [redacted] and the material would be more costly to meI suggested to him I would like him to use the [redacted] siding because I felt with my experience it was a better productHe insisted it was a color choice issue and he liked the [redacted] color betterI then hung panels of [redacted] siding on his garage that was a perfect match of his color choice but he still wanted the [redacted] sidingThat took care of the extra $and he agreed to itWhen I wrote the contract he agreed and signed itTo answer his second problem, the black marks on his siding, he caused themThe problem is he insisted on doing some of the workHe was supposed to have the the soffitt boards removed, change the rotted fascias befor we covered them in aluminum and have his wiring for his soffitt lights installed before we started working thereThis dragged on for months and his girlfriend [redacted] kept calling me as to when we could start the jobShe stated to me he was a hunting and fishing maniac and was doing alot of side work for cash and was busyHe was supposed to stay ahead of my team as he would do the soffit work at night we would side during the dayWe got to the house one of the days to work and his work wasnt finishedI told his girlfriend we were going to leave and come back another time and she wanted us to workShe called him and he said to do our work and he would do his work that night after we did oursWe instructed her to tell him to be careful as there would be new siding installed below his work and she said okThe next morning we came in and found he had dropped a board from above our work and he had destroyed panels of siding and there were black marks all over the rear of the house caused by whatever was in those soffittsHe took off work that day and we asked him what went onHe said he damaged the siding and could he pay us to replace itI changed the siding at no extra cost and we noticed right away the black marks and questioned himI told him it would probably have to be power washed and we werent responsible for itOnly because we are a good contractor we put our heads together with him and tried to clean a few spotsHe thought it was cleaned and thanked us and although we werent happy about it we cleaned the whole back of the houseHe contacted me by text and I told him I was going to get the [redacted] rep involved to see if something was defective as there were few spots on the siding that either wouldnt come clean or were discoloredThe rep called me from his house and told me out of curtisey he would order square of siding to rectify the problem so the discolored panels could be changedThe rep asked if I wanted him to notify me or the homeowner when the siding came in and I answered he should let us both knowI havnt heard from the rep yet that the siding has arrived To answer the gutter problem, I instructed the homeowner that he needs a roof and there is no drip edge on the househe said he would do it next yearHe asked me if I would be interested in installing drip edge only on his house and I told him no because the roof is too far gone and the shingles would disintegrate if we tried to do thisHe needs a new roof with new drip edgings to solve his gutter problemsHe knows thisHe called me about his gutters leaking behind them and he wanted the gutter mans phone number which I gave him the same day he called me Notes; [redacted] withheld payment from me because he said I promised him gable end vents on his houseI instructed him that that wasnt our agreement and it wasnt in the contract, he said he didnt care and wouldnt pay me what he owed me until I did the work for himI sent men there all day to remove the already installed sidiing and install decorative vents the I paid forHe even insisted on the more expensive onesWhen I finally got paid the balance he said if I dont bad mouth him he wont bad mouth me...WHAT ? Only when he insisted on [redacted] siding did the price go to $12,000 because I explained to him I didnt have the buying power at [redacted] and the material would be more costly to me. Hello [redacted] I am writing to you in receipt of Mr. [redacted] answer to my
compliant.  First I would like to say that almost everything that Mr.
[redacted] stated is false, made up, or a complete lie and I have written proof as
well as voice recordings to validate my statements and completely negate his
Lies.   I'll start with his first lie about my other estimates.
             I did indeed receive estimates from [redacted] and
[redacted] siding for the exact job that Mr. [redacted] performed. But [redacted] price
was 13,000.00 and [redacted] price was $10,500.00 of which Mr. [redacted] said that he
would match.  Never once did he say that because of a mutual friend that
he would do the job for 11,500.00.  In fact he bragged to me about how his
prices are usually 3-4 thousand dollars cheaper than [redacted] siding.  Both
prices from [redacted] And [redacted] siding were for [redacted] monogram siding which
is their top premium panel.  This is also
what Mr. [redacted] said he would match.
            Now Mr. [redacted] states in his response and I quote "

explained to him that I didn’t have the buying power at [redacted] and the material
would be more costly to me" but this totally false and I can prove it with
a proposal that Mr. [redacted] sent to me in JULY 2014 that is for the [redacted]
monogram siding just like [redacted] but the proposal reflects the already jacked up
price of $12,000.00. He increased the price by $500.00 it seemed like every
time I talked to him and the same work was being performed nothing extra!
