To whom this may concern regarding complaint # [redacted] Proscapes signed a contract on April and received a deposit for the project of $1,We began this project upon HOA approval and scheduling on June 3rd Once project began at [redacted] residence June 3, We collected the first installment after being on project a few days as materials had been ordered and delivered work was in progressHomeowner had over months with possession of our contract and design, to make any changes or revisions with NO additional chargesHomeowner also had time to hire their plumber to install gas lines for the landscape project where ever they needed to get the gas stub from!! We mentioned that we have had clients in the past stub gas from an existing locations for gas line at their discretion, and mentioned this to the [redacted] (That is why per our contract homeowner is to hire their own plumber for the gas line)It was specified in our contract and verbally explained to the homeowners to hire their own plumber! One of our walk trough’s we discussed different options for the gas lines as (Y Moothart) was overwhelmed with the expense to run the gas lines for her future fire pit and fireplaceWe mentioned we could saw cut / trench and to have the gas line ran from the main but homeowner did not want additional fees to run the gas lineAfter this meeting they decided to cancel out the fire pit and seating bench that was designed and was part of the original contractDuring this time 98% of demo was complete/ drainage started /trenching for gas line and framing had begunWith this also being said they wanted all hardscape to be installed 1-2’ to property line which meant of re framing and moving all forms againBecause they were canceling the fire pit and seat bench they wanted us to redo a full contractWe explained that we will provide an addendum to the contract along with new payment plan to reflect new designWe provided them the credit along the new charges of additional hardscape needed and the change order fees for the canceling of the itemsWe have in our contract that each change order has a fee of $that goes towards admen work and labor The homeowner got extremely upset and told us to get off the property that they are canceling the projectWe have tried to contact them via email and phone to try to discuss the project with themWe have always been willing and able to complete the project we beganWe have never had this happen to us in all the years we have been in business to be kicked off a projectThe homeowner has not responded to us and has not given us an opportunity to try to work this outThey have approached the Revdex.com and now the bond that we have with our contractor’s licenseThe homeowners I believe did not have the money to do their project and now I am the one paying for thisI have a business to run and have tried to work with the [redacted] they have not responded or given us an opportunity even though they are a breach of contract We have NEVER abandoned the project like the homeowner has saidWe have tried to explain that we have purchased materials / provided labor, (over hours) and this is not including for the deliveries of materials and Project managers time on the jobsiteWe again are willing and able to move forward with them to get their project completeUp to this date I still do not understand the reason for them to cancelWhich leads me to believe it was a financial burden on the [redacted] !! To Whom it may concern at Revdex.com We have tried to reach out numerous times to the homeowners to try to work this outThe homeowner has not allowed us go back to the project and perform the work that we had an agreement to do Homeowner is not satisfied with the options our company has providedThey have now hired another company to come in to perform the work that we were originally hired to doThey forgot to mention that the contractor that they had hired before our company to do the 1st phase of their project was not asked to complete the 2nd phase since they had a fall out with that landscape contractor also We have always been willing and able to come in and complete our work that they hired us to doWe have put out our hand to compromise with the client several times with little to no responseWe are here to provide help and guidance to the homeowners to make sure things are completed correctlyWe never walked away from their projectWe have never ever abandoned any projects in all the years we have been in business! The clients are in BREACH of their contract and we had no other choice but to leave it up to a judge to decide this situation as they have been difficult to work with We take pride in our business and our name! Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below Regards, [redacted] Proscapes made promises from original plan that they couldn't keep as far as running gas lines to the outdoor chimney and fire pitContrary to what Proscapes claims we did have their suggested contract plumber come to job siteThe company said it was unable to perform work based on safety concernsBased on these evaluations we simply requested reduction of scope of work and continue with other hard scape workIn addition, when they finally did begin work the minimal framing they began was not consistent with what their original plans called for.Based on what we had experienced, the confidence level of Proscapes doing the job correctly, the owners attitude and the way we were treated we made decision to terminate business with them.Proscaped claims they they believe that this project was a financial burden to our familyAgain this is untrue as we have hired another company to start from scratch to do this job correctlyWork begins in weeks.We have yet to hear from Proscapes about refunding a portion of the $13k they have been paid.In addition we have contacted the Bond Company that represents ProscapesWe have provided documentation, photos and the new contract from the newly hired Landscape CompanyThey have mentioned that Proscapes has broken the law for collecting more than 10% deposit of the entire $40k contractThe Bond Company has told us that they have tried contacting Proscapes several times to try and get them to reimburse our family the money for work not performedThey are trying to keep this from going to mediation.As of this date we have yet to be offered reimbursement for work not done Sincerely, [redacted]
