Company states: The gentlemen had parked at the Brookefield visitor parkingI informed him of this when he came to get his vehicle backWhen I told him he had to pay for thatThey are given HOA rulesWe are given a copy as well so we know it as well

Neither Wildwood HOA or Brookfield HOA had informed the residents of the change of the towing company beginning in April The residents were not notified that the parking area now marked Brookfield HOA would no longer be available to Wildwood residents or guestsThis parking area is close to three Wildwood buildings, none of the residents I spoke with were aware that Wildwood residents or guests were not allowed to park thereThis has resulted in many cars being towed in the middle of the night between 10pm and 2am by the new Predatory style towing company when someone mistakenly parks in the wrong areaThis is obvious extortion, cost to get my car back was $This was a hardship to me because I am a retired person on a fixed income, it took two credit cards and some cash to get my car backThe two HOA's have created a hostile, unfriendly and un secure living environment for the residents and their guests in a place that they pay to call their homeSome have said that they wished they had not moved here after going out in the middle of the night to have a confrontation with the towing man who was attempting to tow their car

Thank you for the call so that we could handle this matter. First thing I would like to point out...

that we are not a predatory tow company. We were hired by the HOA to enforce the parking rules and regulations, each tenant or owner whom lives in the HOA is given a policy and rule book for living there once they have moved in. For the tenants/ owners to have the proper parking passes they need to go to the main office at the HOA and they will enroll their vehicles into a system called Parking Boss which allows us to see if the permit is good or if there is any discrepancies with the vehicle. Also it is posted rather clearly that no tenant is allowed to park in visitor parking. Please see the attachments, it will show you rather clearly as to why this resident was towed on a repeated basis.

I am rejecting this response because: This company is stating that the Hoa has rules and regulations, the problem is they are not following the rules that are set forth in the Hoa and the California Vehicle Code 22658 that before a car can be towed it needs to have been given a 96 he warning and the owner of the vehicle needs to be contacted before and after the tow takes place.  Also I purchased from the Hoa the proper parking pass and it was displayed when my car was illegally towed all three times, thus company is not following California Vehicle Code guidelines or the Hoa towing rules and they know it!

Review: This company has illegally towed my car 3 times in a month, the owner has stressed me and has charged me excessive amounts of money to get my car back! This company is a predator towing company that preys on low income associations and complexes, this company should not be allowed to operate!Desired Settlement: I would like my car back and for this company to stop illegally towing my vehicle and other vehicles in my area!