 My very first contact with him looking over the job he tells me he can do
it for the same price as [redacted] $10,500.00.  Then we waited a few months to
get the ball rolling, well after that few months Dan raises the price to
$11,000.00 and I agree to it just so I can get the ball rolling.  At this
point I ask him for a contract and he says he will mail it to me.  Well he
was working on another job and I did not hear from him for a month or two. Then
he contacted me sometime in the middle of June of 2014 and said he was almost
ready for us. In the midst of the phone conversation he tells me about how he
is not really making any money on the job (which was a total lie) and that he
wanted to know if it would be ok to get an extra 500.00 or else has going to
have to lose money on this job and try to make it up elsewhere.  I
explained to Dan that I also am a contractor and I know what it’s like not to
make money on a job, and if it meant I had to give him an another 500.00 to
make him happy and do a good job for me, that I have no problem with that (even
though at this point it’s really $1000.00 more than original).  I wanted
him to be happy doing the job and not hating coming there and rushing to do a
quick crappy job.  So at this point I ask
him to please get me a copy of a contract to look over, because I will not
allow him to start without a contract, it’s against New York State Business Law
for him to do so anyway.  So 2-3 weeks later on 7/8/14 Mr. [redacted] finally
sends me an emailed contract, (which I will attach to this to show what a
scammer he is), that states the price is now $12,000.00 but does not include
the front and side walls of my garage.  Really??? Just 2 weeks ago the
price was $11,500.00. Now the price has gone up $1500.00 and less work is
going to be performed????  This guy is ridiculous. This alone proves that
everything Mr. [redacted] is saying is utterly and completely false.  That’s
the thing about lying you can’t remember everything as if it were the truth.
 But electronic data never disappears.  So this proposal proves that
Mr. [redacted] jacked the price up an extra $1500.00 well before I even told him I
wanted to go with [redacted] siding.  
 Now the price is
already $12,000.00 and I cannot find a color that I like in the [redacted]
Monogram, so I start looking at other premium line siding panels and I find
that I really like a premium panel that [redacted] has.    I liked
the color of the [redacted] panel and decided I wanted to go with their premium
panel which is charter oak.   I expressed this to Mr. [redacted] and although
he told me how horrible the [redacted] company is, he said it should not be a
problem as both panels were premium panels and about the same price and he said
he could do the job for the ALREADY increased price of 12,000.00 But even after
we came to that agreement Mr. [redacted] kept trying to push this CRANE siding on
me, which is actually a lot cheaper of a siding. Now while all this was going
on Mr. [redacted] was in the middle of siding a house on [redacted] in Hamburg NY
just before he started my house. He was using this crane siding that was a
close color match to what I wanted, and I believe he had a lot of extra and was
trying to push it on me so that he could increase his profits even further
(even after he raised the price on me already by $1500.00.  I then came
home from work one day and I find that Mr. [redacted] had hung up 2 panels of the
cheaper Crane siding on my garage in one last attempt to try and get me to go
with it.   I did not like it and I told him I did not want it for like the
3rd time.  After this he told me [redacted] did not stock the material and he
has to order it so I said ok.
            Now when I gave Mr. [redacted] the job and I signed the
contract Mr. [redacted] told me that he doesn’t take any money from me until the
job is completely finished.  This was
another one of this bold face lies.  At
approx halfway through the job, I come home from working and Mr. [redacted] shows
up at my house demanding half of the money. 
I explained to him that I was not prepared to give him any money at this
time due to the fact that he told me nothing was owed until the job was
finished.  At this point the job was only
less than half finished.  So I told Mr.
[redacted] I would need some time to move funds around to get the money for him
even though I should not have had to give him anything.  He told me he needed to pay his material bill
which was a bold face lie, it was actually coming up on Labor Day weekend and
he needed money to go camping so he figured he would badger me for the
money.   So a couple of days go by and
Mr. [redacted] shows up at my house unannounced at various times of the evening
demanding money and getting belligerent. 
