The assertions made by MrB*** are simply not trueMrB*** came on board as a licensee and SMS Masterminds provided the deliverables and training described within his contractMrB*** had a change of heart and decided he didn't want to move forward with his license, but there is no refund
provision in the contract that he signed and agreed toAs you can see by the below attachments, we delivered what was contractually obligated and even attempted to resolve the issues MrB*** described, however he was not interested in engaging with us to do so. - Engage License (The contract he original signs which outlines our deliverables) - B*** Communication History (Outlines all of our communication and efforts to get his website live and assist him through training) - Training Log (A log showing the records of Jason's activity in our online training platform)

I am rejecting this response because:According to the documents attached, the conditions and dates of my agreement with SMS were very clearMy agreement started as a refundable deposit agreement, and that was always how I was approached and how the conditions were set, whether that is the norm for company or not, that was never communicated to me.My refundable deposit agreement states that if I made a decision by the 30th of June I was going to be refunded the 5,dollarsBy the 19th of June I had already signed my release of contract (as attached) and the document clearly states that I would be refunded within 7-days of the received document.I refuse this response because I have been patiently waiting for the refund for the last months and just like every other email SMS has sent me, they say the will pay but not this month and that it is under review, yet againThat goes completely against everything that I was informed of by them, all the papers I have signed and emails and phone calls we had exchangedI honored my part of the contract and I am tired of excuses!

I am rejecting this response because:This company is predatory, they will make it appear that this is a lucrative and innovative business model, and their guarantee is virtually non existentThey will assist you as long as they need to fulfill their guaranteeThey will use any means necessary to do soI did contact them days prior to the guarantee fulfillment to request a refundAt the time I had businesses, they quickly added one in my area, then placed two under me from other failed licensees in other states7/26/I was at an airport flying out of the country and they jeopardized our ability to fund a funeral if I didn’t sign the guaranteeThe technology is not new, nor innovative, it was very problematic for my merchants which is why they discontinuedThey weren’t signing people up because it’s place in the business transaction is out of placePeople don’t want to enter their numbers, or they simply forget, and merchants and employees don’t want another task to doThe only ones who win are the Masterminds who make their money off of you. As Stated By the Business. I’m reaching out today to respond to the complaint from the Customer, dated 10/19/Per our contract with the Customer’s, we are confident that we’ve delivered everything that we said we would and provided access to training, software licensing and ongoing
support per the terms of that agreementWe do not make any specific claims within our agreement as to what business outcomes a user of our software and services might expectThat being said, we have agreed to grant the Customer’s request to be released from their contract and be absolved of the additional debts that they owe to our company, which is currently in excess of $20,I spoke with the Customer’s today, and let her know that I would be sending a cancellation agreement within the new few days, which once she signs, will release her from her contractual obligation to our company and the past due funds currently owed. I am rejecting this response because:merchants cancelled because they didn’t like the software, would forget to sign customers up, and didn’t feel it was worth the moneyOne canceled because his parent company offered a similar technology for freeOne canceled because he was told by Masterminds he’d have to sign up before I’d even speak to him about the software, decided he didn’t like it after all then canceledOne canceled because he was already being serviced by a previous licensee with Masterminds whose business with them also failed, so he and a group of other former Masterminds licensees started their own software company and kept their clienteleHe also stated Masterminds fees were too highMasterminds was aware that there was a group of failed licensees in my area and led me to believe they were active and in territories adjacent mineThey had tried this same scheme here several times and it had not been successful.

The customer provided a deposit for a license that he ultimately decided not to move forward on. It's not our typical policy to allow for a refundable deposit, but allowed it in this case. We fully intend on refunding the customer's deposit, but cannot do so until the outside funding we're expecting...
is available. We technically do not have a required date to provide this refund by, but will do our best to provide it as soon as possible.
Our company has a strong record of providing excellent customer support and training. All requirements of the agreement were fulfilled, and beyond that, there was nothing stopping Mr. B[redacted] from reaching out for any additional help, training, or assistance he may have needed. If you were to ask any of our existing licensees, they would tell you that we place no limits on the amount of support and training that we will provide, but beyond our standard training package, a licensee would need to reach out and ask for help.It seems clear based on the fact that he went through all the initial training and was worked with to get his site live, that Mr. B[redacted] changed his mind with regard to moving forward with the license and would like a refund due to that change of heart. Unfortunately, we have already invested in living his site, supporting and training him. We cannot take responsibility or financial liability for his decision not to move forward.

