Review: Flooring work to be performed by Terminator Co was agreed upon for $41,250 to start on May [redacted] and a deposit of 14k was given. We rescheduled the work to May [redacted], 2013 which was agreeable with Terminator Co because other trades were still working in the area. Terminator Co did not show on the [redacted] because they forgot they don't work holidays, didn't show on the [redacted] because they had some type of truck issues, didn't show on the [redacted] inexplicably and then we cancelled the work and the Terminator Co would not return 7k of the deposit citing materials they purchased and could not return and would not support it with receipts or purchase orders.Desired Settlement: Refund of entire deposit

In reference to complaint [redacted], I am responding with the following facts per the Caro Properties project. The Terminator Company was In contract for over one month with Caro Properties, had ordered all of the materials and supplies, and then was notified by Caro that the job needed to be held off from the original start date of May [redacted]. The reason was given that they were not ready for us to begin. Caro then rescheduled the job with us to begin on Tuesday May [redacted] since Monday was a holiday.
Our company crew left to go to their job site on the [redacted] at approximately 11:30 in the morning.
We received a phone call from Caro properties informing us that the job site was still not ready for us to begin work due to construction delays. We were told that we would have to wait to begin work.
We contacted Caro on May [redacted] and told again that they are still delayed. On the following day they called to tell us that the job was cancelled due to financial and permit issues.
The Terminator Company is entitled to two weeks of down time profits lost on the project, including all time and materials. I was gracious to return $7,000 to Caro Properties, which their representative signed a final deposit return agreement when picking up the check.

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:
The Terminator Co. was not truthful in its response. The timeline of scheduled work as they state it is not accurate and while Caro properties acknowledges rescheduling the original start date based upon the site not being ready for the flooring it was Terminator who cancelled and/or no showed the next 2 reschedule dates and were cancelled on the third due in part to an inability to appear.
In addition Terminator Co. would not produce receipts for materials it says it purchased and could not return and did not provide those materials to Caro properties upon request and is claiming an excessive amount of 7k for "down time" as if the work crew did not deploy to another job site.
