amount and date as transacted. All incoming and outgoing calls are recorded by our company for the purpose of protecting the consumer and our company. In this case all the allegations by the consumer are completely wrong. I personally pulled the recordings on the alleged " fraudulent " action account. The recording are clear that the husband gave permission to use the credit card for the exact amount that was charged for the exact date that it was ran. The allegation that the consumer did not give out bank account information is completely not true. We record the information as well. The consumer has used two different cards in the past to make payments on delinquent collection accounts assigned to our company. The management staff is available to resolve any problem during business ours. The consumer has dealt with our company on numerous accounts and knows that we are not a fraud. This seems to be a term used very freely these days when a consumer thinks that they can make a " big enough complaint / blow smoke " until someone will make the delinquent debt go away without them paying it. There was an attempt to contact the consumer with no answer after researching her allegations from her telephone call on the day in question. I suggest that the consumer set up a consistent payment plan and use the same card for each transaction. The consumer should also consider that making payments or having a payment plan is only honored by our company if there is enough updated financial information to justify a reason for an extended payment period. If the payment is not made on the agreed due date then the plan is cancelled and the payment in full is due. On this consumer's delinquent accounts there is no information that shows that a payment plan is needed to resolve the account. We are available at all times to work with a consumer to resolve collection accounts.

The consumer was contacted by our office. We do not set up payment arrangements on the first contact without updating full financial information to justify an arrangement. are required by law to send one initial letter to the consumer containing a validation of debt. This was done prior to speaking to the consumer. The consumer was not told that she was being sued. She did insist to be advised on what " further action " could be taken against her. She was advised that " if " our client so chooses they can proceed with the process of suing the account. This is a far cry from saying " you are going to be sued ". The consumer was asked about using her tax refund to satisfy the outstanding debt. This is a common money source for paying delinquent accounts. The consumer has come to our office since filing this complaint. She has made a payment and received documentation on the accounts that are owed.It should be noted that this consumer had over two years to pay this on an arrangement basis with our client. If she would have responded to the statements requesting a call back and offering payment solutions from our client the accounts would have never reached the stage of being referred over to a collection agency.
