Smith Investments incorrectly charged me,never advised me of the charges,followed by filling a dispute through Equifax,resulting in a hit on my creditI checked my credit score on creditkarma.com last month and noticed a charge from Smith Investments for $410. I was never contacted or sent a bill, so I had no way of knowing I had any charges. I was never issued back my $250 that I paid before moving in. I have tried contacting Smith Villages several times, and they refuse to speak to me on the issue. I now live far enough that I cannot go there to speak to someone in person. Smith Investment has not only charged me for something that I have no idea what for, but also done so without notifying me or sending me a bill. As a result, I have unfairly taken a hit on my credit score through Equifax.Desired SettlementI ask that the $410 charge be removed and my credit score be correctly adjusted.Business Response [redacted]Move in date: 9/26/14Move out date: 9/30/2015Rents paid through 8/31/15September rental payments due + late fee for non payment $660.00 - deposit held $250.00 = amount due to [redacted] Investments [redacted] of $410.00. Billing package was returned to [redacted] by the USPS as Unable to Forward on 11/18/15.Upon receipt of a forwarding address the billing was repackaged and mailed to Mr. [redacted]. It is our hope this package will contain all the information Mr. [redacted] requires. He may call our office (XXX) XXX-XXXX and speak with a representative to make arrangements for payment where upon his credit history might be cleared.

(backup problem) I called the office Monday, Feb, 10, 2014. Nothing was done, and called again on February 11, 2014 and was told they would have someone out Thursday morning. An emergency maintenance call at 11:50 p.m. Thursday, February 13, 2014 morning around 3 a.m. The maintenance crew showed up. at 12:30 a.m. and worked until 1:30 a.m., and came back at 10:00 a.m. this morning. My apartment smells like raw sewage, the backup got under my kitchen cabinets, and carpet. I went to the office and asked if I could be moved to another apartment, and was told there are no vacancies. The office manager would not give me anyone's number other than the office to discuss this on-going problem. I would like to move to an apartment that the toilet did not stopped up, kitchen sink does not overflow with raw sewage, and be treated as a renter that needs help. I want to get out of this lease and my deposit returned to me. I feel as if management does not care that a person pays their rent, and have to live with raw sewage.Please call XXX-XXX-XXXX if you need more information.Business Response We are sorry for the tenants inconvenience and the slow response time to here maintenance issue, this is not the usual case for our complex concerning maintenance response times. As we we did not have a suitable and ready unit in which to immediately transfer the tenant, they gave a notice to vacate the premises. If the tenant leaves the unit in a suitable condition upon vacating they may be eligible for a refund of their deposit.

On September 26,2014 we went to the [redacted] Townhomes to sign our lease to move in and we had a walk through of the unit. On the same day, I saw a little dead brown bug and I told her that it looked like a roach and she said that it wasn't a roach. On that day my husband had some guys to move us in and we finally went back to the townhome on Sunday, 9/28/2014 so that we could start unpacking and when I went in the kitchen there were baby roaches in the kitchen and then went to the bedroom and found big roaches and also baby roaches crawling on the toilet seat. So on Monday morning, 9/29/2014 I went to the front office and spoke with the young lady and advised her that the unit had roaches and we couldn't live in a nasty environment and I wasn't unpacking any of my stuff. She told me that she would get back with me. They offered another unit but I didn't trust them nor their units because the lady that did the walk through had told me previously that the bugs were not roaches so at this point I didn't trust them at all. I asked for my money back and she told me that they would have to charge us for the time that our furniture was in the unit and I told her that I understood. I was also told that the refund would take 14 business days and we never received a refund. I contacted the office and was told that Payroll will be cutting checks on Friday so I asked her how will we receive the check and she advised me by mail or come by the office to pick up the check. I told her that we will pick the check up. She told me to come on Monday. When my husband went to pick up the check on Monday, they told him that the checks have not made it in. I called them and they told me the checks just made it in and she checked to see if our check was in the stack and it wasn't. She stated that it will take a little longer for our refund due to us leaving with a lease. [redacted](manager) told my husband that she didn't say we will get the refund but why would they have told us to come and pick up a check.Desired SettlementI need some of our money back because it's their fought they didn't tell us they had problems with roaches. Because when we were moving out the neighbor told my husband about the unit with the roach problemWe paid $1150.00 to get into the unit, $250.00 deposit, $300.00 first month rent and $600 for last month rent. I know they are going to charge for our furniture remaining in the unit but we had no choice because we had to pay someone to move it for us. We would like at least $850-$900.00 backBusiness Response A check in the amount of $950.00 dollars was mailed to the [redacted] on December 2nd, 2014.