I am rejecting this response because: The company is going to say whatever they need to say to make sure they don't have to refund my money. I did not "decide" not to follow through, the company decided for me. They didn't provide the training they promised for "me to be successful". I'm not sure why this is so difficult to understand. The packages usually cost over $30,000 and they offered a special deal to a few people of this lower price. I think they felt as though since my franchise package was a cheaper price, they didn't have to offer the same training. That is exactly what happened. I spoke to a few "mentors" in the company that are supposed to assist in training and they were shocked that the company wasn't offering me the same training that they received. Even current franchisees thought my training was a joke. The training was bare bones and then non-existant. Please refund the money and we can move on.

Our assertions are not "Fake" as K[redacted] states in his response. We are a professional organization with hundreds of clients. We are audited as a public company and do our best to provide the best quality of service to our clients. K[redacted] is incorrect in his assertion that SMS Masterminds owned "GoAustinVIP" as a franchise. SMS Masterminds does not own any of it's licensed territories. We did introduce K[redacted] and Jym Daniels and charged OUR license fee, but did not own the business or territory ourselves. We simply provided him with the ongoing service and support as is required by our terms of service within our support agreement.I understand that K[redacted] is asking for a refund and maybe has determined that he regrets licensing our software to build his business, but we have not breached any of our agreements with him and feel as though we've done as best we can to provide him with a graceful exit out of the business. It's unfortunate that the sale of his business did not move forward, but selling his business was not something that we were responsible for and therefore cannot accept liability related to that transaction.SMS Masterminds was under no obligation to provide a discounted license fee, even while K[redacted] was attempting to sell his business, but we offered this accommodation in good faith in order to assist K[redacted].SMS Masterminds has many positive reviews and hundreds of happy customers. We cannot offer K[redacted] a refund as we have not breached any agreement that he had with our organization and in fact went above and beyond to provide service and support that was well in addition to the deliverables that are promised within our support agreement.

I am rejecting this response because:Unfortunately a large company can easily say they provided something when they did not. I was promised phone calls and training and it did not happen. The company can say that they provided this all day long. The truth is they DID NOT. There is no proof that they provided this training. A few videos online of two guys talking is NOT training. I have spoken with numerous other people who were screwed out of their money by this company. Many of them lost over $30,000. The company tried this same route with them. I am not falling for it. They decide to help a few people and then throw the others away. They were more than happy to do everything to get my money, then all of sudden they didn't want to assist me like they promised. Please provide a refund and we can close this matter.

The assertions made by Kris in his complaint are not accurate. Kris purchased his license from an existing SMS Masterminds client (Jym Daniels), not SMS Masterminds directly. Any representations made by that client apart from our service level agreement/contract with us are outside of our control....
(See attached license agreement).Regarding support, SMS Masterminds delivered on all aspects of our contract and has gone above and beyond to provide accommodations for Kris, as evidenced by the 2 attached hardship agreements, wherein we offered a discounted monthly license fee for a period of time on two separate occasions.When Kris was attempting to resell his license/territory, he decided to market it at a price higher than SMS Masterminds' retail rate. When the prospective buyer found that out through a standard due diligence process, he backed out of the deal. This was not SMS Masterminds' responsibility or liability. Additionally, assistance in reselling a client territory is not something that is included as requirement of our contract with Kris. It was done as a courtesy and is yet another example of how SMS Masterminds' went above and beyond to try and assist Kris.Lastly, SMS Masterminds did honor Kris' request to terminate when it was received in writing. In summary, SMS Masterminds' has in no way breached its agreement with Kris and has actually gone above and beyond to support Kris in his efforts.

