I am responding to a response from Atty Sheronda DDobsonIn the initial appointment with MsDobson I was fully ready to file bankruptcy, I gave her the total amount needed to fileShe later advised me I should not file until I was employed againAfter several surgeries and numerous therapy sessions I am back to workingBut I no longer need to file bankruptcyShe never disclosed there would be no refund for my full balance, neither did she disclose there would be an hourly fee for workIt was explained to me there was a set fee for filing and a set fee for her timeNow I am receiving documentation itemizing things that were never done because the bankruptcy was never filed
Also, she stated she never gave me a certain amount she would refund to me which is also falseIn previous conversations she stated she would refund me due to bankruptcy not being filedI fully think she should be held accountable for at least the if not payment in full due to misrepresentation

Please allow this letter to serve as my response to the above-referenced matter. [redacted] retained my legal services on March 4, 2011 for Chapter 7 Bankruptcy services. However, [redacted] voluntary held off the filing of his bankruptcy case and in the interim continued to refer his creditors to me for handling. It was not until May 15, 2014 that [redacted] informed me that he was not going forward with the bankruptcy filing because he received a monetary settlement to pay his creditors and that he wanted a refund of the monies paid to me. I explained to him that I would refund the $299.00 court filing fee and refund a portion of the $999.00 legal fee after I deducted for the work and time I spent on his bankruptcy file.
 
At the time of our conversation, I never told [redacted] the exact refund amount he would receive in legal fees because I needed time to review his file before doing so. However, I did share with him that I did speak with several of his creditors and prepared the bankruptcy petition skeleton. I then informed [redacted] that I would contact him once I had an opportunity to close out his file.
 
[redacted] was charged a non-refundable legal fee per the executed Legal Service Agreement dated March 4, 2011. (See attached Legal Service Agreement). However, because I did not file his bankruptcy case and attend the bankruptcy hearing, I only charged [redacted] for the time spent handling his bankruptcy file. I have provided a Statement of Itemization of the work performed and the costs accordingly, which information was placed in today’s outgoing mail to [redacted] (along with his refund check in the amount of $598.00).
 
It is my hope that [redacted] will be satisfied with his refund and this matter resolved. Should you have any questions, please do not hesitate to contact me.
