We truly enjoyed working with the [redacted] and we feel bad that this project has ended asit has after the project was done. We know they were happy with the work onthat last day. Our guys worked very hard on their project. Sunrise pridesitself on charging only what was agreed. However in this case more...

was donethan was agreed at the outset; and we feel both homeowner and Sunrise shouldsplit the liability. We are already not making a profit on this job because ofthis incident as well as our subcontractor. We are not trying to profit from froman additional 900 sq ft of concrete poured. We are simply asking for thehomeowner to split the cost (at cost) since they are benefiting from theproduct installed and have counter offered $4,500.00 for the $9000.00 chargedon the additional 900 sq ft by the subcontractor to us the contractor formaterials only as a favor because of what occurred. At $14.00 s.f the priceagreed between Sunrise and the homeowner we should be charging (900X$14.00=$12,600.00)Ifthe homeowner agrees to the counter offer the material is paid for (at cost)and there is no profit to us; or the subcontractor; we both take the labor as aloss. The homeowner declined the counter offer and refuses to speak with us orallow us on the property to try to resolve the issue. The price quoted in item#2 is for 1000 sq ft. Anything in addition to that; when it states“approximately” is a change order. Product installed and unpaid for is subjectto lien. The reason the homeowner did not get a bill until after the finalpayment was made was; that …..when the subcontractor that poured the concretedropped off his bill (the following day) it was significantly larger than whatwe had charged the customer and it was made clear additional square footage hadbeen poured. Even though it is a trusted contractor we use regularily; to makesure... we (Sunrise) were billed accurately the project manager/Architect/Designerand the concrete contractor went out together to measure the area poured toconfirm before going to the homeowner and advising them of the additional charges. They both came up with 1900 sq ft. Verbage fromthe contract: Item #2. Form, pour, and stamp new patio area with 'Brickform'pattern (per customer selection). Sunrise will provide 2 colors (integral colorand color release) to attain agreed surface color rendition. Sunrise willprovide a surface sealer over the entire concrete pour (approx 1,000 s.f).Also, re-locate and re-pipe existing irrigation heads. Includes stamped borderedging detail per customers photo. $14,700.00.  Note thekeyword “approximately” meaning that, that cost covered a number close to1000sq ft. Not to exceed 1,000 s.f at least not by much. The circumstances surrounding this were a little more than just a contractormistake or error. During the pour onsite the crew lead moved the concrete formsper the homeowners request during an disagreement between the husband and wifeabout whether the area would be increased. Free form configuration was used. It is possible that during the disagreementbetween the husband and wife that more area was dug or that the forms were not movedback; but had the disagreement among the homeowners and indecision on theirpart not occurred this would not have happened. The crew lead nor the homeownercalled the project manager to be quoted additional costs. The project managertherefore did not know the incident had occurred to initiate a re-measure ordiscussion with the homeowner prior to the work being done or poured. This wasnot an ordinary concrete pour. It required specialized skills, decorativeconcrete, coloring, etc… This is an expensive product. Sunrise believes thereshould be an ethic shown on both side for the actual scope of work especiallywhen the product given was excellent. We hope the homeowner will be reasonableand agree to our counter offer. Thank youfor your time and attention,Sunrise Management.