December 2016 from S[redacted], a salesperson for the company who simply pursued his due diligence as part of his job requirements. All business prospects either make a choice to purchase or not purchase. A[redacted] elected to purchase the standard licensee of her own free will. On February 8th, 2017, A[redacted] voluntarily elected to purchase an upgrade to the licensee which would refund her money if she did not have 10 merchant accounts or $3000 in one month’s revenue after 180 days. How A[redacted] elected to fund her purchase decisions, are ultimately her decisions. Also, the success of a licensee/business owner is a direct correlation to their efforts, skill sets, and time commitment they can give to business. Due to extenuating circumstances out of our control, A[redacted]’s personal and family issues prevented her from committing to business development. As a result, SMS Masterminds went above and beyond to fulfill our end of the agreement by having supplied 10 paying accounts by 7/25/17, within the 180 day time frame. A[redacted] acknowledged, accepted, and signed off on this on 7/26/17. There is nothing in our agreement that states paying accounts have to be within a licensee’s territory, and A[redacted] did not have any objections at the time as she signed off on the fulfillment of the deal. The $1000 monthly fee was due regardless of the fulfillment of the 10 accounts per terms of her original contract. SMS Masterminds actually extended a special courtesy to A[redacted] by pushing fees back an additional month due to the personal issues she was experiencing at the time. SMS Masterminds had no obligation to do so, but continued to try to assist A[redacted] throughout the entire relationship. To further illustrate this, Richard Delsi was not her Mentor, but the licensee development and training lead, who had numerous calls and countless email interactions to help get her started. The SMS Masterminds Support Team has well over 100 tickets and interactions with A[redacted] on file, assisting her with every question and request along the way. SMS Masterminds also assigned an Account Manager, Kenny Selke, to assist her with any need and secure her initial 10 accounts to help get her started and be able to cover her monthly licensee fees as explained above. Any accounts, or business lost by A[redacted], were a direct result of her not being able to manage, service, or maintain her accounts due to her personal situation and availability. SMS Masterminds has no responsibility for the management of accounts provided. That is the business owner’s responsibility per terms of the business model. Every account that was provided has a record of pre-existing credit card charges to an existing business that cannot be fabricated. SMS Masterminds has no way of forcing anyone to sign anything. A[redacted] stopped any efforts on her part, to which SMS Masterminds could not assist after fulfilling their end of the agreement. Still, SMS Masterminds went beyond obligation to not only push back the start of her fees, but then extended a 50% reduction in fees in consideration of her situation and struggles. SMS masterminds was not obligated to do this either, but did. Also, with her attempts to contact Rob Barber, he spoke with her on several occasions making special considerations to her circumstances. A[redacted] clearly had a way and means of contacting Rob Barber, but he never received any messages as she claimed. He heard from others that she was trying to contact him and he reached out via email and phone calls on numerous occasions and was never able to get a response from her. SMS Masterminds has documentation to support all of this. A[redacted] finally responded to Rob Barber’s outreach efforts on 12/14/17 and said she wanted out. Per terms of her contract, A[redacted] was required to provide 30-day written notice to cancel her contract. 12/14/17 was the first request SMS Masterminds received, and made another special consideration to let her out then and there without any further obligation. No additional attempts to charge her monthly fees were made once she provided any kind of request to cancel. Prior conversations were simply saying she couldn’t pay and SMS Masterminds was constantly attempting to work with her and make special arrangements. In summary, A[redacted] voluntarily purchased a license from SMS Masterminds. SMS Masterminds provided all contractual obligations, and fulfilled the requisite 10 accounts which A[redacted] agreed to and signed off on. SMS Masterminds made several special considerations for A[redacted] under no obligation, by pushing back the start of license fees, reducing the cost of license fees for an extended period of time, and accepting a cancellation request without proper notice. A[redacted] stopped working the business due to personal issues. A[redacted] was unresponsive to outreach efforts to try to assist her further. A[redacted] failed to appropriately manage, and be accessible to the businesses provided, which resulted in her losing accounts. SMS Masterminds made every effort to help A[redacted] be successful, but an inability to dedicate the required time and effort to successfully run a new business, along with A[redacted]’s personal circumstances, is the cause of A[redacted]’s lack of success, not the practices of SMS Masterminds.

I am rejecting this response because:There might be lot of customers who may be happy, as I don't know about them, it can be true or a lie. There might be also customers who will be unhappy, and I'm one of themYes the company (Sales Agent) faked by showing wrong numbers. Now they are defending themselves which is not fair as well. I have no dealing with J[redacted], SMS Masterminds talked with Jym & gave me the price. Later SMS masterminds processed the paperwork. I did not receive any proper help from them. As per the company, when mentor comes they will get me at least 12-18 merchants. But that did not happen. Why?If they are not owners, why did they charge $19000 money from me?So I'm requesting this:1) Either give my money back, or 2) get me 10 merchants as per sales agent which covers up the licensee fee or 3)sell my business for a reasonable price without charging me any fee each month (you can take the merchant fee after the charges if you want)
