I am a first time dog buyer, I was interested in getting a chocolate Labrador from *** at Prairie State Labs. I was referred to her by *** at ***. I then proceeded to call *** to see if she had any puppies available. She answered the phone while driving in the car after picking up a new puppy. She told me that she would call me back when she got home. Once she got home, we started talking about the available puppies. Since she has been a dog breeder since 2011 I trusted that she would inform me on everything I needed to know from the start. She told me that I would have to put a down payment on the puppy since they sell quickly and they won't be born until August 14th. I paid the $400 deposit on July 10th at 2:37pm, at that moment she failed to mention that I would still need to pay another $600 at pickup. I was under the impression that the entire cost of the dog was $400, I soon found out after I sent her the deposit money that I would still need to pay $600 more. Two and a half weeks later I lost my job and could no longer afford or provide the puppy a suitable home, I then proceeded to message *** that I could no longer purchase the puppy and that I wanted my deposit back. I assumed that since the puppy wasn't born yet that it wouldn't be difficult for her to find another buyer (the puppies birth is set for August 14th). After messaging her about a refund she expressed that she would not give my money back and that from the start my deposit was "non-refundable." However, until I asked for a refund, she had never stated that the deposit wasn't refundable. She offered to hold the deposit for a later litter, unfortunately I can't predict where I'll be or what my situation will be months from now so I declined her offer and kindly asked again for a refund. She denied it 3 times then blocked me on *** and my phone number, she hasn't provided a good faith effort to resolve the situation whatsoever. No contract was signed or shared between us for the deposit or puppy.
contacted me July 10th about purchasing a puppy, he was referred to me by another buyer. It was explained that the total cost of the puppy would be 1100 and a non refundable deposit was required as I already had 3 spoken for and he was completely okay with this arrangement. Note he refers to the money sent as a deposit, not a 400 purchase. He in fact did contact me requesting his “deposit” back and I generously offered to apply to a future more conveniently timed litter for him which he declined forfeitIng his deposit.
I am rejecting this response because: Now the total cost has changed a second time. It was never established that it would cost $1000, now it is being argued that it would cost $1100? I never signed a contract or agreement for that outrageous price, I was never informed that the deposit was non-refundable. I had seen on *** that there was in fact a history of previous refunded deposits between *** and other customers, I can no longer provide that evidence because she blocked me. Even on her facebook website she states that she would be "more than welcome to return it to me, I do not ever want any of my dogs to end up in shelters," no where does it state that a deposit would be non-refundable!
