Initial Business Response / [redacted] (1000, 15, 2015/12/03) */ To Whom It May Concern, Mr [redacted] has used my company's services since for storageDuring this time period we have his vessel from our facility to the lake approximately times assisting him with both his boats at no expense during this time period we have not been the sole service provider on his vesselNumerous times his vessel had been moved by another marina service located in Kimberling CityIn fact the other marina service provider notified me in regards to the trailer being difficult to hook on to there transport vehicleWhen they notified me they were at my storage facility lot picking up Mr [redacted] trailerThey were taking the trailer with his boat loaded on it to their location for serviceMr [redacted] had notified me the day before he had decided to take his vessel homeHe also stated he wanted the other marina service to o through his trailer since it had not been serviced in a long time Mr [redacted] then contacted me via text message a few days later adivisng me he had significant damage to his trailer and wannted to know what I was going to do about itI advised him I would contact him the following week in regards to the damage, I was out of the state workingWhen I spoke with Mr [redacted] he was obviously irritated and wanted me to take responsibility for damagesWhen I asked him where the trailer was he notified me he had towed it from Kimberling City MO to his residence in Belleville ILI then explained to him that for me to do anything in regards to trailer I would like to have the opportunity to examine it (My company does in house trailer repairs.) Mr [redacted] then informed me there was no way he was going to let me get away with thisHe stated it was not over and that he could not imagine being such a sorry person as I amHe then went on to inform me he does not know how people like me sleep at night and hung up I am surprised based on his complaint that he would have risked hauling the vessel miles knowing there was significant damage to his trailerMr [redacted] owns a house locally, he also still had storage space leased till end of monthMr [redacted] chose to take the trailer miles then notify me he wanted me to pay for repairs and service Note that I have enclosed a copy of the lease that Mr [redacted] signedSection is the release of liability Please do not hesitate to contact me in regards to any further questions [redacted] J [redacted] Initial Consumer Rebuttal / [redacted] (3000, 17, 2015/12/10) */ In response to [redacted] 's comments provided on December 3,2015, the following response is provided: As he says, YLT did deliver my boat to my dock on multiple occasions during the period April thru Sep 2015; however, it was at not at "no expense" as he statesIt is part of the service he provides with the storage agreementMore than deliveries (splashes as he advertised) result in additional feesHe also states numerous times my vessel was moved by another marina serviceIn fact, [redacted] Marine retrieved my boat on only occasions during the period and the third time in September 30, to prepare it for transport back to my home in Illinois [redacted] Marine made no mention of trailer damage prior to the September pickup at which time they saw the significant damage which they took pictures and informed [redacted] of the damage [redacted] told them to have me contact them before leaving for Illinois I went tohe YLT office on the sme day to discuss the problemJamie [redacted] told me she know nothing of this situation and I would have to talk to [redacted] , who was in a meeting in Springfield, MoShe was not sure if he would be back today, tomorrow or whenIt was obvious [redacted] was avoiding this conversationShe advised she would have him call meHe did not call so I had no option but to leave for IllinoisMultiple attempts to contact him by phone over the next week were unsuccessfulI then sent [redacted] a text message indicating the extensive damage to the trailer and asked him to contact meHe did finally call in mid-OctoberHis recollection of the conversation is not the way it took placeHe identified hiimself and immediately said let's get to the pointI am no going to repair your trailerHe claimed my trailer was damaged when I first brought it to his facility and that he was no tin the business of repairing everyone's boat problemsHe now claims he might have been able to do something had I not removed the trailerI offered to have the removable front section of my trailer delivered to his shop for the repairHe said he was not going to do anything to repair my trailer [redacted] states in his response he was surprised I would risk hauling the vessel that distance when I still had leased storage till the end of the month or I could store it at my house on the lakeMy lease was up on September 30th, the day I had it removed by Premiere MarineMy house locally has no place for boat storage which is the reason I utilized YLT in the first place In response to section release of liability;when I signed the contract, [redacted] was touting his highly qualified and professional staff he had working for YLT and only these people would be handling my equipmentAs time evolved, his staff left his employ and was replaced by unqualified peopleI feel he had a legal duty (or at least an ethical duty)to inform me of this changeI did not say anything about him being a sorry personI did state that I don't know how he could sleep at night after not accepting the responsibility of repairing my trailerAlso, if I indeed did hang up on him, it was my mistake.I thought he had hung upmaybe he had not Final Business Response / [redacted] (4000, 21, 2015/12/21) */ I have turned this matter over to my legal conceal and the State's involved attorny general's officesI have also forwarded the Revdex.com's opinion and corospondences over to themI would inquire with your legal team about what role the Revdex.com and you, as their legal representative, wanted to have from this point forwardI am also requesting that you notify me in writing, mailed to my legal address, and in e-mail your opinion and any corospondences in regards to this matter from this point on, until all issue's and complaints that you and the Revdex.com chose to persue or involve yourself in, is resolved I appreciate the work and diligence you and your for profit organization does for consumer and purchasers [redacted] J [redacted]
