I did contact BMB septic and was informed that there was no consultation or $consultation fee and that all communications were over the phoneI would like to be provided with receipts or invoices for all the supposed services performed, at this point in time it has been over days since requesting a return of deposit [redacted]
It is agreed this customer and [redacted] /Presidio Construction | Pools | Spas went into contract in June of for a pool and spa combination on their property, and a $1,deposit was accepted for down payment for good faith of contractAt the time of contracting, the only issue discussed was flood control channel, there was no discussion of septic issuesIt is the customer’s responsibility to disclose any known issues and septic was not brought to my attentionI assumed as a newer home on a small lot, that it would have already been tied to sewer so I didn’t think to ask about septic issuesEngineering was purchased, plans and application were submitted by Permits in MotionPermits in Motion received an “AS BUILT” septic plan repair, submitted by BMB Septic for previous homeowner in from the Department of Environmental Health (DEH)DEH would not approve current septic layoutAfter discussions with BMB Septic, Permits in Motion, and Customer, the experts though a permit was possible without obtaining an “Engineered” septic system plan, as that would greatly increase the cost of their permitAfter these discussions, my Customer also decided to reduce the contract to a pool only, omitting the spaPermits in Motion met with several DEH employees before finally being able to meet with the head of DEH after three weeks of pursuing this issueAt that time the head of DEH said it was not possible to obtain a permit for this residence without an engineered septic planAt this time, my Customer asked for his $1,deposit backI explained the deposit is good faith of the contract but under the circumstances I would rebate any money that had not already been spent during this permit processTo this date, I have requested several times for an invoice and the plans, and have still not received any bill from Permits in Motion for this job, nor have the plans been returnedPresidio Construction | Pools | Spas costs incurred to this point are as follows: Drawings $Engineering $County Assessor Map $Storm Water Application $Consultation with BMB Septic $Permits in Motion $____ $(plus Permits in Motion fees) Presidio Construction | Pools | Spas is still willing to reimburse Customer for any monies remaining once the Permits in Motion invoice is received, and still plan to return Customer’s plans once they are returnedAgain, I have tried contacting them several times and have not had any responseIf he would like to try contacting them directly I will gladly supply the contact information I have for themSincerely, [redacted] Owner, General Contractor
