Attached is a copy of our response to Mr***'s complaint.July 10, 2017Mr*** *** *** ***Lexington, KY 40517RE: Re-pressure Three (3) Piers at Front Right Corner of the ResidenceOn September 20, 2006, MrSteve W*** with Dwyer Concrete Lifting arrived at *** *** ***,
Lexington, KY and met with MrAdam *** At that appointment, MrW*** sold Mr*** a total of seven (7) steel push piers Four (4) of the piers were located at the back left corner of the house and three (3) of the piers were located on the front right corner of the house On November 13, 2006, Dwyer Concrete Lifting arrived on-site to install the seven (7) steel push piers On November 14, all seven (7) of the piers were installed and the project completed On February 15, 2008, Dwyer Concrete Lifting arrived back on-site to check the pressure of two piers installed in November The piers had lost pressure during this time The piers were re-pressured and Dwyer Concrete Lifting added two (2) additional piers at no cost to Mr*** The two additional piers were added to the left front corner of the house, next to the garage.On November 19, 2012, MrMike M*** with Dwyer Concrete Lifting met with Mr*** to look at the back of the residence this time At that time MrM*** wrote an estimate for seven (7) piers along the back of the residence The estimate stated that the customer would remove the deck boards and Dwyer Concrete Lifting would remove joists as needed and tuckpoint in the working area Dwyer has not performed any work on this residence since 2008.On June 13, 2017, Mrs*** *** contacted The Dwyer Company to notify us that the front right corner of the house had moved again Mrs*** spoke with MrDave Jacob, President of The Dwyer Company On June 21, 2017, MrWesley M***, Regional Manager with The Dwyer Company met Mrs*** to observe the front right corner of her residence MrM*** observed a crack in the working area at the front right corner MrM*** explained to Mrs*** that The Dwyer Company would service her piers at no cost to them While on-site, MrM*** observed the other piers on the left side of the house The other piers looked to be doing what they were designed to do Page #2Adam *** Mrs*** contacted MrM*** back on June 23, 2017, and stated that she had no confidence in Dwyer and that she wanted to go with another Foundation Company Mrs*** asked The Dwyer Company to pay her $2,towards the bill of the other Foundation Company MrM*** told Mrs*** that The Dwyer Company was still willing to come out and re-pressure the three (3) piers on the front right corner of her residence Mrs*** declined to let The Dwyer Company re-pressure the three (3) piers on the front right corner of her residence at no cost to Mrs***.The Dwyer Company’s goal is to be professional and hard working I hope that all parties involved find that our company is willing to stand by our contractual agreement made with our clients Thank You,Wesley M***The Dwyer Company Kentucky Regional ManagerContract StreetSuite 200Lexington, Kentucky

Complaint: [redacted]We are rejecting this response because: What Mike B[redacted] of Precision Painting is stating are manufactured lies.
First of all, His Painting job was not up to PDCA Painters Industry standards (Painters Standards of practice) which clearly state; "PDCA P1 2.3 The painting and decorating contractor will produce a "properly painted surface." A properly painted surface is defined as uniform in appearance, color, texture, hiding and sheen. It is also free of foreign material, lumps, skins, runs, sags, holidays, misses, or insufficient coverage. It is also a surface free of drips, spatters, spills, or overspray caused by the painting and decorating contractor's workforce." Mike's bid / contract clearly states that with the "Painted wood work - caulk all gaps & cracks, fill all holes and sand smooth, prime all wood work and doors with oil, put 2 coats of ProClassic oil, or waterborne ALkyd on all trim & doors (semigloss)". When Mike contracted with us for the WHOLE HOUSE, he stated that his bid was complete to provide these services to restore our home after a flood had occurred to our custom home. There were no EXTRAS requested from the original work as Mike B[redacted] is stating. However, when the job was nearly completed, and the problem areas were pointed out to him, he packed up his equipment, stated that he would have to return on a weekend to finish up and walked out with 2 gallons of Arora Benjamin Moore paint that were CUSTOM mixed for our custom home in addition to all of his equipment. However after a month of no contact with him, we wrote him a letter asking for a date that we could expect his return. His reply sent was a bill.