So I wrote him a check.  He asked
me to please not make it out to the company and to make it out to him personally.   I believe he wanted it made out personally
because he intends to defraud the IRS and withhold earnings from his tax return
claim.   At this point per New York State
business law Mr. [redacted] legally was suppose to take that money and put it into an
escrow account and provides me with the bank and account number holding the
funds.  Mr. [redacted] failed to do this, and
I intend on reporting these actions to the Attorney State Generals office for
review. 
            Now onto the marks on the siding and Mr. [redacted] bold
face lies about them:
            It is true that I did have soffit work to complete on the
back of the house and I was working on this in the evenings after work.  But at this point there was absolutely no
siding installed on the back of the house and a board was never ever dropped on
any siding.  No siding panels were
damaged by me.  The only siding panels
that were damaged were the ones that Mr. [redacted] and his crew damaged.  I will prove that Mr. [redacted] has lied
repeatedly in his response and his credibility is worthless.  And I trust that you will be able to
distinguish that the truth is what I’m telling you and the made up fairy tales
of Mr. [redacted].   So as the job neared the
end I noticed that there were black smudge marks all over the siding in various
spots.  These spots were not contained to
back of the house solely which disproves another one of Mr. [redacted] lies about
me making the marks while working on the soffit.  In fact the majority of the siding panels
that are damaged by Mr. [redacted]’ substandard cleaning practices are NOT even on
the rear of the house, they are on the sides of the garage (s) where there are
NO overhangs or soffits.  Mr. [redacted]
states that I got the marks on the siding due to working on rear soffits, well
if that’s the case then how did the marks that Mr. [redacted] cleaned get on the
Sides of the garage (S) where NO SOFFITS EXIST???  There are spots on the rear of the house that
Mr. [redacted] cleaned and ruined but majority is on the Sides of the attached
garage (s) 25 feet away from any soffits. 
Again this is the thing with lies there is always a truth to disprove
the lies no matter how good or made up they are.  Mr. [redacted] states another lie in his response
that they noticed the black marks on the siding, this is another bold face lie,
and I have a voice recording from a tape recorder in my pocket that will prove
that I told Mr. [redacted] about the marks and asked him to clean them.  He replied “we don’t clean siding” I then
told him that this is a brand new siding job and that I refuse to be left with
brand new siding that has black smudges all over it and that he needs to clean
them off.   The next day after Mr. [redacted]
cleaned the spots I noticed big faded bleached spots all over the side wall s
of the garage (again where there are no soffits and I performed no work).  I then went around the house and saw multiple
spots that were faded and or bleached and these spots are everywhere that Mr.
[redacted] cleaned.  They are in a rubbing
pattern. On this day Mr. [redacted] was suppose to come by and pick up final
payment, he wanted me to leave the check in the mailbox but I refused because I
wanted to show him the damaged he caused to the siding.  So around 6 or 7 pm Mr. [redacted] came to pick
up his check, I told him there was a problem and he didn’t even want to get out
of his truck and look at the issue.   At
this point I had a tape recorder in my pocket as I have in the past and Mr.
[redacted] states that he is not dealing with it and that he is going to contact
the manufacturer and let them warranty it.  I explained to Mr. [redacted] that warranties do
not apply to improper cleaning methods and destruction of material and, Mr.
[redacted] told “you don’t know that”   So
after this point Mr. [redacted] was suppose to get back in touch with me that
following Monday.  2 weeks went by and I
heard nothing from Mr. [redacted], I then contacted him and he told me that he
called [redacted] and that they told him sometimes a film or residue can form and
just to try and wipe it off.  Mr. [redacted]
told me to try and wipe it off, I told him no I’m not touching it because I’m
not going to let him try and say I touched it and made it worse and that’s
exactly what he wanted to try and pull. 
So I told him you come by and try and wipe it off.  This was around the end of august or early
October 2014 and that was the last time I heard anything from Mr. [redacted] until
May 2015 when I filed this compliant with the Revdex.com. 
            Now onto the gutter problem:
Mr. [redacted] states that
he informed me that I need a new roof and that there is no drip edge on the
house etc….
