I'm doing a month to month will be moving out. Paid my rent and office left notification on my door that I owe more with an eviction notice which I do not like. Was going to go ahead and pay the additional and and for some reason my western union account was closed. Went to the office to find out what to do and the office tells me now that they want more than want is on the paper they left on the door.

Contract specified to give 90 day move out nitice. Letter was typed notarized and given to facility in proper time. Their word against mine.
Contract stated we needed a notarized notarized of when we are moving. I got a letter typed,notarized,and submitted within a timley manner. The office later contacted me in question of renewing my contract. She stated along the lines of being pentalized for not having submitted the paperwork. After stating I have submitted this she continued to argue and would not accept another letter. We moved out the date of the letter which would have been the last day of the contracted lease. I do not have specific dates. It has beem almost 7 years. I am trying to rent a home and this is against my credit as a eviction. We were not evicted.

Desired Outcome

I do not wish yo owe this business money a d I would like my credit adjusted properly.

Ms. was a resident along with Michel Harris in apartment 2006, they moved out at the end of their lease term on 5/30/2013. Per their lease, a written 30 day notice was required prior to move out. Our records indicate they moved out without providing said notice and caused $1,771.67 worth of damage.
Ms. stated she provided a notarized 90 day notice, although the required notice was 30 days and written, not necessarily notarized, we do not have a copy. I have asked Mr. Harris for their copy. If they are able to produce the notarized notice, we will review and amend their account accordingly.

Prescott Place uses false advertising.
Also makes people put a $100 deposit down.
While Prescott did their very intensive background check on me. To see if I was 'good enough' to live there. I checked my daughter and I into a Motel 6 7 minutes away. We witnessed gang bangers, drug dealing, prostitution, etc... It was a VERY dangerous location to say the least. So I left the area with my daughter. Prescott Place is in a horrible area! I am on disability. I just moved to TX from IL to escape this kind of crime.
Why I said Prescott practices false advertising is because on their website they claim to have 4 swimming pools. When I did my walk through Karla verbally told me 2 pools. On my print out guarantee rent price it says 3 pools. I just want my $100 back.

Ms. filled out the standard TAA application in where she identified that she agreed that, were she to cancel her application, her deposit would be retained as "liquidated damages".

This is, in fact, one of the safest communities in Mesquite with very little crime. Where Ms. could have seen all of this activity as she claims is unknown to me but, I assure you, it was not here.

AS for the pools, the website states 4 pools because that is what we had prior to filling one pool in last summer. There are, in fact, three swimming pools for our residents to enjoy.

We are sorry that Ms. decided to take the course that she did but the application is signed, the terms agreed to and, under Fair Housing rules, she cannot be treated differently that anyone else. The deposit is retained.

There was no false advertising, in any way, shape or form.

THIS IS MY 4TH TIME CONTACTING THE OFFICE REGARDING THIS ISSUE. THERE IS NOW MOLD IN THE FLOOR AND THE WALL IN MY APARTMENT. MY SON HAS RESPIRATORY.

Carpet Cleaning/Wet Vac THIS IS MY 4TH TIME CONTACTING THE OFFICE REGARDING THIS ISSUE. THERE IS NOW MOLD IN THE FLOOR AND THE WALL IN MY APARTMENT. MY SON HAS BEEN HAVING RESPIRATORY ISSUES OFTEN AND RECENTLY HAD TO GO TO THE ENT. IT HAS BEEN CONFIRMED HE HAS BEEN EXPOSED AND ALLERGIC TO MOLD. I AM ASKING TO BE RELEASED OUT OF MY LEASE. DUE TO THE HEALTH PROBLEMS OF MY SON. I EVEN STARTING TO SMELL.

FIRST COMPLAINT ABOUT THE FLOOR BEING WET WHEN IT RAIN WAS BEGINNING OF SEPT. XX XXXX. BUT THEY DID DOCUMENT THAT REQUEST WITH THE REQUEST ON THE 14TH OF SEPT.

I CAN'T EVEN USE THE ELECTRIC SOCKET IN THAT WALL. IT GIVES OUT ELECTRIC SPARKS. THE WALL IS SOFT AND CAN BE PUSHED IN. I HAVE BENN HAVING TO STAY WITH FAMILY BECAUSE OF THIS ISSUE HAS NOT BEEN RESOLVED.

Desired Outcome

I AM NEEDING TO BE RELEASED OUT OF THIS APARTMENT FOR THE HEALTH CONDITIONS OF MY CHILDREN AND MYSELF. IT IS AN UNSAFE PLACE TO LIVE IN.

We first received the complaint from Ms.. Brown on 10/13/18, the same day she filed this report. The unit did have a leak and it was explained that, upon drier weather, we could go on the roof and repair it, which we did.

We too the normal steps in a leak issue: Pulling the padding, drying the carter, etc. We sealed the walls with KILZ to prevent any mold. he padding has now been replaced, carpets cleaned, walls painted. There is no smell or sign of any mildew in the unit.

We have checked all electrical units. They all work fine. We find no soft walls.

As to Ms. Brown's assertion that she is staying elsewhere, we disagree. In fact, many people stay in that unit on a daily basis.

Shelia completely took my deposit and application fee saying that it will secure my apartment. She stated that it would hold my apartment until I am ready to move in. Her exact words were "you can move in whenever really all we need is your desposit". She knowingly took my money verified with me the move in date and then told me that my apartment was given to someone else. She deliberately took that money without delivering the purpose of it. The manager Richard just took her back. I see from previous reviews that this type of thing is a habit for these people. I am thankful that I did not get a chance to actually sign a lease with them after seeing how they scammed me for $235. He ( Richard) did not give me my money back even though the purpose of the deposit was to secure the apartment. PLEASE DO NOT DO ANY TYPE OF BUSINESS WITH THESE MONEY HUNGRY SCAMMING STAFF MEMBERS. They truly should be out of business for the things they have done to innocent people just because they can do it. They are hateful, rude, and inconsiderate of anyone other than theirselves. It's sad but again I'm thankful that Shelia stopped me from signing a lease with them. That's the biggest blessing out of all of this madness.

Ms. Borden applied in early December for a Move In date of January 1st. She signed the paper that outlined her costs and apartment for January 1st. The Date was written on the paper. January 1st came and went - no Ms. Borden. Calls to her were not returned. Therefore, the application was cancelled and the deposit was held, per the contract she signed, as "liquidated damages". She even initialed next to that clause.

It costs money to keep a unit off of the market. That is the reason the Texas Apartment Association has that clause in their Application to Rent. We do not rent its for "whenever". We rent for specific dates and we tried for 9 days to get a returned call from this person and, finally, cancelled the application and rented the unit to another applicant.

In fact, Ms. Borden dd not come in to Move In. Se came in to cancel her application which, again, forfeited her deposit.

The deposit was help by law ad correctly as was explained to Ms. Borden.
