This is in response to Revdex.com case # [redacted] The complaint seems to be against Chhokar Clinic and NOT Professional Collection Service However, as a Business Associate (BA) of the Covered Entity (CE) Chhokar Clinic, we are entitled to have access to Protected Health Information (PHI) as defined in C.F.R§ on behalf o the CE pursuant to the Health Insurance Portability and Accountability Act (HIPAA) The HIPAA Privacy Rule states that a CE does not need to obtain a patient's consent to use or disclose protected health information to carry out treatment, payment or health care activities According to the regulations , the term "payment" includes billing, collection activities, and disclosure to consumer reporting agencies (Credit Bureau) of any protected health information relating to collection of premiums or reimbursementTherefore, no HIPAA rules have been violated Further more, we are not required to have a contract with the consumer in order to pursue collections of an unpaid debt on behalf of our clientThis complaint is totally without merits because no laws have been broken and no violations have occurred

defined in 45 C.F.R. § 160.103 on behalf o the CE pursuant to the Health Insurance Portability and Accountability Act (HIPAA). The HIPAA Privacy Rule states that a CE does not need to obtain a patient's consent to use or disclose protected health information to carry out treatment, payment or health care activities.
According to the regulations , the term "payment" includes billing, collection activities, and disclosure to consumer reporting agencies (Credit Bureau) of any protected health information relating to collection of premiums or reimbursement.
Therefore, no HIPAA rules have been violated. Further more, we are not required to have a contract with the consumer in order to pursue collections of an unpaid debt on behalf of our client.
This complaint is totally without merits because no laws have been broken and no violations have occurred.
