Mr [redacted] :My name is Brandon Hudson, CEO of SEVENSIXTEEN, LLCand I am reaching outto you today with regard to a complaint that Ms [redacted] has filed with your office.To provide a little background as to what we do, we design and manufactureaccessories for the Apple Watch, initially available on [redacted] (a widely-knowncrowdfunding platform) and on our website at [redacted] We initiallylaunched our first product, Click, a watchband adapter for the Apple Watch (whichMs [redacted] is referring to in his complaint) back in March of this year.Regarding his concerns about the delivery timeline, we have seen some delays withthe launch of our product, as many new companies seeWe have worked throughmany of those hurdles and are now in the process of fulfilling those items tocustomersIn addition to this, we have and will continue to post regular updates toour [redacted] project regarding the progress of production and fulfillmentIt isimportant to note that [redacted] is not a retail storefront; it is a means of fundingthe creation of an ideaWith this in mind, Ms [redacted] did not purchase these itemsin the traditional sense, where payment is received and the finished product isdispatched to fulfill an order (as with traditional retail or online storefronts)Ms[redacted] pledged $prior to the existence of our product to see that it isbrought to life from a set of ideas conveyed on the project page to a retail product,going through all of the hurdles of new product design, refinement, and production.As per [redacted] 's FAQ section regarding [redacted] Basics(https:// [redacted] It's not uncommon for things to take longer than expectedSometimes theexecution of the project proves more difficult than the creator had anticipatedIfa creator is making a good faith effort to complete their project and is transparentabout it, backers should do their best to be patient and understanding whiledemanding continued accountability from the creator.We have and will continue to meet these requirements.Regarding Ms [redacted] 's concerns of quality - though she has not yet received herorder, we launched an Adapter Replacement Program for customers who were notsatisfied with the adapters they receivedThis includes the full replacement andshipping expenses (free of charge) to any qualified customerThe specifics of thisprogram were published on [redacted] , our website, and social media onNovember 18,and can be seen at the following URL: [redacted] Regarding Ms [redacted] 's reference to refunds, [redacted] is an All-Or-Nothingcrowdfunding platform, meaning that customers (referred to as Backers per [redacted] 's documentation) pledge a dollar value for the reward items they wouldlike to receiveAt the time the campaign closes, if the pledged amount is higherthan the minimum we set, we are able to collect the funds and the project isconsidered a successFor our [redacted] campaign, we allowed a 30-day windowin which Backers could add, remove, and adjust their pledges until it closedOncethe project closes and is successfully funded, per [redacted] 's Terms of Service,that each Backer agrees to when backing the project, we may issue refunds, but arenot required to do so (https://www[redacted] ,com/terms-of-use?ref-footer):You can refund individual pledges if you wantAfter your project hasbeen funded, you can cancel and refund a backer's pledge at any time, if you do,you have no further obligation to that specific backer, and no agreement existsbetween you.Per this agreement, we are not issuing refunds to [redacted] backers, as the fundsgenerated from this campaign have been utilized to pay for the cost of tooling,production, and fulfillment, all of which began in August of this yearThis has alsobeen clearly conveyed to any Backer that has requested information regardingrefunds and we will continue to convey this message moving forward.In summary, our products are in the production and fulfillment stagesWe havebeen and will continue to post regular updates regarding the progress of productproduction and fulfillmentThough the product is delayed past when weanticipated its arrival to customers, this is not uncommon and we have addressedor are actively addressing hurdles along the way to insure that we are providing aquality product to all of our customersThough we do see a large number ofcustomer inquiries, we will continue to actively monitor and respond to customerneeds as required.With regard to Ms [redacted] 's claims of advertisement, we are shipping exactlywhat was advertised on our [redacted] campaign and what has continued to beadvertised to the public - an Apple Watch adapter allowing a customer to utilize astandard 22mm watch band (with spring or quick release bar) with his or her AppleWatchThough our product did evolve over the duration of the days ourcampaign was active (between the months of March and April, 2015), the basics ofour product have not changed since that time and all modifications during thatperiod were publically posted on our [redacted] campaign {in the Updates section)and were driven by public customer requests and inquiries to make the productbetter for all.Thank you for reaching out to me regarding this matter and if there are any furtherrequests or concerns, I ask that you please forward them to our legal team at theinformation below: [redacted] Managing Partner

To whom it may concern: Ms***s did in deed purchase a vehicle from us on or around July 19thThrough the verification process at our lending partners, some information on her credit application was unable to be verifiedThis conflict created a breach of contract and we the original terms of the deal were not able to be honoredMs***s did indeed bring the vehicle back, she was given other options to vehicles that would fit her budget with the verified information, which she declinedMs***s was given all of her down payment back, as well as reimbursement check for some money she spent on the vehicle for an oil change and detailShe was not reimbursed for her insurance as she also was not charged for any usage or miles put on the vehicleIf Ms***s will accept a more affordable vehicle in line with her verifiable income and credit profile we have options for her to resolve her transportation needs If you should need any additional information please feel free to reach out to me directlyThanks [redacted] Chief Operating Officer [redacted] ***

For your reference, details of the offer I reviewed appear below.The response sent by Sevensixteen does not address my primary concerns regarding my purchaseI am not satisfied with the quality of the adapters I have received, and the company's reference to their own Product Warranty terms does not address this pointThe method of determining any "defects in materials and workmanship" has not been mentionedIt is not clear at all if the company agrees with me that the design as shipped is defectiveUntil I know where the company stands on this issue, I cannot accept this responseFurthermore, the Warrant Terms claim that "To obtain warranty or exchange service the Adapter(s), with proof of purchase, should be sent, with an explanation of the problem and the desired resolution, postage prepaid"I do not accept that I have to pay for postage to return an item that is defective by design. With regards to the watch band that I received not matching the one that I ordered, I appreciate that the company is willing to send me the correct itemHowever, I am not satisfied with the company failing to provide a timeline for this replacement, or any mention of how I am to return the incorrect watch band to themIt is not clear to me that the company will pay for the shipping to return their incorrect band, or if I will be expected to pay for that as wellPart of my original complaint was that the company had not responded to my request for support when I had contacted them directlyThat complaint still standsThey mention that Sevensixteen will "assist" me in the exchange, but I have heard nothing from themI find this unacceptable.