Prior to his walking out, there were several areas of concern brought to his attention, namely, visible and palpable nailholes and pulled up painted areas on windowsills throughout the main floor that were not fully filled but were painted over, cracked caulking around several windows, a ceiling medallion with visible lumps, flashing on at least 2 major walls, thin coats of paint in a couple of rooms which did not fully cover the undercoating, overspray on all windows and mirrors throughout the house (estimated to clean approximately $800.00) as well as overspray on walls, overspray on tile floors under closet builtin's, all outlets over sprayed that now have to be replaced (a bid for replacement which can be provided), he refused to paint an empty closet that just had the gallon of paint in it required to finish it, he did not paint the shelf trims in the closets (that we had a conversation about, because at one time he had stated that he was going to paint the shelves as well as the woodwork and we requested that he not paint the shelves because they are Melamine and we didn't want them painted, just the woodwork rails), most of the 21 doors that he painted have raw skint marks on most corners of the brand new two panel arched doors and poor coverage on many. He also only stained but did not Marine grade finish the NEW replacement Mahogany front and side doors per contract. There were at least 2 areas of heavily dripped runs that we, the homeowners, called him on to correct and he did not return. Due to his word of returning on a weekend, we paid over half of the remaining bill and put a hold on the rest until the job was completed. His contract clearly states that payment is due upon COMPLETION (reference the contract he provided in his Revdex.com response). The job is not satisfactory, nor is it complete. NO WHERE in his contract does it state that the BRAND NEW ceilings with Brand new texture were not to be primed as per contract and as per previously discussed. This is one of many examples of false statements that Mike is submitting to the Revdex.com regarding this situation. Pictures can be provided upon request.
We have given Mike B[redacted] over 4 months time, exchanging certified letters in an attempt to rectify this situation and although we have been Very Lenient with him in an attempt to allow him to correct the errors he provided, we now feel that we are forced to hire someone else to finish his job. The first bid we got was for $8449.65 from a local contractor to come in and finish up on the workmanship listed above and repair the doors and windowsills and respray them to give them the new quality that they should be given, since they are all replacement, brand new doors of a reputable company. We have given Mike the opportunity to come in and shorten the list of projects to correct, giving someone else a smaller list of the things that Mike is REFUSING to do, like repair the window sills and doors up to standard (which up until this response, per the certified letters, he was going to charge us more to repair the errors he made), which would have given him more funds to receive in the end, after paying the person who is willing to come in and clean up after Mike.
There is no founded facts regarding his allegation that we have a history of not making payment to contractors. He is more than welcome to provide proof of names and services if he is so willing to make such false allegations.
Initially, when we asked him to come look at the issues, he stated in writing (certified mail) that he "does not do walk throughs", that the homeowners do that. We did and invited him to come address the issues and it wasn't until we gave notice that we would have to be forced to hire someone else, that he finally conceded to come look at the issues. Since then,, he has been given every opportunity and ample time to correct these issues. Instead he has resorted to liable. He is not providing a solution to the issues so we are rejecting his response. Per our conversation on the phone with him in our final attempt to rectify these issues on July 13, 2016, he stated that if we paid him $2,500.00 without further repairs, that he would "just disappear and we would never see him again". Due to the financial burden this would cause us based on the bid that we have received, we are unable and unwilling to do this and NONE of the problems would be rectified.

Hello. I did talk with Mr [redacted] about his concerns. I let him know that we could not lightly pressure wash the gutter fronts because the paint would peel off. My foreman informed me that the crew did not use the hose on the back of the Home or left the water running. We did tell him the roof cap...
needed some repair as a courtesy for him. I talked with him and he held $ 100.00 of the total for not washing the gutter fronts. He did pay us and this has been resolved. We strive for Customer satisfaction and do achieve this goal with all of our Customers.Thank You.
