There was a contract for drainage project. They did some extra work as well on property and billed separate. The first issue logs were buried and excavated material put on top that stated in contract not to do and now the are coming out of ground creating hazzard. The also on a separate bill charged me a total 680 plus tax for grass seeding on the front pond that was never done at all and is all weeds now. This is on top of the 1350 I paid for seeding the back pond that was done but approx 20% needs reseeded. There was also a 600 charge for stone on my bill for front pond that should have been in the other drainage project bill. The only charge I should have on my second bill is for excavator and dozer as they dug an extra pond not included in the drainage project. After several attempts trying to get problem fixed it is now all weeds and impossible to seed it now the way it is. If pictures are needed I have as well as invoices for work paid for.
Finish the job They either now need to come in and spray weeds and than seed the grass seed that was paid for. As well the logs that are protruding out of ground that were buried during excavation that clearly stated it was not to be done in contract need to be removed and soil leveled and seemed as well or compensated for this breach of contract as well.
Regarding the case, my response is below.
There was in deed a contract with the municipality for this project at which we did extra work for the client mentioned here after the completion of the contractual portion. I have had several conversations with this individual and at no point did I say that we would not be returning to do the work. As of today there is still nearly a quarter of a year for the warranty. We will be going back to do this work however this person is not our only client and we are extremely busy. Regardless, the work will get done, I am just disappointed on how this was handled altogether. I have had conversations with the municipality and the engineer and they all have attested that this individual was quite hard to deal with. During our email correspondence and phone conversations he constantly tried to explain the monetary conflicts he was having however they are not our issues as we are merely the contractors and if he wasn't being assessed properly he was to take it up with the municipality or the conservation authority for that matter. It sounds like there was some confusion amongst the parties involved in which he feels wasn't fair and I feel/felt for him. He even appreciated that I had taken the time to here him out. I actually tried to help him out and give him advice. There is no denying that there may be some logs sticking up and there are weeds now where the grass will ultimately be but bottom line we are going back to do what I told him we were going to do back in January of this year. I have already reached out to him again and would like to mobilize and get it done the week of June 11, 2018.

They are correct that extra work was performed. Unfortunately the approval for this did not come from me. When I paid the first bill was told by township this was full for entire project or I would have questions cost than before I paid and than a month later received another bill. I do question that for the back pond cost was 5000 but the front charged to me half the size was more. As well since the front pond was ultimately charged to me separately I question why there is over 600for grass seed on my bill and 300for rock where that should have been put on other bill that was paid by all land owners. Even part of pond excavation should been charged to everyone as it needed to be dug even if pond not dug. I don't understand how I get charged for grass seed when it wasn't even discussed. I just assumed the seed cost was for at back that everything was on this one bill. As well for the one year guarantee to do the work. Since this is a separate charge and bill for me this work was never performed. It is now all weeds. I don't understand how they can come a year later throw some seed on it that won't grow now and say your warranty period is up now. There should be one you warranty after the work is performed so when it don't grow they will fix. My preference to this is to have my money refunded for seed and rock that never ok'd to begin with and be done with it and do myself. There is no way grass will grow there now till the weeds are sprayed and killed first. Coming in throwing bit seed around now and saying year is up is not a sufficient fix to something that should have been done last year when it won't properly grow now. If they still wish to do and not refund money the weeds need to be sprayed than when dead seeded and a warranty period after that that it grows sufficiently.
As far as being difficult when I was accessed 4400 and you get a bill for 6600 and the township tells you that is full amount and a month later after you pay that you get a 4400 bill so my accessed charges goes from 4400to 11000 it is a bit upsetting just because of a small extra pond that was dug that I did not give approval for and no explanation of additional charges except 16 hours for excavator and 12 hours for a dozer is a bit much for the work that was performed. My point all along and being difficult is that some of those charges should have been on other bill that was charged to all landowners.
We can close this as we came to a satisfactory agreement with each other.