This house is a duplex
with an attached garage on each side (left and ride) and a 5’ roof over the
porch across the width of the front of the house.  The covered porch roof and both garages have
NEW roof shingles and drip edge installed within last 10 years.   The main house roof is older but not in need
of immediate replacement.    If Mr. [redacted]’s
theory was correct then the gutters attached to the garages and the front porch
roof would NOT be leaking behind the back wall of the gutter, only the main
house roof would be.  But the problem is
NOT the roof or the drip edge.  The
problem is the incorrect pitch of the gutters and starting height that they
started the gutters at.  The industry
standard for gutter pitch is .25” to .50” per 10’ of gutter.  This means that a 15’ gutter at the most should
have a pitch of .75” or 3/4'” drop.   The
gutters across my 14’ wide garage pitch is over 1.5” that is double the recommended
industry standard if not more.   The
problem is if a gutter has too much slope it will flood
the downspouts, and there's a very good chance that the gutter will overflow at
the low end. Overflowing can erode the foundation near the downspout and the
dramatic slope can take away from the architectural beauty of the roofline.  The other problem is that the starting edge
of the gutter was not installed up tight to the drip edge and was started to
far below the drip edge, and with overly excessive pitch that is on the gutter
the other end is way too far below the drip edge which defeats the whole reason
of having drip edge .   I had this
problem inspector by a very reputable company and that was their findings.
            And
lastly to address the notes that Mr. [redacted] provided in his response:
Yes I did indeed withhold $1500.00 from Mr. [redacted]
until the job was completed.  Mr. [redacted]
either messed up and forgot to re-install my homes Gables vents or he just flat
out tried to pull another scam and side over my homes ventilation system.  It is imperative that a home has adequate
ventilation for many many reasons.  There
are 2 types of home venting systems Gable vents which are on side peaks of
homes OR ridge vent which are at the roofs center point.   My home had Gable vents at the side wall
peaks.   These vents were removed and
framed in for new ones.  These vents need
to be installed at the same time siding is installed.  These vents are part of the siding job.   Dan [redacted], Myself, and my girlfriend [redacted] had a whole conversation about these vents at the time that Mr. [redacted]
originally quoted the job.  The conversation
was brief but included all the necessary details like color, shape, and
size.   So it was to my surprise when I
came home from work and saw that the vent hole that were already framed in were
sided over by Mr. [redacted] crew.  After I confronted
Mr. [redacted] about the issue he became very belligerent and defensive and started
saying that he wasn’t going to install them and that he never ordered them etc….  Then he had the nerve to ask me “well is it
written in the contract”???  Just for
example this would be like going to the automotive shop for new tires and the
shop installing the new tires but leaving all the lug nuts off and then telling
you well our price doesn’t include lug nuts being installed, Really???  The vents were pre existing and not a new
work installation, how do you remove an essential part of someone’s home and
not reinstall it?   I am an electrician
and this would be the same as you hiring me to do a panel change at your home
which is called a service upgrade and then installing everything except the
circuit breakers and leaving your home with no power because theres no breakers
installed.  And then tell you well even
though you hired me to change your electrical service from fuses to a circuit
breaker panel it doesn’t say ill install the circuit breakers! 
            Also
I never did say anything to Mr. [redacted] about bad mouthing me and vice versa
those were HIS words to me and I have a witness that can verify this as well as
a voice recording!
            And
lastly and this is totally irrelevant to the situation, yes I did bring a law
suit against a concrete contractor for not finishing the job but Mr. [redacted] is
incorrect and I did not lose.
            So
to sum up everything:
1) I have enclosed a copy of the original [redacted]
quote specifying the exact worked that Dan [redacted] performed, this [redacted] quote
proves [redacted] is lying about the prices he was gave.
2) I have enclosed Mr.
[redacted] quote from July 2014 showing that he jacked up the price well before I
decided to go with [redacted]. This proves he also lied about how the price
increase took place
3)
I have pictures of the damaged siding on the side walls of the garages that Mr.
[redacted] damaged.  This totally negates Mr.
[redacted] false accusations that I caused the black marks due to working on the
soffits (again there are no soffits on the side of the garage and o work was
performed there) yet [redacted] cleaned that section of siding due to his employees
causing the marks there.
4)
I can provide multiple voice recordings including one where [redacted] admits he
cleaned all these parts of the siding with an organic cleaner but doesn’t know
what happened or why.
5)
I can provide written statement from reputable company stating that gutters are
installed incorrectly
6)  And lastly the complaint about the damaged
siding does not matter who got the black marks on the siding.  In the court of laws eyes once Mr. [redacted]
took responsibility and cleaned it with improper cleaning methods, he took the
burden of liability for any damaged caused by those actions and methods of
cleaning.
