First, Ms *** doesn't know what she is talking about as she hasn't checked into the gym in over a yearWhile our air conditioning was broke, we installed brand new commercial units on Tuesday July 14th; and yes we did hang signs apologizing for the heat, obviously broken A.Cis unexpected and
we were genuinely sorry it was hotThe turn around time on commercial A.Cunits is not quick but we got them installed ASAP as it was a top priority to us Just because it doesn't appear to *** that we were working on the issue doesn't mean we weren't. Second, *** *** purchased an month Paid-in-full contract in February At the time of the purchase, the previous owner, World Gym, was running a special that included a 'bonus' months with an month paid-in-full contractThe price of her contract was prorated over months and the month bonus added at the endThis is clearly outlined in the contract she signed upon registrationBecause the contract is an month contract, and not a month contract as ** *** mistakenly stated in her complaint, there is no money to be refunded as her contract is currently in bonus. Third, the person that answered the phone when ** *** called left me a message requesting I research her contract and to get back in touch with her I called *** *** and left a message, she never returned my call.We provide a safe and clean environment in which to workout and we care deeply about our member and their safety and comfort levelsWe do not appreciate *** *** slander against our facility because she feels entitled
Revdex.com:I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.
Thank you for your response. I have rejected Pocatello Athletic Club's (PAC) response because of the following:
• I have not received any phone calls or voicemail's from anyone affiliated with PAC.
• They stated that I haven't been to the gym for over a year which leads me to believe they do not have the correct membership and contract pulled up.
• I was last at the gym in June 2015, where it was unbearable to workout because of no air conditioning or ventilation, I have not been back since. I know the AC has been broken for the majority of summer because I work with people that go there and they've had the same complaints.
• I paid $455.80 for a 24 month period, which works out to be right around $18.99/mo. The membership fee at that time was $19.99, I am not sure why I was charged $18.99/mo; maybe because I paid two years in full or it was an honest mistake. I did not receive 6 months free for paying in full or I would have only been charged $359.82 at $19.99/mo. I am attaching a picture of my contract and a snip from credit card statement.
• The contract I signed clearly states that membership fees can be refunded at a pro-rated rate for various different reasons that I believe my situation falls under. I have attached a picture of that part of the contract with the applicable sections underlined.
All I wanted from PAC was to acknowledge my concern and my contract looked at, which I feel neither has been done after reading their response to my initial complaint. I feel I do deserve a partial refund of the total paid in the amount of $160 for the time June 1, 2015 - February 11, 2016 because of the gym being in less than desirable workout conditions. And the contract I signed states that if the gym has relocated more than 10 miles away, or has closed, a pro-rated refund is due to the member within 15 days of complaint. World Gym did both of the following and I was not given any notice that the gym was being bought out when I signed and paid in full for another two years. Had I known, I would have only signed a month/to-month contract. The owners of PAC bought out all the contracts when they took over World Gym. I think it's only fair to honor those contracts.
Thank you for your time in this process.
Sincerely,
Janna M[redacted]
Thank you for allowing Pocatello Athletic Club ("PAC") an opportunity to respond...we are always happy to provide feedback as well as explain our business operations. We have been in contact with the aforementioned individual and working on a settlement as clearly this was miscommunication...
surrounding several of the particulars. As is typical in this industry, members enter into a legally binding contract when committing to Membership Agreements. These Agreements bind PAC to our members and members to PAC for a period of either 12 or 24 months. Industry standards such as Agreements require patrons to make financial commitments to gyms/clubs for the term of the agreement; it's simply a cash/revenue stream for the industry. In this incident, there were two Agreements/Membership Contracts in question; one for membership dues and a second for child care (PAC Kare). Each Agreement was for a term of 12 months with a "30-day let" in the event of a relocation outside of 30 (thirty) miles from the community. While there was a cancellation request, it was made during the term of the Agreement, month 4 of the term resulting in a loss of 8 months of revenue. To PAC's knowledge, no relocation or residence change was made, therefore the contract was not cancelled. The misfortune was clearly a service issue for our patron, Cameo. She was patient and attentive to staff members and she did in fact, make an effort via social media to resolve the issue. Again, referring back to the Agreement, any form of membership cancellation is required to be in writing (hard copy) and PAC records reflected only a request for ONE (1) of the Agreements in dispute (PAC Kare). This particular incident is clearly an apples to oranges story; membership agreement vs. PAC Kare agreement. Our discussions with the patron have been productive thus far and we feel very confident a settlement is near. Thank you for allowing an open forum for follow up. We hope all of our patrons are as approachable as [redacted].
