To Whom It May Concern: I am responding to your letter regarding a "Delivery Issues" complaint in font-size: 11px;">referenced case. Portraits by Precious Moments, LLC (PMI) provides a complimentary family portrait to all families that donate to the local volunteer fire department and/or rescue squad that our sister company works with as a way of saying "Thank You" for their support. Appointments are scheduled after the photo shoot for the families to return to view and/or purchase additional photos. Mr. [redacted]'s family didn't make the return appointment for the viewing and the project was completed for the volunteer squad we were working with. Generally when a customer misses their appointment, PMI sends a letter telling them that if they send $10 to cover shipping and handling their complimentary 1Ox13 portrait and samples will be sent to them insured; however in this instance, the photos were sent out at our expense and not insured. This was explained to Mr. [redacted] on numerous occasions but he insists on us sending it out for free. Mr. [redacted] was told to take his complaint to the USPS or send $10 and we would gladly reprint his 1Ox13 and send it insured but he refuses to do so. Instead, he continually calls my office (18 times over this past weekend) and harasses my personnel, stating that he will be the biggest pest I have ever seen and he plans on continuing to call until I send him his photo for free. If the calls continue, I will be forced to get a "Cease and Desist" complaint on Mr. [redacted]. Mr. [redacted] states that he purchased the photos for $25.00, however this is not true. Mr. [redacted] made a contribution to the local volunteer rescue squad and as a way of saying "thank You' for his support, received a certificate for a free 1Ox13 family portrait. PMI is under no obligation to reprint the photo at our expense since the damage was clearly done by the USPS and Mr. [redacted] didn't pay anything for the shipment of the items in the first place.
