Review: Not even being sold the vehicle by an employee, and only driving the car a month after financing it,it break down on me three times, on three separate occasions. All because of the same issue,"the starter". Upon financing the vehicle, not only did it come with a two bald tires, a poor alignment job, oil leaking continuously, and white smoke (with no proof smog being passed), the car is by far a lemon. I broke down at a gas station, nicely enough a few people tried to help me to get it to start. One being a mechanic, said yet again it was my starter. So,a few people helped me push the car from the gas pump to a parking spot, where I would later get it towed. Calling the gas station later, the vehicle was gone. I filed a police report, thinking my vehicle was stolen, but some how the car ended up on the lot? The gentleman that answered the phone at S and J's told me the total cost, in order to pick up my vehicle was $449.93. Including my monthly payment of $150. I did not authorize a tow to my vehicle, parts to be ordered, and most definitely NOT to have any type of labor done on the vehicle. I feel, yes I am responsible for the monthly payment, but not the towing, the part or labor. There was no verbal communication that my vehicle was there, or verbal communication that work was being done on the vehicle (which verbal is hearsay, anyway). I most importantly had NO written statement saying I want this work done on MY VEHICLE! Like I said above, I DID NOT AUTHERIZE ANY TOW, PARTS ORDERED OR LABOR on the vehicle that me and me alone is financially responsible for. The disrespect of trying to continuously communicate with S&J Auto, and NEVER receiving a phone call back after several attempts, or being told I would get a phone call back and no one ever calling, basically getting the run around of; you need to talk to the mechanic, the front office, the owners wife, to finally the owner whom hung up on me. This is what I would call, a poor way to conducted business. I am flabbergasted!Desired Settlement: I feel I am NOT responsible for the tow, because I have AAA, the starter, (which they tossed) because I had already purchased three, and could of returned it, considering it has a life time guarantee, or the unauthorized labor done on my vehicle. My car was to be towed to my aunt's work, which is a real shop, Toyota and worked on. I refuse to pay for something I didn't authorize, and an explanation on who towed my car without me there? And who authorize work to be done? Because it was not me.

Ms. [redacted]

Re: [redacted]

In response to the complaint filed by Ms * let me first state to you that most of her

claims are false. She did purchase a vehicle from S&J Auto on 3/21/2014. She

came down to our lot with a boyfriend (**) of hers, who happens to be a friend of

ours as well. Ms * had NO money at the time to purchase a vehicle but wanted to

make payments. Since (**), who is a friend of ours vouched for her we agreed to

sell her the vehicle. She signed a Contract, a Buyer's Guide, an Agreement To

Furnish Insurance and A Contract Cancellation Agreement. The contract stated

she would make her payments starting on 4/2112014. Ms. * was a fust payment

default on this contract. The Buyers Guide stated the vehicle was sold As-Is. She

test drove the car and had no issues at the time of sale. The Contract Cancellation

Option was declined. The Agreement To Furnish Insurance stated Ms * would

supply full coverage Insurance on the vehicle of which she never complied.

Basically Ms. * had no intention of making the payments or insuring the vehicle as

she promised. We started calling Ms *, the day after she bought the car to get her

proof of insurance, but she avoided our daily calls. We called her on 4/21/2014 to

see if the payment was sent out. She did not respond or come by. On April 24,

2014 the vehicle was TOWED to our lot with Ms *'s original set of keys. She

called her boyfriend (**) that originally brought her to our lot, when she had an

issue with her car. Ms * gave him the keys to her car and asked him to tow it for her

because she had NO money. He then gave her a ride to the Beach because she did

not want to go home to her new boyfriend ([redacted]) who might see her with him. It

should be noted that the reason the car broke down was because Ms * had work

done to the vehicle and the wrong part was installed by whoever she chose to work

on the car.

On 4/26/2014 we received a call from her new boyfriend ([redacted]) wanting to know

how we got the car. It should be noted that in Ms *'s complaint with the Revdex.com, she

wrote, " I filed a police report, thinking my vehicle was stolen" yet, she told her

oyfriend to call us, because she knew exactly who had the car and exactly how it

got here but she did not want her new boyfriend ([redacted]) to know, so she lied to him.

We did not want to get involved and we told him we could not discuss her account

with him. There was no police report filed because if there had been we would have

received a call since we are listed as the legal owner. Ms * handed the car and the

keys to boyfriend (**) and asked him to take it and get it fixed for her. Boyfriend

(**) had it towed back to us and asked us to look at it and repair if possible, stating

she would pay for repairs. If she filed a police report I would like the report number

as she filed a false police report and both myself and boyfriend (**) will testify to

this.

From the date of sale 3/21/2014 to 4/26/2014 we NEVER received one phone call

from Ms *, she drove the car uninsured which is against the law, she missed her

first payment and she had not once called to say she had any problems or issues

with the car.

We have spoken to Ms * on several occasions, after she gave the keys to boyfriend

(**) and had it delivered to our lot and we have asked her for proof that she in fact

put a starter in the car because the starter that was in the car when it was delivered to

us, was the wrong starter, she obviously had someone install an incorrect starter in

the car but whoever put that starter in the vehicle is the responsible party for the car

breaking down on her. The mechanic she supposedly paid the $300 to is at fault for

putting in the wrong part or if she purchased the part on her own she herself bought

the wrong part and had it put in by an inexperienced mechanic. Ms * claims also

that we "threw away" the starter she had put in the car but if she had actually

pu**hased a starter from an auto parts store she would know that they take the old

starter as a core. To this day we have not received any proof of who did the work or

where the part was purchased from.

Ms * also filed a complaint with the BAR stating the vehicle was not smogged, this

again is her trying to smear my reputation. The vehicle was smogged on 2/6/2014,

two months before she bought the car. This claim was deemed unsubstantiated by

the BAR.

We spoke to Ms * on several occasions, after she had car towed to us, giving her

the opportunity to make her payment and show us proof of insurance. She never

offered to make her payment that was PAST DUE, nor did she supply us with proof

of insurance. We then told her we were going to repossess the vehicle as she had

defaulted and had no source of income or money to pay and was driving without

insurance which was required by the State of California and the legal owner. On

May 10,2014 Ms * came into S&J Auto and decided to do a voluntary

repossession. Ms * agreed to come in and sign the paperwork if we would not

report the repossession to the credit reporting agencies. She came in and signed

the documents and we agreed to not report this to the credit reporting agencies. At

that time we told her to bring in the receipt for the repairs and we would call the

auto parts store to see about getting a refund for her since the part was incorrect. Ms

B has never called back since 5/10/2014 when she signed the vehicle back over to

us nor has she done anything other than try to ruin my reputation.

Let it also be known that I am the owner of S&J Auto and I personally have never

spoken to her. She has done nothing but slander my business when in fact she is the

one that did not follow through on any of her promises or contractual obligations.

Ms. * took a car and drove it for a month without paying a single penny to me.

I have documents and witnesses to all that I have stated.

If you need anything else or have any questions please let me know.

Thank you,

Owner
