We deeply regret our customer’s dissatisfaction It is our company’s goal and in fact our company’s policy to treat every customer and every transaction with the utmost integrity Although we did not then and do not now believe their complaint had or has any merit whatsoever for all the reasons stated in our response to their initial complaint, we have offered replacement loads of the same material or loads of alternative material that they also trade in as a courtesy because we strive for the highest level of customer satisfaction We were very surprised that they lodged a complaint after we were notified in writing that the material had arrived in Malaysia and been accepted Interestingly, in that same email of acceptance it was noted that the price for this material would not work for new loads of the same material moving forward It should be noted that this email was received a full days after our customer‘s customer picked up the material from our location As stated in our initial response, Polamer Plastics offered us an opportunity to inspect the material at their customer’s customer location in Malaysia Again, we reiterate that this was a ridiculous offer because at that point, the material had passed through multiple layers of ownership and Polamer had also purchased other loads of the same material, at the same time as our loads, from other sources, and all containers arrived at their customer’s customer site at the same time, making it impossible for us to reliably verify what we are looking at and what they actually tested at that location Nevertheless, they accepted the material in writing days after picking it up Following that, they appeared to have ‘price remorse’ as prices had dropped during the period between the time they picked up the loads and the time they delivered the loads to their customer’s customer We stand behind our original response 100% We consider this a baseless complaint and potentially injurious and we will defend our reputation and our material quality vigorously using all available resources, including legal avenues, to preserve our integrity Please do not publish any complaint against us in connection with this matter as the complaint is completely and fully unfounded

In response to complaint# ***, your instructions ask us not to
include any information that personally identifies our customer, yet we are
personally identified in their complaint.
Second, the customer information that you sent us identifies a person in
the Customer Information
section that we have never met, spoken to or had any interaction
with whatsoever. However we believe the
complaint is actually coming from an individual related to the person mentioned
in your Customer Information section
The complaint is erroneous and disingenuous in its entirety. The presumed relative of the complainant with
whom we dealt at Polamer Plastics (who disclosed to us that Polamer was
brokering/flipping this material to another broker who was brokering/flipping
it to an end user located in Malaysia) purchased 132,lbs +/- of *** #
black washed agricultural film bales from us in July 2015. Prior to the purchase, upon Polamer’s request
(Polamer is our customer), multiple representative samples of the material were
sent to Polamer (broker/flipper) and to Polamer’s customer (broker/flipper) and
from thereon we do not whether the samples were sent to the final
company/end-user; however Polamer Plastics accepted the samples and sent us the
purchase orders for the material.
As for moisture, ash content, dirt clumps, etc., that is erroneous and
an extreme exaggeration. The material
was sampled multiple times by both brokers/flippers and presumably the end
customer. We would assume they and/or
their customer would have tested the material to see if it would work in their
application prior to issuing purchase orders.
The material was picked up by our customer’s customer on July 12,
(containers) and July 21, (container). Nearly days later, we received an email
from Polamer in response to an email we sent inquiring about his customer’s
level of satisfaction with the material as we had not heard from him. In response to our inquiry, Polamer replied,
““Yes, he said - Previous price
for this material will not work? - Material is good but not nearly worth
that price.” (This came as no
surprise because within that day period, the commodity market price for this
material had dropped.)
Within the next day or two, Polamer changed the assessment of the
material and lodged their complaint with us about quality and price. We responded by reminding them we shipped
what they sampled, they picked up the material, and they remitted payment. However, although we did not believe the
complaint was legitimate and was in fact was driven more by the decline in the
commodities market, we wanted to maintain a positive relationship with them so
we offered them replacement loads or alternative materials at our expense in an
attempt to satisfy them and maintain a good working relationship. All proposals were rejected.
Subsequently, Polamer sent us test results from a company in Southeast
Asia reporting negative results. We have
no way of knowing what material was tested, the qualifications of the testing
company, or the chain of ownership/possession of the material we supplied. We also understand from emails sent to us by
Polamer that he purchased multiple loads of the same material we supplied from
another vendor at the same time he purchased our material, and both our
material and their material arrived at Polamer’s customer’s customer at the
same time. This causes us to further question
the chain of ownership/ possession of the material we shipped. Polamer offered us the opportunity to inspect
the material at their customer’s customer site in Malaysia knowing full well it
was a ridiculous and disingenuous suggestion as we had no business with their
customer’s customer
To summarize, this complaint is completely without merit. It is highly unsubstantiated and is
completely unverifiable in any way due to the multiple layers of ownership,
brokering and flipping that this material went through prior to any complaint
was noted. Furthermore, in an email in
October from Polamer, the material was pronounced good, but pricey, essentially
buyer’s remorse based on price.
Additionally, the complaint arose over days after the complainant’s
customer picked up the material from us.
We consider this a baseless complaint and potentially injurious and we
